Currency (Royal Australian Mint) Determination 2010 (No. 1)

The Determination operates through a small set of legal and technical concepts tied to the Currency Act 1965: "standard composition", the Schedule to the Act, specification of weight and allowable variation, dimensions, and design. The instrument is framed as a statutory amendment to the Schedule rather than as standalone rules. Key textual elements are:

• Standard composition: The instrument adds to the Schedule’s list of compositions opposite $25 the phrase "At least 99.99% gold" (s 4(1) and Schedule Part 1, Items 2-4). The Determination therefore makes 99.99% gold a legally recognised composition for the $25 denomination under the Schedule.

• Coexistence of multiple compositions for a denomination: Section 4(2) states explicitly that the newly specified standard composition for $25 is "in addition to any other standard composition that is, or is taken to be, specified in the Schedule to the Act for that denomination immediately before the day on which this Determination commences." The result is that the Schedule may list more than one permissible material for a single face value.

• Technical specification categories: Section 5(1) makes the Schedule the vehicle for declaring, for each item, the coin's "standard weight", "allowable variation from that standard weight", "dimensions" and "design". Those four categories are presented as legally significant attributes once included in the Schedule. The Schedule then sets those attributes in tabular form for the items at issue.

• Designs and iconography: The Schedule identifies obverse and reverse design codes (O1/O2, R1-R4) and then explains them in Part 2. O2 requires an effigy of Queen Elizabeth II and the inscriptions "IRB", "ELIZABETH II", "AUSTRALIA 2010" and "25 DOLLARS". Reverse designs R2-R4 include kangaroo motifs and the textual representation "1/5 oz. 9999 Au". Those design entries are part of the legal specification (s 5(1) and Schedule Part 2).

• Commencement and formality: The Determination takes effect the day after registration (s 2), and contains the formal signatory statement showing a Ministerial decision made under the referenced Act. The Schedule is integrated into the instrument and therefore intended to be read in the statutory context of the Currency Act.

Conceptually this is not an open-ended delegation; it is a narrow exercise of authority under the Currency Act to define how particular coins are to be constituted and to add metal-composition variants for a denomination. The instrument is technical in nature , it fixes production tolerances (weight and allowable variation), dimensions (diameter, thickness), and design attributes (shape, edge, obverse and reverse). The Schedule’s inclusion of text such as "1/5 oz. 9999 Au" links the technical specification to bullion-language commonly used in the precious-metals market.

The Determination has a focused set of direct and indirect stakeholders, as inferred from its text and structure.

• Royal Australian Mint (and other state coin producers if engaged): The Schedule sets the physical and design specifications required for coins of this denomination and composition. The Determination is titled "Currency (Royal Australian Mint) Determination" and is made under powers that apply to the Act’s Schedule. Practically, the Mint will be the entity that implements the specifications (dies, blanks, planchets, quality assurance), though the instrument itself does not name operational parties other than the Assistant Treasurer (instrument-maker). Those who manufacture, test, or distribute the coins must meet the Schedule’s weight, variation, dimension and design specifications (s 5(1), Schedule Part 1 and Part 2).

• Designers, toolmakers and suppliers of precious metals: The specification "At least 99.99% gold" and design codes (e.g. O2, R2-R4) are operational constraints on suppliers of planchets and on die-makers. The text forces procurement of gold meeting that purity threshold and production according to listed dimensions.

• Collectors and bullion investors: The Schedule’s reverse inscriptions include "1/5 oz. 9999 Au" and the table sets weight 6.22 (Schedule Part 1 items and Part 2 items 6-8). These features identify the coins as small-format bullion pieces with a specified fineness. Market participants who buy or sell such coins will be affected by the legal indication of bullion content and the coin’s face value. Although the Determination does not set sales channels or prices, it establishes the legal attributes that will be relied on in market descriptions and marketing materials.

