Currency Determination No. 1 of 1995

The Determination deploys a small set of recurring technical concepts that define a coin issue and the manufacturing constraints:

• Standard composition and minimum metal purity. Each clause specifies the standard composition and a numeric minimum for metal purity: silver coins are specified as "not less than 99.9% silver" (for example cll 4(1), 5(1)); gold coins "not less than 99.99% gold" (for example cll 11(1), 14(1), 19(1), 21(1)); platinum coins "not less than 99.95% platinum" (for example cll 12(1), 15(1), 20(1), 22(1), 24(1)). Those percentages set clear assay thresholds for any production run and create an intrinsic relationship between the coin and bullion purity standards used in markets. The reverse inscriptions also repeatedly state weight and purity (for example "1 OZ. 999 SILVER", "1 OZ. 9999 GOLD", "1 OZ. 9995 PLATINUM"), reinforcing the intended bullion character of many issues (see cll 4(9)(b)(i), 11(9)(b)(i), 12(9)(b)(i), 21(9)(b)(i)).

• Measurable dimensional and mass parameters. Each issue specifies the coin's shape (always circular in this Determination), edge finish (milled), standard weight and allowed weight variation, diameter and thickness (see the repeated structure across cll 4-24). The permitted variations, sometimes as small as 0.015 grams on very light coins (cll 11(4)-(5), 12(4)-(5)), impose precise manufacturing tolerances.

• Obverse standardisation. The obverse across almost all clauses is standardised to bear an effigy of the Queen and the inscriptions "ELIZABETH II" and "AUSTRALIA" and the nominal denomination, encircled by raised beads inside the rim (see e.g. cll 4(8), 5(8), 11(8), 21(8)). That standardisation simplifies one aspect of quality control, but the Determination also embeds specific textual forms for the obverse inscriptions which must be reproduced.

• Reverse individuality and bullion labelling. Reverse designs vary by denomination and variant. They commonly depict wildlife (kookaburra, koala, kangaroos), historic florin reverses, commemorative emblems (World Vision 40 hour famine logo) or the "Nugget" motif. Importantly, the reverse inscriptions typically declare the bullion content and purity and include year marks (often "1995" or "1996") (see cll 4(9), 5(9), 11(9), 18(9)). Some clauses include additional imagery described as representations of historic coins (for example cl 6(9)(b): "a representation of the reverse of the 1927 florin") or commemorative devices (cl 7(9)(b), cl 8(9)(b)).

• Repeat and variant clauses. The Determination repeatedly uses the same structural template to describe multiple separate but similar issues. Several clauses are near-duplicates with only the reverse motif or inscription changed (notably cll 5-10, which each set the same weight, diameter, thickness and obverse for a $2 silver coin but change reverse design text). That pattern demonstrates the Determination’s approach of enumerating variant issues within one instrument rather than issuing single separate determinations per design.

• Technical artefacts and placeholders. The text contains embedded image placeholders within inscriptions (for example image.003.png and image.004.png in cll 11(9)(b)(i) and 14(9)(b)(i) respectively) and contains textual errors or truncations in a small number of clauses (for example cl 12(8)(b) reading "ELIZABETH IP," and cl 18(1) using "not less man 99.9% silver"). Those features are part of the instrument as published.

These core concepts , composition minimums, precise mass and dimensional tolerances, prescribed obverse/ reverse motifs and inscriptions , are the determinative elements the Determination imposes on production and are the primary bases for compliance measurement.

This Determination affects a discrete set of actors and functions directly, and may have secondary effects on other market participants.

Primary affected parties and roles

• The issuer and the regulatory authority. The Determination is made under the Currency Act 1965 by the Parliamentary Secretary to the Treasurer (introductory material). It therefore operates as an instrument of the Treasury portfolio; the decision-maker named (the Parliamentary Secretary acting for the Treasurer) is the authorised maker of the instrument. The Treasury, or its delegate, will hold responsibility for giving effect to the Determination administratively (design approvals, commissioning, supervision).

