This Act gives legal backing to import taxes (customs duties) that were already collected by the government in late 1964 and early 1965.

How it works Under Australian law, the government can announce immediate changes to import taxes through 'Customs Tariff Proposals' (temporary tariff measures announced in Parliament). These allow new duties to be charged right away, but they need to be formally validated by an Act of Parliament later to make them completely legal.

What this Act validates This law rubber-stamps the duties collected under tariff proposals announced on 9 and 12 November 1964, including special reduced rates for New Zealand imports. It confirms these collections were lawful, provided they happened on or before 30 June 1965.

Why this matters Without this validation, anyone who paid those import taxes could potentially demand refunds, arguing the charges weren't properly authorised by law.

CUSTOMS TARIFF VALIDATION.

No. 128 of 1964.

An Act to provide for the Validation of Collections of Duties of Customs under Customs Tariff Proposals.

[Assented to 24th November, 1964.]

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title.

This Act may be cited as the Customs Tariff Validation Act 1964.

Commencement.

This Act shall come into operation on the day on which it receives the Royal Assent.

Validation of collections under Customs Tariff Proposals.

All duties of Customs demanded or collected (whether before or after the commencement of this Act) on or before the thirtieth day of June, One thousand nine hundred and sixty-five, pursuant to—

(a) Customs Tariff Proposals introduced into the House of Representatives on the ninth or twelfth day of November, One thousand nine hundred and sixty-four; or

(b) Customs Tariff (New Zealand Preference) Proposals introduced into the House of Representatives on the ninth day of November, One thousand nine hundred and sixty-four,

shall be deemed to have been lawfully imposed and lawfully demanded or collected.
