Declaration under section 248 of the Environment Protection and Biodiversity Conservation Act 1999 - List of Marine Species

The declaration operates around three main concepts that are explicit in the text: (1) a statutory source (s 248 of the Environment Protection and Biodiversity Conservation Act 1999), (2) the act of declaration by the responsible minister, and (3) the catalogue of taxa declared to be on "a list of marine species". Each of those concepts is visible on the face of the instrument and frames how the list will be read and used.

Statutory source. The instrument repeatedly identifies s 248 as the enabling provision. The text commences: "I, ROBERT MURRAY HILL, Minister for the Environment and Heritage, in pursuance of s248 of the Environment Protection and Biodiversity Conservation Act 1999, hereby declare..." That locates the measure as an exercise of a statutory power, not as policy guidance or departmental advice. The declaration itself does not restate s 248’s content; it only records that the minister is acting under that section.

Ministerial declaration. The instrument is signed and dated by the Minister. That indicates the decision-maker and the executive character of the instrument. The declaration is not framed as a regulation, but as a discrete decision: "shall be deemed to be established by inclusion of the following species." The language of deeming is important: it creates a statutory fiction or legal recognition of a constructed list rather than presenting a set of management rules. The instrument does not include delegations, conditions, or a procedural preface explaining prior steps (consultation, scientific advice) on its face.

Taxonomic catalogue. The core of the instrument is the taxonomic catalogue. The list is organised by higher taxa (Order, Family) and sets out scientific names and many common names. It includes marine reptiles (sea snakes in Families Hydrophiidae and Laticaudidae; crocodiles; dugong; marine turtles), a broad set of marine fishes within Syngnathiformes (Syngnathidae and Solenostomidae), a large suite of seabirds and shorebirds across numerous orders, and marine mammals (otariids, phocids). The catalogue contains different kinds of entries: species names, subspecies, informal species placeholders (for example "Corythoichthys sp 1"), and some entries with "cf" or other qualifiers (for example "Halicampus cf dunckeri"). The list thus blends formally described taxa and taxa of uncertain taxonomic status as recorded by the instrument.

Absent elements. The declaration does not specify what "marine species" means for the purposes of the list, nor does it set geographic or jurisdictional boundaries, provide references for taxonomic authority or dates, or offer guidance on synonyms and taxonomic changes. It does not indicate whether future taxonomic revisions will be automatically reflected or whether re-declarations will be necessary. Those omissions are technically significant because the legal and administrative consequences of listing often turn on clear taxonomic identity, distribution, and definitions of what counts as "marine" for regulated activities.

These main concepts together mean the instrument is a statutory instrument of inclusion rather than regulation of conduct. The legal force of being on the list must be sought in the EPBC Act itself, and the declaration is best read as the ministerial act that places the enumerated taxa into a list that the Act recognises under s 248.

The declaration names the minister as the decision-maker and the EPBC Act as the legal basis, but the text itself does not identify a closed list of affected third parties. Nevertheless, the instrument will have immediate administrative and practical relevance for several categories of actors; those categories are inferred from the mechanism of inclusion into a statutory list and the identities of the taxa included in the list.

Operators in marine and coastal industries: Fishers, aquaculture operators, charter-boat operators, vessel owners, offshore developers, coastal infrastructure proponents and mining or petroleum operators who undertake activities in marine, estuarine or coastal environments are likely to be materially affected if the Act attaches control, assessment or permit-triggering status to species on the list. The list contains taxa with marine life-cycles, migratory seabirds and coastal-dependent bird species; any project that may interact with these taxa could face additional compliance steps. The declaration itself does not impose the steps but then becomes relevant where rights, permits and approvals depend on the list’s composition.

Public authorities and regulators: Federal environmental agencies and relevant state/territory conservation agencies will have administrative responsibilities around implementing any statutory processes that rely on the list. The declaration provides an authoritative list that agencies must reference when administering any enumerated-species-based provisions in the Act, for compliance, monitoring, and report generation. The instrument names the Minister as the actor who declared the list; subsequent administrative decisions will flow from the department and its delegated decision-makers.

Researchers and museums: Taxonomists, marine biologists, monitoring programs and biodiversity data custodians will need to reconcile their records with the ministerially declared list. The list includes many taxa that are subject to research permits, collection conditions or export/import rules in other regulatory contexts; how those interact with the EPBC framework depends on the Act’s provisions and on whether the list is used as a trigger for permitting or other measures.