• Currency law practitioners, compliance officers and inspectors: Because the Schedule is part of the Act’s statutory apparatus, its specifications may be invoked in regulatory or enforcement contexts under the Currency Act (the Determination is made under paragraph 13(2)(a) and subsection 13A(1) of the Act; see front matter and s 3-5). Those advising or auditing minting operations, or involved in legal questions about coin authenticity or compliance, will need to consult the Schedule.

• Secondary-market intermediaries (dealers, precious-metals traders): The presence of inscriptions such as "1/5 oz. 9999 Au" and the stated weight in the Schedule provide an authoritative description that can be used in marketing or valuation. Dealers will rely on these legal specifications when describing provenance and authenticity, and when reconciling face value with bullion value.

• Public and businesses accepting cash: Practically, given the face value is $25 but the coin is specified as high-purity gold, retail businesses and members of the public must understand that the likely economic use will be as bullion/collectible rather than a circulated medium of exchange. The Determination itself does not address legal tender acceptance or redemption mechanics, but the Schedule’s composition and inscriptions affect how market participants will treat the coins.

The Determination does not itself create or remove criminal offences, nor does it amend other bodies of law such as taxation, customs, or financial services regulation. It also does not expressly change Royal Australian Mint’s commercial powers or pricing mechanisms. The direct legal effect is to expand the Schedule’s technical list of authorised standard compositions and to set the manufacturing tolerances and designs of specified $25 gold coins (s 4-5 and Schedule).

The Determination imposes prescriptive technical requirements and thereby establishes duties of compliance for those producing the coins. It does not, in the text provided, create separate statutory rights such as enforcement regimes or private causes of action; rather, it operates within the statutory framework of the Currency Act 1965. The key duties and rights that follow from the instrument’s text are:

• Duty to adhere to the Schedule’s specifications when producing a coin that is denominated $25 and claimed to be the newly specified composition. By setting the "standard weight", "allowable variation", "dimensions" and "design" in the Schedule (s 5(1) and Schedule Part 1 and Part 2), the Determination creates a legal specification that production must follow if a coin is to be the type described. The practical duty falls on the mint or any authorised minters responsible for die design, planchet manufacture, and final striking.

• Duty implied to use the exact obverse and reverse inscriptions/designs set out in the Schedule for the variants listed. Part 2 explains that O2 includes the effigy of Queen Elizabeth II and the inscriptions "IRB", "ELIZABETH II", "AUSTRALIA 2010" and "25 DOLLARS" and that R2-R4 require the "1/5 oz. 9999 Au" inscription plus kangaroo imagery (Schedule Part 2 items 3 and 6-8). Design duties include edge treatment (E1, continuously milled) and shape (S1, circular).

• Duty relating to allowable variation: Section 5(1) and the Schedule require adherence not only to the standard weight but to the allowable variation shown. The table lists 6.22 and an adjunct of "+ 0.09". The table format is also used to record the 20 cent row, which shows "11.30 ± 0.33". Practitioners should read the Schedule as assigning a standard weight and a permitted manufacturing tolerance for weight, and ensure quality control systems track compliance with that tolerance.

• Right to produce legally authorised coins: Where producers comply with the Schedule’s specified composition and technical attributes, the produced coin will conform to the statutory description found in the Schedule to the Currency Act. That status is material because the Schedule in the Currency Act provides the legal template for what constitutes authorised coinage. The Determination thereby shores up the statutory basis for producing and issuing those particular $25 gold pieces.

• Right to rely on legal description in trading/marketing: Market participants (dealers, buyers) can rely on the Schedule’s textual inscriptions ("1/5 oz. 9999 Au", "25 DOLLARS") and the statutory statement of composition to assert that an authorised coin matches those descriptions. That statutory backing is relevant to authenticity disputes and to descriptions used in sale or tender.

• Limitation: The Determination does not itself set or change the criminal penalties that might apply under the Currency Act for counterfeiting, fraudulent use, or misuse of coins, nor does it modify other rights such as tax or customs statuses. Any duties or rights to enforcement will operate through the Currency Act’s broader provisions (the Determination does not include penalty clauses; s 5(2) notes it does not affect other determinations).

