What it does
This instrument, the Currency (Perth Mint) Determination 2015 (No. 1), is a legislative determination made under the Currency Act 1965. It is dated 11 February 2015 and signed by Kelly O’Dwyer, Parliamentary Secretary to the Treasurer. The instrument commences the day after registration, per section 2. Its legal effect is to specify, for the purposes of the Currency Act, particular coin denominations, the standard composition of those coins, and the standard weight, allowable weight tolerance, design and dimensions of each coin listed in the Schedule to this determination.
Mechanically the determination operates in two linked ways. First, section 5(2) states that the Currency Act 1965 has effect, from commencement, as if references to the denominations specified in Part 1 of Schedule 1 to this determination were included in the Schedule to the Currency Act, and as if opposite each such denomination in the Schedule to the Act there were specified the standard composition given in Part 1 of Schedule 1. Second, section 6(2) provides that, from commencement, each item of the table in Part 1 of Schedule 1 specifies the standard weight, allowable variation from that standard weight, the design and the dimensions of the coin whose denomination and standard composition are specified in that item.
The Schedule is comprehensive. Part 1 is a long itemised table that lists 134 separate coin specifications. Each line records: the denomination (face value), the standard composition (for example "At least 99.99% gold", "At least 99.9% silver", or "Aluminium and bronze"), the standard weight in grams together with the allowable variation, maximum diameter or other dimension, maximum thickness, shape symbol, edge symbol, obverse symbol and reverse symbol (for interpretation). Part 2 is a keyed legend that explains the symbol codes used in Part 1 for shapes (S1-S3), edges (E1-E3), obverse designs (O1-O15) and reverse designs (R1-R69). Sections 5(3) and 6(4) explicitly state that this determination does not affect other provisions of a determination made for the same enabling paragraphs and subsections of the Currency Act, so earlier determinations under paragraph 13(2)(b) and subsection 13A(1) of the Currency Act remain in place unless varied elsewhere.