Indigenous and local communities: Communities that hold rights, customary usage or economic practices connected to the listed taxa may see practical effects in areas such as subsistence, cultural activities and local fisheries. The declaration contains a number of species that are culturally significant in some communities (for example dugong, certain turtles, and seabirds). The instrument itself does not provide exemptions, but listing may be relevant to how customary activities are treated under the EPBC Act and other instruments.

Commercial collectors and aquarium trade: The Syngnathidae entries (seahorses, pipefish, sea-dragons) are of practical interest to collectors, aquaria and the ornamental fish trade. If the Act’s regulatory framework treats listed species differently for trade, collection and export, businesses operating in that space will be affected. The declaration does not address trade, but it supplies the authoritative species list that enforcement officers and customs may use.

State and territory governments: Many biological resource management functions are co‑operative across Commonwealth and state territory lines. The ministerial list will be a reference point in Commonwealth decision-making that can intersect with state-managed fisheries, parks, and wildlife legislation, or with joint approvals. The instrument itself does not stipulate intergovernmental arrangements.

Because the instrument is limited to deeming the list established, the declaration’s immediate effect is to create the authoritative roster of taxa for any statutory provisions that rely on that roster. Whether those third parties are actually constrained or required to act depends on how the EPBC Act itself and subordinate instruments use the list. The declaration does not itself create permit conditions, authorisations, or explicit constraints , it provides the list which those legal mechanisms reference.

The declaration’s text does not state any duties or rights. It is an act of inclusion: "shall be deemed to be established by inclusion of the following species." Therefore the key duties and rights that will be engaged are those embedded in the Environment Protection and Biodiversity Conservation Act 1999 and any other statutory or regulatory provisions that refer to "a list of marine species" established under s 248. The declaration is the trigger for those downstream duties and rights; it is not the source that articulates them.

What the declaration does establish, on its face, is an authoritative list for administrative purposes. Where the Act creates legal consequences tied to inclusion on that list, those consequences will apply to the taxa enumerated. For example, if the Act requires impact assessment, referral, protection orders, permitting, offsets, incident reporting, or species-specific management plans for taxa on the list, the ministerial declaration makes the taxa subject to those provisions to the extent the Act provides. The declaration does not itself make or explain such duties or rights; it only produces the roster to which they attach.

Because the instrument includes taxa at different taxonomic granularities (species, subspecies, and informal entries), a duty or right tied to a "species" on the list may raise downstream interpretative questions about scope. Examples of interpretative issues that flow logically from the document’s structure are: whether entries such as "Corythoichthys sp 1" are legally equivalent to described species names; whether infraspecific listings (Arctocephalus pusillus doriferus) mean protections apply to other subspecies of that species; and how "cf" and "sp" entries should be treated when matching biological records or enforcement actions.

The instrument does not prescribe rights of appeal, review, compensation, or carve-outs. Any rights of persons or corporations affected by regulatory consequences of listing will depend on the Act’s procedural architecture (for example review rights, merits review, or judicial review availability) which is not reproduced in the declaration. The instrument, being signed by the Minister, indicates the decision-maker whose exercise of statutory power has produced the list; rights to challenge that ministerial act will be determined by general administrative law principles and any Act-specific provisions.

In short, the declaration itself creates neither duties nor rights but supplies the authoritative roster that determines which taxa are subject to any duties, restrictions or entitlements that the Act attaches to listing. Persons who may be affected should therefore map this declared list against the operative provisions of the EPBC Act to identify the precise rights and duties that now apply to activities affecting these taxa.

The declaration contains no penalty clauses and does not establish enforcement mechanisms. It is a ministerial act of inclusion under s 248; the instrument does not create offences, specify sanctions, or appoint enforcement officers. Any penal consequences that flow from presence on the declared list must therefore be located in provisions of the Environment Protection and Biodiversity Conservation Act 1999 or in subordinate instruments that refer to the list established under s 248.

Because the document is silent on enforcement, a concrete compliance and enforcement regime must be derived from statutory provisions external to the declaration. Enforcement tools that a reader might expect to be connected in practice to a statutory species list include administrative enforcement (compliance notices, stop-orders), civil liability (injunctions, compensatory measures), and criminal sanctions (fines, imprisonment), but none of those are in the declaration itself. Whether those tools apply, and the scope of penalties, depends on the Act’s operative sections and any regulations or codes of practice which the Act authorises.

The document’s construction poses enforcement-related interpretative issues that practical regulators and enforcement counsel should note. The list includes taxonomically uncertain or non-standard entries, such as "sp 1" and "cf" qualifiers, which can produce evidentiary complexity in enforcement proceedings. Proving that a particular specimen or incident relates to an entry listed as "Corythoichthys sp 1 - Broken-bands pipefish" requires careful scientific and chain-of-custody evidence. In prosecutions or compliance matters, regulators will need to handle taxonomic uncertainty, synonymy (where the scientific name in an enforcement notice differs from the name in the list), and potential claims about range or identification error.