Operationally the most immediate duties are technical: ensure planchets meet "At least 99.99% gold", match the standard weight and allowable variation shown ("6.22 + 0.09"), have the specified diameter "21.69 mm" and thickness "0.893 mm", circular form (S1), continuously milled edge (E1), and apply the prescribed obverse and reverse designs (O2 and R2-R4 as applicable) (Schedule Part 1 and Part 2). Compliance must be contemporaneous with the Determination’s commencement (the day after registration) and any coin produced and sold or presented as the $25 99.99% gold coin should conform to these listed attributes.

The Determination itself contains no express penalty provisions or enforcement mechanisms. It operates as a specification instrument made under powers granted by the Currency Act 1965 (instrument heading and s 3-5). The Determination’s text does not create offences or state how compliance will be policed. The following points describe the enforcement context and practical considerations grounded in the Determination’s terms.

• No penalty clauses in the Determination: The instrument is purely prescriptive as to composition, weight, dimensions and design and does not, in its text, set fines, imprisonment, or other sanctions. It is therefore not a standalone enforcement statute; rather, compliance and enforcement would rely on the statutory enforcement provisions and offences that exist in the Currency Act 1965 and other relevant legislation (the Determination is made under paragraph 13(2)(a) and subsection 13A(1) of the Currency Act 1965, see heading and s 3-5).

• Enforcement via the Currency Act framework: Because the Determination amends the Schedule to the Currency Act, any enforcement action relating to unauthorised coin production, fraudulent representations, or counterfeiting is likely to be pursued under the Act’s existing offence provisions and enforcement mechanisms. The Determination does not reproduce those offences; practitioners must consult the Currency Act 1965 itself (not included in this Determination) for the applicable criminal or civil remedies.

• Administrative compliance and inspection: The Schedule sets manufacturing tolerances and design codes that the Mint or authorised minters will be required to meet in practice. Quality-control and record-keeping obligations will be operational necessities for the mint to demonstrate compliance if a regulatory inspection or evidence needs to be produced in administrative or legal proceedings. The Determination itself does not specify inspection regimes or reporting obligations.

• Evidentiary role of the Schedule: The Schedule provides statutory evidence of the authorised composition and designs. In any dispute over whether a coin is an authorised $25 99.99% gold piece, an inspection against the Schedule’s attributes , weight, allowable variation, diameter, thickness, obverse and reverse design , will be the central inquiry. The Determination thereby has an evidentiary effect even though it does not itself create enforcement penalties.

• Potential ancillary enforcement issues outside the Determination: The Schedule’s inclusion of bullion-style inscriptions (for example "1/5 oz. 9999 Au") and the presence of a face value of $25 may give rise to regulatory questions in other regimes (consumer protection, trade descriptions, taxation, customs), but the Determination does not address those. Any enforcement or penalties in those regimes would be governed by their respective statutes and administrative rules.

For practitioners advising on enforcement, the practical takeaway is that the Determination defines the legal template against which coin authenticity and adherence to technical attributes will be measured, but any prosecution, civil enforcement or administrative sanction must be anchored in the Currency Act or other applicable laws outside the Determination text itself.

The Determination is an instrument made under the Currency Act 1965 and therefore interacts directly with that Act by amending (or specifying additions to) the Schedule to the Act (s 3-5). The Determination does not attempt to amend other statutes, but it has consequences for how other legal regimes will treat coins that conform to its specifications. The instrument’s text itself and its structure indicate several interaction points to be considered.

• Integration with the Currency Act Schedule: The Determination operates by specifying entries to be included in the Schedule to the Currency Act, which is the statutory catalogue of denominations, compositions and the technical specifications of coinage (s 4(1)-(2), s 5(1)). Therefore, the primary legal interaction is with the Currency Act: the Determination supplies the content that will appear in the Act’s Schedule and thereby has the legal force of a Schedule entry.

