240 Powers of State to control Project (1) If the State exercises a power under the Agreement to assume control of the Project, the State has and may exercise all the powers of the Freeway Corporation under— (a) this Act and the regulations; and (b) the **Road Management Act 2004** and the regulations under that Act; and (c) the **Road Safety Act 1986** and the regulations under that Act relating to traffic control devices. (2) The State may authorise any person to exercise any power conferred on the State by this section. (3) Despite anything to the contrary in this Act, the **Road Management Act 2004** or the **Road Safety Act 1986**, the Freeway Corporation is not entitled to exercise any power while it is conferred on the State by this section. (4) A power conferred on the State by this section must be exercised in accordance with the Agreement. Division 6—Powers of Authority to investigate
