121 Surplus land (1) The Authority, with the approval of the Minister and the Minister administering section 12 of the **Land Act 1958**, may determine that certain Crown land in the Project area is not required for the Project and is surplus land. (2) The Authority must publish a copy of a determination under this section in the Government Gazette. (3) This section does not apply to— (a) land reserved or deemed to be reserved under the **Crown Land (Reserves) Act 1978**; or (b) leased land; or (c) licensed land; or (d) land for which the Agreement requires a licence to be issued under Division 2 or a lease to be granted under Division 3.
