CROWN LANDS REGULATIONS 1992

The Regulations operationalise several recurring administrative concepts in Crown land management. They should be read as subordinate instruments that give effect to statutory powers in the Crown Lands Act 1992 by specifying forms, conditions, timing and documentary obligations. Main concepts are:

• Commencement by registration. A lease "commences on the date of its registration by the Registrar‑General", unless the lease itself provides otherwise (r 8). This makes registration the mechanical trigger for a lease becoming operative. That affects timing for rent, insurance duties and improvement instalment obligations.
• Mandatory lease covenants. For leases under s 5 of the Act the Regulations prescribe a set of covenants and conditions that must be included (r 9). These cover rent, rates and charges, repair obligations, restraints on assignment/subletting without Ministerial consent, and an express termination mechanism (14 days notice) (r 9(a)-(e)). Those covenants standardise lessee obligations and give the Minister a contractual termination route built into the instrument.
• Insurance and improvement security. Where a lessee pays for improvements by instalments, the lessee must insure improvements from lease commencement and until payment in full, lodge the policy with the Minister within 30 days and produce premium receipts within 30 days of due dates, with insurance proceeds to be used to reinstate improvements (r 10(1)-(5)). The insurer must be approved by the Minister and the policy must be in the joint names of the lessee and the Minister (r 10(1)-(3)).
• Surrender and cadastral update. A surrender requires an appropriate form, Ministerial acceptance and a prescribed fee (r 11). On acceptance the Minister must lodge the surrender for registration (r 12) and, where a lease is partly surrendered, prepare and lodge an amended plan with the Registrar‑General for registration under the Land Title Act 2000 (r 13). This links administrative surrender to title registration and mapping.
• Licence regimes with prescribed conditions. The Regulations prescribe conditions for licences generally (Schedule 1) and additional conditions for classes of licences (Schedule 2), which vary depending on licence activity (supply services, taking natural substances, licences where land has improvements, and licences on natural bushland) (r 14-15, Schedules 1-2). Conditions require licences to obtain other statutory approvals, be non‑transferable without consent, maintain land, prevent spread of weeds, report pollution or safety incidents, remove improvements at licence end, maintain public risk insurance, indemnify the Territory subject to limited exceptions, and allow Ministerial inspections and remedial entry with cost recovery.
• Fee simple conversion pathway. Lessees may apply in writing to the Minister for a grant in fee simple over whole or part of their leased land (r 50(1)). The Minister inspects and may approve, refuse or grant in an amended form (r 51). Partial fee simple grants require survey at the applicant’s expense (r 50(2)). Advertisements for sale of Crown fee simple must specify purchase conditions and deposits (r 52).
• Allocation of administrative costs and financial strings. The Regulations place specific costs on private parties: survey costs for partial fee simple (r 50(2)), deposit required on application to purchase (r 52(2)), licensee responsibility for costs of Ministerial remedial actions (Schedule 1 cl 9(2)), and licensee expenses in recording works for service licences (Schedule 2 cl 1(2)). They also set how witness fees are paid to Ministerial witnesses and exclude Public Sector employees from entitlement unless on leave (r 53).

These concepts combine contractualised default obligations (leases and licences) with administrative process rules (registration, advertising, surveys, lodging forms) and cost allocation between the Territory and private land users. The Minister is a central decision maker (accepting surrenders, approving insurers, consenting to transfer, deciding fee simple applications, approving removal of substances or structures) and the Registrar‑General executes registration consequences. Several conditions reference external legislation , for example the Land Title Act 2000 (r 13), Bushfires Management Act 2016 and Fire and Emergency Act 1996 (Schedule 2 cl 4(3)-(4)), and the Public Sector Employment and Management Act 1993 (r 53(2)) , signalling that compliance requires attention to cross‑statutory obligations.

The Regulations allocate obligations and financial burdens across three main groups: the Minister (and the Territory), lessees/applicants/licensees, and the Registrar‑General or other administrative bodies. Concrete effects are as follows.