• Coexistence with prior Schedule entries: Section 4(2) makes explicit that the new standard composition "is specified in the Schedule to the Act in addition to any other standard composition that is, or is taken to be, specified in the Schedule to the Act for that denomination immediately before the day on which this Determination commences." That creates a statutory situation where more than one composition can be listed for the same denomination in the Schedule. Practically, this interacts with whatever prior Schedule entries exist for $25 coins; both sets of entries will be part of the Act. Practitioners must therefore read the Schedule in the Currency Act as a composite list of authorised variants for a denomination.

• Interaction with design and heraldry rules: The Schedule requires an effigy of Queen Elizabeth II and certain inscriptions for the obverse (O2) and reserves specific reverse motifs (R2-R4) (Schedule Part 2 items 3 and 6-8). Use of the Queen’s effigy and related inscriptions interacts with the broader statutory and prerogative rules governing the depiction of the monarch on coinage; the Determination exercises the authority to fix the obverse and reverse designs by reference to the Schedule rather than altering broader constitutional rules. Any other statutory regimes that regulate imagery or copyright may intersect, but the Determination provides the legal design specification for coins under the Currency Act.

• Interaction with market and consumer laws (incidental): The Schedule’s stamping of "1/5 oz. 9999 Au" and the face value "25 DOLLARS" may intersect with consumer-protection, trade-description or labelling laws if the coins are sold or marketed. The Determination itself does not set marketing rules; it supplies the authorised technical description that sellers may use. Where sellers make claims inconsistent with the Schedule, trade or consumer regulators may have grounds for action, but such action would be under the relevant consumer-protection statute, not the Determination.

• Interaction with taxation and customs regimes (practical considerations): High-purity gold coins with bullion inscriptions are often treated as investment precious-metal products for tax or import/export customs purposes. The Determination’s specification of "At least 99.99% gold" and the "1/5 oz. 9999 Au" reverse legend will be material factual inputs to tax or customs characterisations, but the Determination does not itself change tax law. Advisers should therefore cross-check relevant ATO or customs rulings on treatment of legal-tender bullion coins.

• Evidentiary interaction in disputes: Because the Schedule is now the statutory statement of the authorised physical attributes of the $25 99.99% gold coins, it will be used as primary legal evidence in any disputes under the Currency Act or related proceedings dealing with authenticity, counterfeiting or misrepresentation.

• Preservation of prior determinations: Section 5(2) states that subsection (1) (the new Schedule items specifying weight, variation, dimensions and design) "does not affect any other determination of the standard weight, variation, dimensions or design of a coin made under subsection 13A(1) of the Act." That preserves prior determinations and avoids revoking or amending them by implication. Practitioners must therefore read the Schedule and other determinations together to understand the full legal landscape of coin specifications.

In short, the Determination interacts primarily with the Currency Act’s Schedule and flows into other regulatory regimes only insofar as the factual characteristics it fixes are relevant to those regimes; it does not itself amend or create offences or other substantive duties outside the Currency Act framework.

The Determination itself records its formal origin and is a freestanding instrument with a clear single-date history in the text provided.

• Date and maker: The Determination is dated 25 February 2010 and signed by NICK SHERRY, Assistant Treasurer. The front matter states: "I, NICK SHERRY, Assistant Treasurer, make this Determination under paragraph 13 (2) (a) and subsection 13A (1) of the Currency Act 1965." The instrument is titled Currency (Royal Australian Mint) Determination 2010 (No. 1) (s 1 and heading).

• Commencement: Section 2 provides the commencement rule: "This Determination commences on the day after it is registered." There is no explicit registration date printed in the body of the instrument beyond the signature date; the practical effect is that the Determination becomes effective the day after the instrument’s registration in the Federal Register of Legislative Instruments or other prescribed registry.

• No further amendments shown: The text provided contains no later amending clauses or schedules showing subsequent changes to this Determination. The instrument itself contains its Schedule and the Part 2 explanation of symbols. There are no embedded amendment notes, revocation clauses, or transitional provisions beyond s 5(2), which preserves other determinations. Therefore, as contained, the Determination’s amendment history is limited to its creation on 25 February 2010 and its commencement rule.