• Coin manufacturers and assayers. Any entity tasked with producing coins to these specifications, whether the Royal Australian Mint or an authorised contractor, must meet the detailed compositional, dimensional and inscription requirements , that includes controlling alloying and refining to meet stated minimum purities; tooling and die-making to reproduce the specified effigy and motifs; manufacturing processes capable of meeting narrow weight tolerances (sometimes ±0.015 grams on very small gold/platinum coins, cll 11(4)-(5), 12(4)-(5)); and quality control processes to ensure diameters and thicknesses (for example cl 13 for the $10 silver coin specifies 75.50 mm diameter and 8.70 mm thickness).

• Distributors, retailers and dealers in coins and bullion. Participants who handle, sell or market coins issued pursuant to the Determination will be affected insofar as they need to validate that supplied coins meet the specified inscriptions and technical parameters. Features such as stated metal content and purity on the reverse (e.g. "1 OZ. 999 SILVER") bear on purchaser expectations and compliance with representations.

• Collectors and purchasers. Buyers of coins will be affected because the Determination sets the physical attributes and inscriptions the finished product must bear. Those attributes influence valuation, authenticity checks and collectability. The explicit bullion content inscriptions and high stated purities indicate an intention for many issues to function as bullion coin products.

Secondary or potential affected parties

• Assay and testing laboratories, and metrological services. The specified tolerances and stated purities mean that independent testing may be required for authentication and valuation. The Determination’s numerical thresholds create objective criteria for assays.

• Customs, excise and trade administrators. While the Determination does not articulate customs or taxation consequences, coins that declare high-purity metal content and significant intrinsic metal weights (for example cl 18’s "1 KILO 999 SILVER" inscription) may attract regulatory interest for export controls, duty calculation, or reporting obligations under other regimes. The Determination is silent about these interactions and therefore affects those agencies only indirectly.

• Secondary markets for bullion and numismatic coins. Dealers who trade in bullion and numismatics will be affected by the design and purity statements because these influence market liquidity and pricing.

What the Determination does not directly affect

• The Determination does not itself set face value redemption rules, volumes to be produced, sale prices, distribution methods, or explicitly state legal-tender status in its text. It also contains no penalties or enforcement procedures. Those matters, if relevant, are addressed elsewhere in law or administrative practice and are not specified in the instrument (see cl 3 which preserves other determinations).

In practical terms, the document most directly constrains the technical activities of minting and quality assurance. It also shapes purchaser expectations by embedding bullion content and purity claims into the coin inscriptions. Parties responsible for issuing and producing the coins carry the direct compliance burden; dealers and buyers carry the due-diligence burden to confirm coins match the Determination.

Duties imposed by the Determination

• Manufacture to the specified physical parameters. For each listed denomination the Determination imposes precise manufacturing duties: make the coin circular (cll 4(2), 5(2), 11(2), etc.), mill the edge (cll 4(3), 5(3), 11(3), etc.), meet the stated standard weight and not exceed the stated allowable variation (cll 4(4)-(5), 11(4)-(5), etc.), meet the diameter and thickness set out (cll 4(6)-(7), 11(6)-(7), etc.), and reproduce the obverse and reverse motifs and inscriptions described (for example cl 4(8)-(9), 11(8)-(9), 21(8)-(9)). Those are positive duties to achieve measurable characteristics.

• Ensure composition meets minimum purity. Each clause requires that the “standard composition … includes not less than” the specified purity for the metal (e.g. cl 4(1), cl 11(1), cl 12(1)). That is a duty to procure and verify metal of a minimum assay quality.

• Observe specified reverse inscription content. The Determination mandates exact or near-exact wording for inscriptions on reverse faces, including denomination, bullion weight notation and purity indicators, and permitted year marks (for example cl 4(9)(b)(i)-(ii), cl 11(9)(b)(i)-(ii), cl 21(9)(b)(i)-(ii)). Reproducing these texts is part of the manufacturing duty.

• Observe permitted variation tolerances. The Determination imposes limits on acceptable deviation from standard weight (for example ±0.500 g for larger silver coins, cl 4(5); ±0.015 g for small gold/platinum coins, cll 11(5), 12(5)). Manufacturers must implement quality control capable of measuring and maintaining those tolerances.

Rights or authorisations arising from the Determination

• Authorisation to use the specified designs. The Determination, as subordinate legislation under the Currency Act 1965, functions to authorise the manufacture of coins of the kinds and designs specified. That authorisation is implicit in an instrument that prescribes designs under the currency law, and the named maker is the Parliamentary Secretary acting for the Treasurer (introductory material). The text itself creates the legal basis to produce coins with the prescribed obverse and reverse designs, subject to the principal Act and any other applicable instruments.