The declaration does not specify effective dates for enforcement, transitional relief or grandfathering. It is dated 4 August 2000; absent contrary statutory drafting in the Act, the list can be read as operative from its date. That has practical consequences for incidents occurring around the declaration date: whether activities that commenced before that date are subject to newly applicable obligations will depend on the Act’s transitional provisions rather than anything in this instrument.

Finally, because the instrument is silent on enforcement delegations or administrative arrangements, enforcement responsibility will rest on the authorised institutions designated by the Act. The declaration makes clear who made the decision (the Minister) but not who enforces it. Enforcement will therefore be a function of the broader EPBC framework and the administrative agencies empowered by that framework.

The declaration states that it is made "in pursuance of s248 of the Environment Protection and Biodiversity Conservation Act 1999." It is therefore an instrument of Commonwealth administrative law whose legal effects, insofar as they exist, are mediated through the EPBC Act. The instrument itself does not mention state or territory laws, international conventions, trade rules, or other Commonwealth statutes, but practical and legal intersections with other laws are likely in three principal ways.

Reference trigger relationship. Because the declaration produces an authoritative list of taxa, any other legal instrument,Commonwealth regulations, state statutes, territorial ordinances, management plans, fisheries laws or international agreements, that expressly or implicitly references the EPBC list will now point to the taxa named in this instrument. The declaration forms the canonical roster that those instruments must take into account if their text relies on "a list of marine species" established under s 248. Practical examples include cross-referenced assessment lists, protected species schedules, and permit-trigger lists used in environmental approvals. The declaration does not itself incorporate or cross-reference other laws, but it is functionally a building block that other statutory texts will use.

Concurrent jurisdiction and duplication. Many of the taxa listed (for example, seals, sea lions, crocodiles, turtles and migratory seabirds) are species whose conservation and take are subject to state and territory wildlife and fisheries law as well as Commonwealth law. The declaration does not resolve concurrency issues, nor does it pre-empt state laws. Where overlap occurs, regulated parties may face dual compliance burdens: complying with the Commonwealth framework that references the declared list and complying with corresponding state or territory requirements. How inconsistencies, primacy, or delegation are handled depends on the wider legislative architecture, not on this instrument.

International obligations. Several taxa listed are migratory and are covered under international agreements (for example certain migratory birds, turtles, albatrosses). The declaration does not reference international instruments but may be used as a domestic basis for meeting obligations under international conventions, to the extent the Act and relevant treaties interact. Whether and how the list is used to discharge treaty obligations will depend on treaty implementation provisions within the EPBC Act and other Commonwealth policies, not on the declaration itself.

Operational instruments and subsidiary law. The declaration provides a roster that may be incorporated into management plans, recovery plans, and national conservation priorities. Subordinate instruments, regulations, determinations, or administrative guidelines, may reference the species list created by this declaration. The declaration does not itself create those subsequent texts, but it is the source document that such instruments would cite when specifying species-specific management regimes.

Taxonomic and data systems. Practical interaction with databases, permit systems, customs and quarantine lists requires a clear mapping from the names in the declaration to the nomenclature used in other instruments. The list contains non-standard entries and inconsistencies in formatting and editing which will require administrative cross-referencing to avoid mismatches. For example, an international trade or customs regime using a different binomial nomenclature could fail to match an item unless synonyms and taxonomic authorities are reconciled.

In summary, the declaration’s interaction with other laws is entirely mediated through the EPBC Act and downstream instruments. The instrument itself does not amend any other statute or supplant other authorities; its principal legal relevance is that it furnishes the authoritative list that other legal texts and administrative processes will treat as the recognised catalogue of marine species for the Act’s purposes.

The declaration bears a single date and signature: 4 August 2000, signed by the Minister for the Environment and Heritage, Robert Hill. The text contains no express amendment clauses, no revocation language and no histories of prior or subsequent amendments. The instrument presents the list as newly "deemed to be established" under s 248 at the date on the face of the instrument.

Because the declaration does not include a clause purporting to amend or repeal earlier instruments, a reader cannot, from the declaration alone, determine whether it supplants, complements or consolidates any earlier lists. The instrument does not say "replaces" or "amends" or "varies" any previous list. It simply declares that "a list of marine species to that Act shall be deemed to be established by inclusion of the following species." That phrasing can be read as an initial establishment or an addition; the declaration does not itself explain its relationship to any prior ministerial lists.