• Relationship to other determinations: Section 5(2) expressly states that the subsection specifying weight, variation, dimensions and design "does not affect any other determination ... made under subsection 13A(1) of the Act." That indicates an intent that this Determination is additive and non-revoking with respect to other determinations made under the same empowering section. Practitioners should therefore expect the Schedule to the Currency Act to reflect multiple determinations and to consult the consolidated Schedule and any other determinations for a complete set of authorised coin specifications.

• Registration and publication: The instrument includes a Note referring to the Federal Register of Legislative Instruments: "All legislative instruments and compilations are registered on the Federal Register of Legislative Instruments kept under the Legislative Instruments Act 2003. See http://www.frli.gov.au." That indicates the formal administrative channel for registration and any subsequent search for amendment history. Any practitioner seeking to verify whether this Determination has been subsequently amended or superseded must consult the FRLI and the consolidated Schedule to the Currency Act.

Given the absence of later amending material in the instrument itself, the recorded amendment history in the text is limited to its making and its commencement rule; subsequent amendment history (if any) will only be visible by consulting the FRLI and the Currency Act’s consolidated Schedule.

The Determination’s text contains no record of litigation, judicial review, or referenced cases. It is a technical amendment and the Schedule is presented as an administrative exercise under the Currency Act 1965. The instrument itself does not cite prior cases nor does it provide a history of judicial disputes.

Practical notes for practitioners on likely litigation touchpoints arising from the Determination:

• Authentication and counterfeiting disputes: Should questions arise as to whether a given gold $25 coin is an authorised piece, courts would refer to the Schedule entries (as added by this Determination) to determine conformity with statutory specifications (weight, allowable variation, diameter, thickness, obverse and reverse design codes). The Determination’s Schedule will function as primary statutory evidence. The instrument itself does not prescribe procedures for such proceedings; those lie within the Currency Act and general criminal/civil procedure rules.

• Consumer or trade misdescription claims: If a commercial operator markets or sells coins claiming the attributes set out in the Schedule but the coins do not conform, civil litigation under misleading-or-deceptive-conduct or trade-description laws could follow. The Determination’s Schedule will be relevant factual material to show whether the marketed description matched the statutory specification. The Determination does not itself create private causes of action.

• Administrative review: Challenges to the Decision to make the Determination would invoke administrative law principles (for example judicial review of decisions by ministers or executive officers). The Determination records it was made under the Currency Act and is dated and signed by the Assistant Treasurer. Any judicial review would need to be brought against the Assistant Treasurer’s decision-making process under relevant administrative law grounds; the Determination contains no internal review procedures.

• Lack of recorded litigation: The instrument does not mention any past litigation impacting the decision. Practitioners should therefore treat the Determination as an administrative technical instrument and search relevant case law databases or the Federal Court/High Court records if litigation history is needed beyond the instrument.

Given the content of the Determination, litigation (if any) is likely to be factual and technical: disputes over conformity of weight, fineness or design; or over whether a particular coin is a non-authorised counterfeit or misdescribed. The Determination’s Schedule entries will be central evidence in any such proceedings.

The Determination is concise but contains several details and drafting features that create potential practical pitfalls for drafters, designers, minting staff, market participants and legal advisers. These "gotchas" are drawn directly from the instrument’s text and schedule.

• The Schedule lists multiple $25 items: The instrument adds a standard composition "At least 99.99% gold" for the $25 denomination in addition to any other standard composition already listed (s 4(2)). Practically, the Schedule will list several permitted variants for $25. Confusion can arise working with stock-keeping, tender acceptance, or accounting systems if multiple coin types share the same face value but differ dramatically in material and bullion value.

• The weight/variation notation for $25 reads "6.22 + 0.09": The table entry for standard weight and allowable variation for Items 2-4 is shown as "6.22 + 0.09" (Schedule Part 1). By contrast, the 20c row uses "11.30 ± 0.33". The absence of a clear "±" symbol for the $25 entries invites ambiguity about whether the tolerance is plus-only, plus-or-minus, or a typographical shorthand. Section 5(1) states the Schedule specifies "the coin’s standard weight; and the allowable variation from that standard weight", but the table’s notation requires interpretation. Practitioners should seek confirmation from the issuing authority (Treasury or the Royal Australian Mint) or the FRLI consolidated instrument to confirm the intended tolerance (commonly manufacturing practice is a plus-or-minus tolerance). Do not assume ± without verification.