• Right to identify coins by inscriptions. The Determination grants the right for the issuing authority to label coins with bullion weights and purities and year marks as specified. Those inscriptions are part of the authorised product description and should be relied upon by distributors and purchasers, subject to statutory and contractual obligations elsewhere.

What the Determination does not specify

• The Determination does not set out enforcement mechanisms, sanctions, sale or distribution modalities, price-setting, or minting quantities. It contains no explicit provision granting private parties rights to demand minting, nor does it set licensing rules for private minters or distributors. It also does not restate or alter other determinations (cl 3).

• The Determination does not address legal-tender treatment, conversion of face value in law, or other monetary policy matters. Those subjects remain in the domain of the Currency Act 1965 and possibly other regulations, not within the face of this instrument.

Operational duties and interface obligations

• Where textual ambiguities or placeholders appear (for example image placeholders in inscriptions and truncated lines in some clauses), the responsible issuing authority or manufacturer will have a duty to seek clarification or to rely on authorised artwork and instructions from the Treasury or its delegated officers before tooling and production commence. The Determination does not itself supply that clarifying detail.

In short, the Determination imposes precise manufacturing and compositional duties, authorises specific inscriptions and designs, but leaves issuance, enforcement and many other operational questions to other instruments or administrative practice.

The Determination itself contains no express penalties, sanctions or enforcement provisions. It sets technical requirements and design parameters but does not specify who inspects compliance, what the consequences for non-compliance are, or what enforcement mechanisms apply. There is no provision in the instrument text for fines, seizure, criminal liability, or administrative corrective measures.

Consequences of the absence of enforcement provisions

• Reliance on the principal Act and other statutes. Because the Determination is made under the Currency Act 1965, enforcement of design and composition standards would, in practice, fall back on the enforcement powers conferred by the Currency Act and any other relevant legislation or administrative arrangements. The Determination itself does not amend or restate those enforcement powers, and cl 3 emphasises that it does not affect other determinations. Therefore, any sanctions, compliance processes, or criminal provisions that might apply would need to be located in the Currency Act or other instruments.

• Quality assurance and contract remedies. In the absence of statutory penalties within the Determination, enforcement of the specified standards will typically be implemented through contractual obligations (contracts between the issuing authority and the mint or manufacturer), internal administrative approvals (Treasury or its delegate checking conformity), quality-control regimes and commercial remedies for breach. The Determination creates objective technical criteria that can be enforced via contractual claims, warranty regimes, or administrative withholding of approval.

• Evidential clarity for disputes. The Determination’s detailed, measurable specifications (weights, diameter, thickness, composition minima, inscription content) create clear material tests that can be used in disputes over compliance. The absence of statutory enforcement language does not eliminate the value of those objective measures; it means that enforcement likely will proceed under other legal frameworks.

Implementation and compliance risk factors

• Lack of procedural inspection clauses increases reliance on administrative practice. Because the Determination does not specify inspection, sampling or assay regimes, those operational steps must be sourced from elsewhere; failure to adopt robust inspection protocols would increase the risk of non-conforming coin batches entering circulation or sale.

• Multiple variants increase complexity of inspection. The multiple near-duplicate clauses for some denominations (particularly for the $2 silver coin in cll 5-10) require administrators and producers to track which variant is authorised for any specific production run. Ambiguity in that mapping could create enforcement gaps.

• Textual anomalies create uncertainty. Placeholders and truncated passages in the text (see cll 11, 12, 15, 18) leave open the precise wording or imagery to be reproduced in some cases, which injects uncertainty about what should be inspected and enforced.

Practical enforcement instruments likely to be used

• Administrative approvals and release procedures by the Treasury or delegated agency before distribution.

• Contractual compliance warranties and acceptance testing between the issuing authority and manufacturer.

• Assay and metrological verification by independent laboratories at the point of production or sale.

• Application of any applicable offences or sanctions under the Currency Act or other Commonwealth laws where misconduct, misrepresentation, counterfeiting or unauthorised use of designs occurs, although those provisions are not stated in this Determination.

In sum, the Determination imposes technical obligations but provides no internal enforcement mechanism. Compliance and sanctioning will depend on the principal Act, administrative arrangements, contractual instruments and standard commercial or legal remedies external to the Determination.

