sec.117C Relevant approvals
A development approval or water approval given for premises is a relevant approval if— the premises are on land in a priority development area; and the approval is given after— the day the priority development area is declared; or the day the land becomes part of the priority development area, if that happens after the priority development area is declared. A development approval or water approval given for premises is also a relevant approval if— the premises are on land in a priority development area (whether the priority development area is declared, or the land becomes part of the priority development area, before or after the approval is given); and the approval is changed or amended after— the day the priority development area is declared; or the day the land becomes part of the priority development area, if that happens after the priority development area is declared. See sections 44 , 45 , 247 and 248 for when a development approval under the Planning Act may or may not be changed after a priority development area is declared. s 117C ins 2024 No. 32 s 39 (sec.117C-ssec.1) A development approval or water approval given for premises is a relevant approval if— the premises are on land in a priority development area; and the approval is given after— the day the priority development area is declared; or the day the land becomes part of the priority development area, if that happens after the priority development area is declared. (sec.117C-ssec.2) A development approval or water approval given for premises is also a relevant approval if— the premises are on land in a priority development area (whether the priority development area is declared, or the land becomes part of the priority development area, before or after the approval is given); and the approval is changed or amended after— the day the priority development area is declared; or the day the land becomes part of the priority development area, if that happens after the priority development area is declared.
- (a) the premises are on land in a priority development area; and
- (b) the approval is given after— (i) the day the priority development area is declared; or (ii) the day the land becomes part of the priority development area, if that happens after the priority development area is declared.
- (i) the day the priority development area is declared; or
- (ii) the day the land becomes part of the priority development area, if that happens after the priority development area is declared.