Who pays

• Applicants seeking purchase of fee simple land pay a deposit on application when the land is advertised and must fund any required surveys for partial fee simple grants (r 52(2); r 50(2)). Deposit refunds occur where the Minister does not accept an application (r 52(3)).
• Lessees who pay for improvements by instalments bear the cost and administrative burden of insurance premiums and must lodge policies and receipts with the Minister within specified timeframes (r 10(1), (3)-(4)). They are also responsible for re‑instatement work funded by insurance proceeds (r 10(5)).
• Licensees bear operational compliance costs: obtaining other statutory approvals (Schedule 1 cl 1), maintaining the land (cl 3), preventing spread of weeds (cl 4), removing improvements at licence end (cl 6), maintaining public risk insurance (cl 10), and meeting costs of providing construction records for service licences (Schedule 2 cl 1(2)). If the Minister enters to remedy a default the licensee pays the Minister’s costs (Schedule 1 cl 9(2)).

Who decides

• The Minister exercises several discretionary functions: accepting or refusing surrender (r 11), consenting to assignment or sublease (r 9(d)), approving insurers and insurance conditions implied by r 10, deciding applications for fee simple grants after inspection (r 51), specifying conditions and deposits in advertisements for fee simple purchase (r 52(1)), and requisitioning reports from licensees on quantities taken (Schedule 2 cl 2(2)). The Minister may also inspect licensed land at any time (Schedule 1 cl 8) and enter to remedy breaches (cl 9(1)).
• The Registrar‑General registers leases, surrenders and amended plans; registration is the event that starts a lease unless the lease states otherwise (r 8; r 12; r 13 referencing Land Title Act 2000).

Who changes behaviour

• Lessees are incentivised to have improvements insured and to bring all rates and charges current since leases must require payment of all rates, charges and assessments whether payable by the lessee or the Territory (r 9(b)). The 14 day termination provision (r 9(e)) creates pressure on lessees to comply with commonly enforced covenants or risk swift termination.
• Licence applicants and holders face behaviour change via non‑transferability without consent (Schedule 1 cl 2), removal obligations for improvements (cl 6), an indemnity to the Territory (cl 12), and reporting obligations for pollution or incidents (cl 5). For licences that involve taking natural substances the licensee must report volumes on demand and cannot remain on site after removal without approval (Schedule 2 cl 2(1)-(2)), which places administrative reporting and site‑vacation constraints on extractive activities.

Other affected parties

• Public sector employees summoned as witnesses by the Minister are generally not entitled to witness fees unless on leave of absence (r 53(2)), shifting the cost of time from the Territory to the employing agency unless leave is taken.
• Third parties who would otherwise be creditors or contractors of licensees or lessees should note the licensee’s release of the Territory from claims for employee death or injury and property loss (Schedule 1 cl 13), but that release excludes gross negligence or wilful Territory conduct.

Concentrated benefits and burdens

• Those who benefit from greater certainty are administrative actors who need prescribed forms, registration rules and survey links (Minister, Registrar‑General). Those who bear concentrated burdens are individual lessees and licensees who must meet insurance, survey and indemnity obligations, and applicants who fund surveys and deposits.

In sum, the Regulations make clear who pays for specific transactional and compliance costs, who exercises key decisions and inspections, and which practical behaviour changes (insurance, survey, removal of improvements, reporting) licence holders and lessees must implement.

The Regulations transform statutory powers into specific duties and certain limited rights for private parties and the Territory. The duties and rights are contractual, administrative and procedural.

Key duties for lessees

• Inclusion of mandatory covenants and conditions for leases under s 5: prompt payment of rent; payment of all rates, charges and assessments in respect of the leased land whether payable at law by lessee or Territory (r 9(a)-(b)); maintenance and delivery up in good repair (r 9(c)); not assigning, subletting or underleasing without Minister’s consent (r 9(d)); and an express provision that the lease can be determined on 14 days notice (r 9(e)). These convert statutory expectations into enforceable lease terms.
• Where improvement payments are by instalment, the lessee must insure improvements from the lease commencement until full payment, with joint insurance naming lessee and Minister, lodge policies within 30 days of issue, provide premium receipts within 30 days of due dates, and use insurance proceeds to reinstate improvements (r 10(1)-(5)).