• The Schedule ties bullion inscription to stated weight: The reverse designs R2-R4 include the legend "1/5 oz. 9999 Au" (Schedule Part 2 items 6-8) while the weight field is 6.22 (Schedule Part 1). The table therefore pairs an explicit bullion weight inscription with a tabulated gram weight. Practitioners must ensure that the produced coin’s actual mass is consistent with the inscription and the statutory entry. Any discrepancy between inscription and measured mass could fuel disputes about authenticity or misdescription.

• Obverse inscriptions and effigy: The obverse design O2 requires the effigy of Queen Elizabeth II with the letters "IRB" and the inscription "AUSTRALIA 2010" and "25 DOLLARS" (Schedule Part 2 item 4). Use of the monarch’s effigy is tightly specified. The initials "IRB" (Ian Rank-Broadley) identify a particular effigy designer; practitioners must ensure licensing and correct reproduction if third parties are involved in die or tooling production.

• Multiple reverse variants with small dimensional tolerance: Items 2-4 share the same denomination, composition, weight and external dimensions but have different reverse designs (R2-R4). The small thickness (0.893 mm) and fine designs could complicate tooling and striking; striking tolerances and die wear must be controlled so as to meet allowable weight variation and legibility of inscriptions.

• Legal-tender versus bullion value: The Schedule combines a monetary face value ($25) and explicit bullion descriptors ("1/5 oz. 9999 Au"). Market participants should be aware that legal tender face value is not necessarily an indication of bullion market value. The Determination does not address redemption, circulation, or use as payment, and practitioners should not assume commercial merchants will accept such coins at face value. The Schedule itself takes no position on market value, but it provides the authoritative technical basis that markets will use to value the coins.

• Preservation of other determinations: Section 5(2) clarifies that this Determination does not affect other determinations under subsection 13A(1) of the Act. The practical implication is a potentially complex web of coexisting determinations in the Schedule; practitioners must read the consolidated Schedule rather than rely exclusively on this Determination when advising on authorised coin specifications.

• Registration timing: The Determination commences the day after registration (s 2). Ensure that production schedules and marketing materials align with the instrument’s actual registration date on the FRLI , premature claims about legal authorisation before the commencement date could cause legal or reputational issues.

• No enforcement text in the Determination: Because the instrument contains no penalties, any enforcement action will rely on the Currency Act or other statutes. This means that for compliance guidance or enforcement risk assessment, advisers must consult the broader statutory framework rather than the Determination alone.

• Designation "At least 99.99% gold": The precise legal meaning of "At least 99.99% gold" should be read literally as a minimum fineness requirement. That phrase requires suppliers to provide gold meeting or exceeding the 99.99% threshold. Practical testing protocols and standards for proving fineness (assay methods) are not set out in the Determination and must be governed by internal quality control and industry standards.

Each of the above is rooted in the instrument’s text (s 2-5 and Schedule Part 1 and Part 2) and points to concrete procedural checks that mint operators, legal advisers and market actors should perform when implementing or dealing with the coins.

For governmental producers, the Royal Australian Mint, and any authorised manufacturer or distributor dealing with the $25 99.99% gold coins specified by this Determination, compliance is primarily technical and documentary. The following practical checklist translates the Determination’s text into operational steps; each step is grounded in the Determination’s provisions (s 2-5 and Schedule Part 1 and Part 2).

1. Check commencement and registration status

   • Verify the instrument’s registration date on the Federal Register of Legislative Instruments. The Determination commences the day after registration (s 2). Do not represent coinage as authorised under the Determination until after commencement.

2. Read the consolidated Schedule to the Currency Act

   • Because s 4(2) and s 5(2) make the Determination additive and non-revoking, consult the consolidated Schedule in the Currency Act 1965 to see all existing standard composition entries and determinations for the $25 denomination. This prevents confusion where multiple authorised variants exist.