The Determination is made under the Currency Act 1965 and therefore operates as subordinate legislation within the Commonwealth legal framework (introductory material). It explicitly states that it does not affect any other determination of the specifications or design of a coin (cl 3). That clause signals an intent that this instrument functions alongside existing determinations rather than replacing or overriding them.

Direct legal intersections

• Currency Act 1965. The Determination’s authority derives from the Currency Act; any legal effects beyond the specification of physical characteristics , for example, legal-tender status, criminal offences for counterfeiting, or other statutory consequences , would be determined by the provisions of that Act and the wider statutory regime. The Determination itself remains confined to design and specification.

• Other determinations and subordinate instruments. Clause 3 expressly preserves other determinations. Where more than one determination touches a denomination, reconciliation will require reading instruments together and identifying any temporal or hierarchical rules in the parent Act regarding conflicting subordinate instruments. The Determination itself does not set out conflict-resolution rules.

Areas of regulatory silence that imply interaction with other laws and practices

• Legal-tender status and redemption. The Determination does not state whether each coin is legal tender, nor at what value it will be treated in law aside from the face value inscription. Legal-tender treatment is governed by the Currency Act and related authorities; producers and distributors will need to consult those sources to determine the coin’s legal status in transactions.

• Taxation, customs and export controls. The Determination states bullion content and weight for many coins (for example cl 18’s "1 KILO 999 SILVER", cl 21's "1 OZ. 9999 GOLD"). Those features may interact with tax law (GST, excise, customs, capital gains or commodities taxation) and export-control regimes, but the Determination does not address those interactions. Any obligations under tax or customs law must be determined with reference to the relevant statutes and administrative guidance.

• Intellectual property and use of monarch effigy. The Determination mandates use of an effigy of the Queen on all obverses (repeated in many clauses). The right to use the effigy and other elements of Royal iconography is governed by separate administrative permissions and protocols; the Determination itself prescribes the visual result but does not explain the intellectual property or authorisation steps required beyond being made under the Currency Act.

• Consumer protection and misrepresentation law. The reverse inscriptions claim bullion content and purity for many coins. Those representations interact with consumer protection statutes that prohibit misleading or deceptive conduct. The Determination creates a basis for truthful assertions, but distributors who misrepresent coins contrary to the prescribed inscriptions may still be liable under consumer-protection laws.

Practical implications of interdependence

• Administrators and manufacturers will need to coordinate with agencies responsible for currency issuance, taxation, customs and intellectual property to ensure the coin issues resulting from this Determination are legally compliant in all respects.

• Clause 3’s preservation of other determinations means production programmes must be reconciled with any prior determinations already in force, and that the Determination is one element in a broader statutory and administrative mosaic governing coin issuance.

• The Determination’s technical prescriptions will serve as evidence of intended specification in legal or administrative proceedings, but sanctions and remedial measures for non-compliance are located outside the instrument itself.

Overall, the Determination sits within a wider legal ecosystem; it prescribes the technical attributes of specified coins while delegating legal treatment, enforcement and operational implementation to other laws and administrative arrangements.

The Determination as provided contains the following dated and procedural material: it is made by Paul Elliott, Parliamentary Secretary to the Treasurer, dated 2 March 1995, and it commences on 20 March 1995 (introductory matter; cll 1-2). There is no express record in the text of any amendments, revocations, or replacement determinations. No subsequent dates, amendment notes, savings or transitional arrangements are printed within the instrument provided.

Internal structural observations relevant to amendment and correction

• Multiple near-duplicate clauses and numbering gaps. The Determination contains a series of highly similar clauses for the same denominations (notably multiple clauses headed "Specifications and design of a $2 silver coin" at cll 5-10), which points to a deliberate enumeration of variants but also increases the likelihood that further instruments would be desirable to correct errors or clarify variant ordering. The instrument as printed contains no cross-reference table or mintage identifiers that would typically be used to track individual issues in administrative records.

• Textual errors and placeholders. The instrument as published contains typographical and formatting anomalies (for example cl 12(8)(b) contains "ELIZABETH IP,"; cl 18(1) uses "not less man 99.9% silver"; multiple inscriptions include image placeholders such as image.003.png and image.004.png). Those features are present in this published text and may, in practice, have required corrigenda, replacement pages, or separate amendment determinations to resolve ambiguities in the artwork and inscriptions. The Determination as provided does not show such corrections.