The absence of internal amendment history requires practitioners to check other sources for a full amendment record. Specifically, to ascertain whether this declaration has been superseded, varied, or revoked, one must consult the legislative register of ministerial instruments, the text and schedules of the Environment Protection and Biodiversity Conservation Act 1999, and any published Commonwealth notices or departmental registries. The declaration itself does not carry a notation of amendment.

The list also contains several entries that are placeholders ("sp 1", "sp 2", "nov. sp.", "cf") and one entry marked "Thalassarche nov. sp." where the list apparently records a not-yet-described species. That raises amendment-related practicalities: as taxonomic research formally describes or revises species, the minister or the administering agency will need to decide whether to amend the list to update names or to add or remove entries. The declaration does not commit to a mechanism for such updates; it simply records the names as declared on 4 August 2000.

In short, the declaration’s amendment history as contained in the instrument is nil beyond its own date of making. Determining any subsequent amendments, revocations or the current status of the list will require consulting the statutory instrument register and the EPBC Act legislative history outside this document.

The declaration itself contains no references to litigation, no case citations and no recorded legal challenges. It is a standalone ministerial declaration with a clear date and signature, but the instrument does not record any legal proceedings, judicial reviews, or administrative appeals connected to its making.

Because the instrument is a decision under a statute, it is subject in principle to judicial review on public law grounds in the Australian courts (for example, procedural fairness, jurisdictional error, or failure to follow statutory requirements), but whether any such challenges were commenced, settled or decided is not reported in this document. The declaration contains no indicia of any litigation history, and none of the cases or judicial authorities are named in the text.

For practitioners seeking to know whether the list has been litigated, whether its scope has been interpreted by courts, or whether enforcement actions grounded on the list have been tested, this instrument provides no information. A comprehensive litigation history (if any) must be obtained from case law databases, Federal Court records, Tribunal decisions, and administrative law reports external to the declaration.

Three practical litigation-related points follow from the instrument’s content. First, the textual vagaries and taxonomic imprecision of the list (use of "sp", "cf", informal common names, and infraspecific designations) create legal points that could be contested in enforcement or review proceedings: identity and scope issues are commonly litigated where lists operate as legal triggers. Second, because the instrument does not specify procedural background, potential grounds of procedural challenge (for example insufficient consultation or failure to consider relevant material) would need to be assessed against the statutory requirements of s 248 and the Act rather than against anything in the declaration. Third, because the declaration is dated and signed, it is a discrete administrative act susceptible to time-limited applications for review or challenge under general judicial review principles; but the existence, outcome or topic of any litigation cannot be inferred from the declaration itself.

The instrument contains a number of drafting, taxonomic and practical features that produce pitfalls for users who take the list at face value. These "gotchas" are drawn from the declaration’s text; they are not commentary on policy but are practical implementation traps that will affect administration, enforcement and compliance.

Taxonomic imprecision and placeholders. The list contains entries such as "Corythoichthys sp 1", "Corythoichthys sp 2", "Corythoichthys sp 3", "Heraldia sp 1", "Doryrhamphus sp 1", "Solegnathus sp 1", "Solegnathus sp 2", "Hippocampus spinosissimus" and "Thalassarche nov. sp." The presence of "sp" and "nov. sp." indicates either undescribed taxa or operational placeholders. Enforcement officers and regulated parties will need to decide how to treat these entries when a specimen is identified to a formally described taxon that was named after 2000, or if a specimen is similar to but not identical to the placeholder. There is no meta-data in the instrument to help with these determinations.

Use of "cf" and informal qualifiers. Some entries include "cf" (for example "Halicampus cf dunckeri") or other informal qualifiers. Those indicate tentative identification and will complicate strict legal matching. A prosecution or permit decision resting on identification will need expert evidence to tie a specimen to the instrument’s provisional taxonomy.

Infraspecific listings. The list includes a subspecies entry (Arctocephalus pusillus doriferus). That raises the question whether protections (if any attach under the Act to species on the list) apply only to the named subspecies or to the species as a whole. The declaration does not clarify whether omission or inclusion of other subspecies is intentional.

Formatting and typographical errors. There are a few apparent typographical anomalies in the list (for example "Phycocedrus eque s - Leafy sea dragon" where spacing or spelling looks incorrect). Such errors can lead to administrative mismatches when automated databases attempt exact string matches against other taxonomic repositories. Agencies should not rely solely on literal string matching when using this list in IT systems.

Scope ambiguity: "marine species" label. The instrument is titled "List of Marine Species" and yet it includes many bird species that are migratory or use coastal, intertidal or inland habitats. Users will need to clarify whether the listing is intended to encompass species for which only some life stages are marine, or whether the label is broader. The declaration does not define "marine." That ambiguity will be consequential where legal obligations are spatially limited to marine environments.