3. Material procurement and assay

   • Source gold planchets that meet the phrase "At least 99.99% gold" as specified in the Schedule (Schedule Part 1, Items 2-4). Establish assay procedures to demonstrate compliance with the minimum fineness standard. Keep assay certificates and QA records to demonstrate compliance.

4. Weight and tolerance control

   • Configure planchet weights and final struck coin weights to meet the Schedule entry "6.22 + 0.09" (Schedule Part 1). Because the table notation may be ambiguous as to whether the variation is plus-only or plus-and-minus, seek explicit confirmation from Treasury or the Mint’s legal/standards team regarding the intended meaning of "+ 0.09". Until verified, adopt manufacturing controls that ensure each coin’s mass remains within a narrow band around 6.22 g and document the chosen interpretation and rationale.

5. Dimension and striking parameters

   • Die and press settings must produce coins with maximum diameter "21.69 mm" and maximum thickness "0.893 mm" (Schedule Part 1). Establish and record the measuring protocols and instruments (calipers, micrometres) used to confirm these dimensions for each production batch.

6. Edge, shape and design conformity

   • Ensure the coins are circular (S1) and the edge is continuously milled (E1). Implement die designs to reproduce the obverse (O2) and the appropriate reverse design (R2, R3 or R4) depending on the variant to be produced (Schedule Part 2 items 3-8). For O2, include effigy and inscriptions "IRB", "ELIZABETH II", "AUSTRALIA 2010", and "25 DOLLARS". For the reverse designs, include the "1/5 oz. 9999 Au" inscription in the position specified for R2-R4.

7. Intellectual-property and authorisation checks

   • Confirm authorisations for use of the effigy and the initials "IRB" if relevant for tooling agreements, reproductions and third-party contractors. Ensure any third-party dies or trademark use is cleared under standard Crown/contractual arrangements.

8. Quality assurance and record-keeping

   • Implement batch-level sampling to test weight, dimensions and fineness. Keep production records, assay reports, QA certificates and design proofs. Because the Schedule is the statutory standard, documentary proof is the principal evidence of compliance in any dispute.

9. Marketing and labelling

   • Use the legal inscriptions and statutorily required designations (for example, "1/5 oz. 9999 Au" and "25 DOLLARS") in marketing only where the produced item conforms exactly to the Schedule. Avoid any statements that could be misleading about face value versus bullion value. If selling through the Mint, ensure marketing materials state the legal attributes in terms matching the Schedule.

10. Cross-check ancillary regulatory obligations

    • Review whether the coins will be subject to customs, export, anti-money-laundering, consumer-protection or taxation regimes and ensure that the coin’s factual attributes (composition and weight) are correctly represented in declarations and reporting. The Determination itself does not set obligations in these areas.

11. Dispute and recall procedures

    • Establish internal procedures for handling customer complaints, suspected mis-strikes or off-spec coins. Where a batch is off-spec, have a protocol for segregation, recall and remediation, supported by assay and QA data to demonstrate corrective steps.

12. Legal review and confirmation

    • Because section 5(2) preserves prior determinations and because the weight-tolerance notation could be ambiguous, obtain a legal confirmation memo (from Treasury legal or Crown solicitor) addressing: a) The intended interpretation of the weight-variation notation "6.22 + 0.09". b) Whether any additional administrative approvals or notifications are required before production or issuance. c) Any licensing related to the effigy or inscriptions.

13. Documentation for third-party traders and dealers

    • Prepare a concise compliance statement and a copy of the Schedule entry for distribution to dealers and institutional purchasers so they have definitive legal reference material when valuing or reselling the coins.

By following these steps and maintaining documentary trails keyed to the specific Schedule entries in the Determination (s 4 and s 5 and the Schedule), producers and market participants can show adherence to the statutory template that the Determination sets out. When in doubt about interpretive issues (for example the "+ 0.09" notation), seek authoritative clarification from Treasury, the Royal Australian Mint, or the Federal Register of Legislative Instruments.