• Truncated or incomplete clauses. Clause 15 appears to have textual discontinuity: after stating a standard weight and variation it then jumps into an inscription segment introduced by "(i) 'THE AUSTRALIAN KOALA ...'", missing the standard clause structure with diameter and thickness lines that other clauses contain. Such truncation is included in the instrument as provided and, in practice, would be a candidate for administrative correction or amending instrument to ensure the clause is operationally complete.

What is recorded in the instrument

• Only the original making date (2 March 1995), the commencement date (20 March 1995), and the absence of any express amendment history within the text. No later amendment dates, no repeal or replacement statements, and no footnote references to later instruments are printed in the provided document.

Implication for research and operational use

• A practitioner relying on this Determination should verify the current status and any amendments or corrigenda by consulting an authoritative source of legislation (for example the official Federal Register or Treasury records) rather than relying solely on this printed text. The presence of typographical errors and placeholders in the provided copy increases the probability that later corrections exist; because the instrument itself does not include amendment annotations, external confirmation is required.

In short, this document as presented contains an initial issuance record but no internal amendment history; its textual irregularities suggest practical avenues where amendments or corrections may have been necessary, although none are recorded within the text itself.

The Determination text as provided does not record any litigation history, court challenges, or judicial interpretation relating to it. There are no named cases within the instrument and no references to judicial decisions. Accordingly, the document contains no instance of litigation citations.

Potential litigation exposure suggested by the instrument’s content

• Disputes about conformity to specifications. Because the Determination is precise about weights, purities, diameters and inscriptions (for example cll 4(4)-(7), 11(4)-(7), 21(4)-(7)), a plausible source of litigation would be claims by purchasers or the issuing agency that a production run failed to meet those specifications. The availability of objective measures means such disputes could be litigated as contract or administrative law matters, with assays and metrological tests serving as primary evidence.

• Misrepresentation or consumer-protection claims. The reverse inscriptions repeatedly make representational claims about metal content and purity (for example cll 4(9)(b)(i), 11(9)(b)(i), 21(9)(b)(i)). If coins sold or marketed deviated from those representations, purchasers might bring consumer-protection claims for misleading representations. The Determination itself would be prima facie evidence of the authorised claims, but enforcement would proceed under consumer law and contract law rather than the Determination’s text.

• Intellectual property and image use challenges. The Determination mandates the use of the Queen’s effigy for obverse designs across the set (e.g. cll 4(8), 11(8), 21(8)). Disputes might arise concerning the right to use particular artist effigies or die designs, although the Determination establishes authority for the imagery; any challenge would likely concern licensing or attribution for specific effigy designs and would be governed by separate administrative or contractual arrangements.

• Commercial disputes over variant designs and acceptance. The presence of multiple near-identical clauses for the same denomination (cll 5-10) could give rise to dispute about which variant corresponds to a particular contract or release, and manufacturers or distributors might litigate over whether a delivered batch corresponds to the contractual specification.

Limitations of available information

• Because the Determination includes no record of subsequent administrative decisions, approvals, or contestations, the absence of litigation history in the text cannot be taken as proof of absence of litigation in the broader public record. A practitioner seeking to determine whether any disputes arose in practice would need to search court records, administrative tribunal transcripts and public procurement records.

In sum, no litigation history is recorded in the Determination itself; the instrument’s specification-heavy nature creates objective bases for disputes that could be litigated or otherwise contested under contract, administrative, consumer protection or intellectual property law, but any such litigation would be external to and not recited in the instrument.

This Determination contains a number of drafting, structural and operational features that create specific risks or hazards for practitioners and implementers.

1. Multiple near-duplicate clauses without clear issuance identifiers

• Several denominations, notably the $2 silver coin, have multiple clauses (cll 5-10) that reproduce the same geometric and mass specifications but differ only in reverse imagery or inscription. The Determination does not provide a simple internal identifier (mintage number, issue name, or separate schedule) to map each clause to a distinct release or batch. That increases the risk of ambiguity in contracting, production planning and public sales literature. Administrators should ensure they can tie each clause to an authorised minting instruction.