Key duties for licensees

• Obtain any approvals, permits or licences required under any other Act necessary for the licensed purpose (Schedule 1 cl 1).
• Do not transfer the licence without written Ministerial approval (cl 2).
• Maintain the licensed land in a clean and tidy state to Ministerial satisfaction and take measures to prevent the spread of weeds (cl 3-4).
• Notify the Minister (and other relevant authority) as soon as practicable of health or safety incidents or potential/actual contamination, pollution or environmental harm (cl 5).
• Remove improvements and chattels at licence end (cl 6).
• Maintain public risk insurance and show evidence on request (cl 10).
• Indemnify the Territory for harm or damage caused by licence activities, including acts or omissions of agents and contractors, save where compensation is provided elsewhere in the licence or where the owner contributed via gross negligence or wilful act or omission (cl 12).
• Release the Territory from claims for employee death or injury and loss or damage of the licensee’s property to the extent permitted by Territory law, subject to exceptions for gross negligence or wilful Territory acts (cl 13).

Key rights for private parties

• Lessees have the procedural right to apply for grant in fee simple in writing (r 50(1)); applicants can expect that the Minister will inspect the area and decide to approve, refuse or approve in amended form (r 51).
• Where an estate in fee simple is advertised for purchase, applicants have the right to make application by paying the specified deposit, and the deposit must be refunded where the Minister does not accept the application (r 52(2)-(3)).
• Licence holders have the right to be notified that the Minister may inspect at any time (cl 8), but concurrently the Minister has the right to enter to remedy failures and recover costs (cl 9(1)-(2)).

Administrative duties of the Territory

• The Minister must cause surrenders accepted to be lodged with the Registrar‑General for registration (r 12).
• When a lease is partly surrendered, the Minister must prepare a new plan delineating amended boundaries and lodge a copy with the Registrar‑General for registration under the Land Title Act 2000 (r 13).
• If Crown land advertised for lease remains unleased it remains available as advertised unless withdrawn or re‑advertised by Gazette notice setting conditions for leasing (r 7).

Procedural rights and constraints

• Registration is the mechanical trigger for commencement of a lease unless the lease provides otherwise (r 8). That gives lessees a right to predictable commencement upon registration but also imposes a duty to monitor registration.
• The Minister’s broad inspection and remedial entry rights (Schedule 1 cl 8-9) are accompanied by a duty on licensees to pay costs incurred by the Minister in exercising remedial powers (cl 9(2)).

Limitations and exceptions

• Several protections for licensees exist in the indemnity clauses: the licensee’s indemnity does not apply to the extent compensation is provided elsewhere in the licence or where the Territory contributed through grossly negligent or wilful conduct (Schedule 1 cl 12(3); cl 13(2)). These are limited carve-outs rather than general protections.

Taken together, the Regulations convert a range of statutory powers into binding, often prescriptive obligations on lessees and licensees, while furnishing the Minister with inspection, remedial and decision‑making rights and the Registrar‑General with registration functions that trigger legal effect.

The Regulations provide administrative enforcement levers, cost recovery mechanisms and contractual remedies rather than standalone criminal penalties. They interact with enforcement provisions likely in the Crown Lands Act 1992 and other Territory statutes, but they do set specific enforcement mechanisms and financial consequences:

Administrative termination and determination

• Leases granted under s 5 of the Act must include a provision for determination on 14 days notice (r 9(e)). This is an express contractual termination mechanism enabling swift end of tenancy for a breach entitling the Minister to issue 14 days notice. The regulation does not itself specify the grounds for giving that notice beyond being a provision required in the lease.

