13 Delegation by Minister S. 13(1) substituted by No. 14/2005 s. 11. (1) The Minister may, by instrument, delegate any of the powers of the Minister under this Act or the Agreement to— (a) the Authority; or S. 13(1)(b) repealed by No. 49/2019 s. 186(Sch. 4 item 15.5). (c) a person employed under Part 3 of the **Public Administration Act 2004**; or (d) a public authority. (2) A delegate of a power under subsection (1) may, subject to any conditions to which the delegation is subject, sub-delegate that power to any other person or persons or body if the instrument of delegation authorises its sub-delegation. (3) Sections 42 and 42A of the **Interpretation of** **Legislation Act 1984** apply to a sub-delegation authorised by this section in the same way as they apply to a delegation.