2. Textual anomalies, placeholders and truncated clauses

• The text contains image placeholders in inscriptions (for example image.003.png in cll 11(9)(b)(i) and 12(9)(b)(i); image.004.png in cl 14(9)(b)(i); image.005.png in cl 15). The Determination as printed does not resolve what actual text or mark those images substitute for. Implementers must obtain the authorised artwork and final wording from the issuing authority rather than rely on the printed placeholders.
• Clause 15 shows an apparent truncation: after standard weight and variation (cl 15(4)-(5)) there is an immediate jump to an inscription item labelled "(i) 'THE AUSTRALIAN KOALA ...'", with preceding structural lines (diameter, thickness) absent. The instrument as provided is incomplete at that point and requires clarification.

3. Typographical errors in key textual fields

• Some clauses have misspellings in obverse inscriptions (cl 12(8)(b) reads "ELIZABETH IP," cl 18(8)(b) reads "ELIZABETH IT,"). Clause 18(1) uses "not less man 99.9% silver." These are part of the published instrument and may have unintended legal implications if reproduced literally on dies. Producers should seek authoritative corrected text or formal corrigenda.

4. Extremely precise tolerances on small mass coins

• Several gold and platinum issues for small coins set tolerances as tight as ±0.015 grams on a 1.571 gram standard weight (cll 11(4)-(5), 12(4)-(5)). That requires very precise manufacturing and measurement capability. Quality-control regimes must be designed to detect and reject non-conforming items at scale.

5. Discrepancies in magnitudes and plausible physical properties

• Clause 13 specifies a standard weight of 312.347 grams for a $10 silver coin with diameter 75.50 mm and thickness 8.70 mm. That coin would be very large compared with other denominations in the instrument. The Determination contains this figure as printed. Whether that figure represents an intended "proof" or special oversized coin, or a typographical error, is not clarified in the text. Practitioners should verify the intended specification before production.

6. Absence of legal-tender status and distribution details

• The Determination specifies face-value inscriptions (for example "10 DOLLARS", "100 DOLLARS") but does not state legal-tender rules, nor does it provide distribution, pricing or sale volumes. Parties cannot assume legal-tender treatment, mass distribution mandates, or sale price frameworks from this Determination alone and must consult the Currency Act and administrative guidance.

7. No internal enforcement or inspection regime

• The Determination imposes objective standards but contains no inspection, assay, sample size or acceptance-testing provisions. Production contracts will need to include rigorous acceptance criteria and assay protocols to operationalise compliance.

8. Potential inconsistency between obverse standardisation and effigy rights

• The Determination mandates “an effigy of the Queen” on all obverses (see cll 4(8), 5(8), 11(8), 21(8)), but it does not specify which artist's effigy or whether permission to use a particular effigy has been granted. In practice, specific dies and effigy artworks are subject to separate administrative approvals.

9. Missing clause numbers and potential editorial omissions

• The Determination jumps in numbering and content length and appears to omit clauses 16 and 17 in the printed sequence provided. That raises questions about whether the published instrument is complete.

Each of these items is present within the text supplied and must be resolved administratively before tooling, minting and marketing proceed. Failure to resolve them exposes issuers, manufacturers and distributors to operational errors, consumer disputes and reputational risk.

This section sets out a practical compliance checklist and risk mitigation steps for Treasury officials, mint contractors, dealers and compliance professionals responsible for giving effect to the Determination. All steps must be read against the specific clause(s) that prescribe the requirement in each case.

1. Confirm authoritative text and artwork

• Obtain the official master copy of the Determination from the issuing authority or consolidated legislative register to confirm the final text and any corrigenda or amendments. Do not rely on this printed copy alone where placeholders, typographical errors or truncations appear (see cll 11, 12, 15, 18).
• Secure the authorised obverse and reverse artwork files and die specifications for each clause-issued variant. Where the Determination shows image placeholders (image.003.png, image.004.png, image.005.png), obtain the intended artwork and confirm licence/permission to reproduce the effigy and any commemorative logos.

2. Map clause to production batches

• Prepare an internal schedule that maps each clause number to a discrete production run or issue identifier, including intended mintage volume, release date, packaging, and marketing text. For $2 silver coin variants (cll 5-10) ensure each reverse design variant is tracked and documented to avoid confusion over which dies correspond to which release.