Synonymy and taxonomic change. Scientific names evolve. The instrument does not specify taxonomic authorities, authors, or dates. Consequently, subsequent nomenclatural changes, splits or lumps will create questions about whether a newly named species is covered by the 2000 declaration. Practitioners should anticipate the need to reconcile modern taxonomies with the 2000 list via authoritative taxonomic crosswalks.

Common names and duplicate entries. The list mixes common names and scientific names and includes parenthetical common names frequently. Reliance on common names in enforcement contexts can cause confusion where multiple species share the same common names in different regions.

No effective date clarity beyond date of signing. The declaration is dated 4 August 2000 but does not specify an effective time distinct from that date. For incidents occurring close to that date, parties may need to determine whether obligations applied from the date of signing or from some administrative notification. The instrument gives no transitional text.

These are practical "gotchas" a compliance officer, lawyer or regulator should expect to confront when applying the list in real-world regulatory, enforcement or advisory settings. They are problems of identification, scope and administrative interoperability rather than policy disagreements.

Because the declaration itself is an act of inclusion and does not specify duties, compliance must be understood in relation to the Environment Protection and Biodiversity Conservation Act 1999 and any subordinate instruments that use the list. The following practical, source-grounded steps are tailored for lawyers, environmental managers, compliance officers and operators who must act in reliance on the declared list.

1. Map obligations to the list. Identify which provisions of the EPBC Act (and any subordinate instruments) refer to "a list of marine species" established under s 248, and map how those provisions create duties or restrictions for activities affecting species on that list. The declaration supplies the roster; it does not itself create obligations.

2. Cross-reference taxonomic names. Reconcile the names in the declaration with current taxonomies and synonyms. Given the number of informal entries ("sp", "cf", "nov. sp.") and potential typographical variations in the list, build an authoritative crosswalk between the declaration’s strings and accepted database identifiers (for example, using recognised taxonomic authorities). Do not rely on literal string matches for enforcement or permitting decisions.

3. Conduct species-impact mapping. For specific projects or operations, run spatial and temporal species-occurrence checks against the declared list. The roster includes migratory birds, coastal-dependent birds, turtles, dugongs, sea snakes, pinnipeds and syngnathids , all of which may be present intermittently in different parts of Australian waters and coasts. Map likely interactions and prepare mitigation, monitoring and reporting plans proportionate to the ecological risk and legal triggers in the EPBC Act.

4. Obtain authoritative identification where needed. Where an activity potentially affects a listed taxon, secure professional taxonomic identification. This is especially important for entries recorded imprecisely in the declaration (for example those using "sp" or "cf") because enforcement and permits will turn on accurate biological identification.

5. Review trade, collection and research approvals. If your entity engages in collecting, exporting, importing, or displaying wildlife (for example seahorses or pipefish in aquaria), check whether actions relating to declared species require permits under Commonwealth law referenced to the list. The declaration itself does not address trade controls, but the list will be the reference point for any EPBC-linked permitting regime.

6. Integrate into internal compliance systems. Update environmental management systems, standard operating procedures, and staff training to include the declared list. Pay attention to typographic anomalies and ensure that automated compliance checks use the crosswalks mentioned above rather than literal text matching.

7. Record-keeping and evidence. Maintain robust records of surveys, identifications, consultations and approvals. Where enforcement is possible in law, having contemporaneous expert identification and monitoring records will reduce legal risk given the taxonomic ambiguities in the declaration.

8. Inter-governmental coordination. If your activities intersect state and territory jurisdictions, coordinate compliance across Commonwealth and local regimes. The declaration creates the Commonwealth roster; state laws may have their own lists or additional requirements. Seek to harmonise permits and approvals where possible.

9. Engage early with the administering agency. Because this instrument is a ministerial declaration under s 248, the relevant Commonwealth department will be the administrative contact point for questions about the list’s interpretation. Early engagement with the department can clarify how the list is being applied in practice, especially where taxonomic uncertainties exist.

10. Monitor for updates and legal developments. The declaration does not record subsequent amendments or litigation. Practitioners should routinely check the statutory instrument register, the department’s species lists, and case law for changes, clarifications or judicial interpretations that affect the legal consequences of the list.

These steps are practical, defensible actions to align operations with an authoritative roster created by the ministerial declaration. They recognise that the declaration supplies the names but that substantive legal duties, rights and penalties must be identified and complied with through the wider statutory and regulatory framework that references the list established under s 248.