3. Establish metallurgical procurement and assay protocols

• Source metal feedstock that guarantees the minimum purities specified: silver not less than 99.9% (cll 4(1), 5(1) etc.), gold not less than 99.99% (cll 11(1), 14(1), 19(1), 21(1)), platinum not less than 99.95% (cll 12(1), 15(1), 20(1), 22(1), 24(1)). Maintain certificates of assay from refineries and perform independent assay tests on incoming lots.
• Implement sampling and independent assay procedures at production acceptance points to verify that minted pieces meet stated purities, particularly because the reverse inscriptions explicitly claim metal content and purity (e.g. cl 4(9)(b)(i), cl 11(9)(b)(i)).

4. Design and tooling to precise dimensional and mass tolerances

• Set die and blank production tolerances to meet standard weights and permitted variations per clause. For small gold/platinum coins, design for ±0.015 g tolerance (see cll 11(4)-(5), 12(4)-(5)); for larger issues, apply the specified tolerances (for example ±0.500 g for many silver coins, cl 4(5), cl 5(5), ±1.00 g for the large $10 silver (cl 13(5)), ±1.50 g for the $30 silver 1 kilo coin (cl 18(5))).
• Ensure diameter and thickness tooling is capable of delivering the specified dimensions (for example cl 13: 75.50 mm diameter, 8.70 mm thickness; cl 18: 101.00 mm diameter, 14.60 mm thickness). Confirm through prototyping that the combination of diameter, thickness and alloy density yields the specified weight.

5. Quality control and acceptance testing

• Implement lot acceptance testing: weigh samples to the stated tolerances, measure diameters and thicknesses, verify edge milling and raised bead encirclement, and inspect inscriptions for correct spelling and placement (given the presence of textual errors in the published Determination, insist on reference to authorised artwork and corrected text).
• Maintain records for each lot: production date, die identifiers, assay certificates, sample test results and final acceptance sign-off. Preserve examples of accepted coins (master samples) for future reference and dispute resolution.

6. Contractual safeguards with manufacturers

• Draft manufacturing contracts to require compliance with the clause-specific specifications as a condition precedent to acceptance and payment. Include warranties as to metal purity, weight tolerances, and imagery accuracy. Specify independent assay, sampling, and rejection rights.
• Insert provisions for rectification, retooling costs and indemnities in event of non-conforming production.

7. Compliance with other legal obligations

• Obtain confirmation from the legal or policy unit on the coin’s legal-tender status, taxation and customs implications before public sale or export. The Determination itself does not set legal-tender rules or distribution terms (cl 3), so these matters must be cleared through the relevant legal framework and administrative policy.
• Confirm permissions for use of the Queen’s effigy and any logos (for example the World Vision logo referenced in one clause, cl 10(9)(b)), and ensure any third-party marks have appropriate licensing.

8. Marketing, numbering and documentation

• Prepare marketing and sales literature that reproduces the exact inscriptions and images authorised by the Determination and the issuing authority’s artwork. Do not publish materials that conflict with the Determination or that purport to alter the legal content of inscriptions.
• Ensure product descriptions accurately reflect the physical specifications to avoid consumer-protection exposure.

9. Pre-release audit and legal sign-off

• Before distribution, perform a legal and technical pre-release audit to confirm that all coins for sale match the Determination’s substance and any corrected text or artwork. Secure sign-off from the responsible Treasury delegate.

10. Maintain an issues and corrections register

• Because the instrument contains multiple drafting anomalies, keep an internal register of any clarifying communications, corrigenda, or ministerial directions that relate to the Determination. Make that register available to auditors, distributors and compliance officers.

11. Plan for post-sale verification and returns

• Establish a procedure to handle customer enquiries, authenticity verification requests, and returns where coins are alleged not to meet the disclosed specification. Maintain sample assays and master samples as references to resolve disputes.

12. Seek clarification where needed

• For any clause where the text is ambiguous (missing diameters, truncated clauses, placeholders), obtain written clarification from the Treasury or the delegate before commencing production. Examples include clause 15’s apparent truncation and the placeholder images in cll 11, 12 and 14.

Adhering to these steps will bridge the gap between the Determination’s technical prescriptions and operational realities. The Determination is narrowly prescriptive on physical attributes; operational compliance requires procedural, legal and contractual workstreams to translate those prescriptions into reliable products and market conduct.