Ministerial inspection and remedial entry

• Licensing conditions give the Minister a right to inspect licensed land at any time (Schedule 1 cl 8). If a licensee fails to carry out obligations, the Minister may enter the land and perform any thing necessary to remedy the failure (cl 9(1)). The licensee is liable for any costs incurred by the Minister in relation to remedial entry (cl 9(2)). That is a cost recovery mechanism: remedial works are funded by the licensee, rather than an explicit fine, but it imposes a concrete monetary consequence.

Contractual indemnities and releases

• Licensees must indemnify the Territory against harm or damage caused to land, water, infrastructure or improvements, including acts or omissions of agents or contractors (Schedule 1 cl 12(1)-(2)). This shifts liability for operational harm to licensees, subject to the carve‑outs (cl 12(3)). Licensees also release the Territory from certain claims relating to employee injury and personal property loss, to the extent permitted by Territory law (cl 13(1)). These clauses have enforcement implications: the Territory may rely on indemnities and releases in civil claims, and licensees’ insurers will be engaged.

Insurance requirements and remedies

• Where improvements are paid by instalments, lessees must maintain insurance in joint names with the Minister, lodge policies and produce premium receipts, and apply insurance proceeds to reinstate improvements (r 10(1)-(5)). Failure to insure or to lodge policies may permit the Minister to take remedial steps or enforce payment under the lease covenants; the regulatory text makes insurance a precondition to holding unpaid improvement obligations.

Surrenders and registration

• A surrender must be in the appropriate form, given to the Minister for acceptance and accompanied by the prescribed fee (r 11). On acceptance the Minister must lodge the form with the Registrar‑General (r 12). These steps are administrative but prescribe consequences for an incomplete surrender process , a surrendered lease is only effective upon acceptance and registration steps, and failure to follow the form or fee requirement could leave a lease in force.

Financial recovery and deposits

• For advertised fee simple purchases the Minister specifies the deposit to be paid; applicants must pay the deposit on application, and deposits are refundable where applications are not accepted (r 52(1)-(3)). The Regulations give the Minister authority to set purchase conditions; they do not state specific penalties for failing to pay deposits, but the practical result is that non‑payment blocks application.

Procedural witness payments

• Witnesses summoned by the Minister are to be paid fees and expenses as for Supreme Court witnesses, subject to the exception that Public Sector employees are not entitled while at work unless on leave (r 53(1)-(2)). This defines an entitlement and a budgetary consequence for the Minister’s witness summonses.

Absence of express criminal sanctions within the Regulations

• The Regulations do not themselves create offences or express fines or imprisonment penalties. Enforcement in the criminal or penalty sense will be via the Act or other Territory legislation. The Regulations focus on contractual terms, administrative obligations, inspection and entry rights, and cost recovery.

Practical enforcement risks and implementation points

• The breadth of Ministerial discretion in accepting surrenders, consenting to assignments and deciding fee simple applications, combined with the contractual enforcement tools (indemnities, insurance, cost recovery, 14 day termination), concentrates enforcement power in the administrative sphere. Non‑compliance primarily produces contractual or administrative remedies (entry and remedial action, cost recovery, termination) rather than immediate statutory fines in the Regulations themselves.

Where more severe enforcement or regulatory sanctions are required, the Act and other statutes mentioned (for example environmental or bushfire laws referenced in Schedule 2) are the likely vehicle. Practitioners advising clients should map regulatory duties here to offence or penalty provisions in the Act and other relevant Territory statutes to identify the full enforcement profile.

The Regulations explicitly reference and operate alongside several Territory statutes and administrative instruments. They are a subordinate instrument made under the Crown Lands Act 1992 and integrate with land title, public sector, fire management and other regulatory regimes.

Statutory cross‑references inside the Regulations

• Crown Lands Act 1992: The Regulations implement particular powers and duties under the Act by prescribing lease covenants (r 9 for s 5), surrender formalities (r 11 for s 27(f)), licence conditions (r 14-15 for s 92(2)(a) and (b)), and witness summons payments under section 98 (r 53). Where the Regulations refer to these sections they do not restate the Act; they operationalise the Act’s delegated powers.
• Land Title Act 2000: Regulation 13 requires the Minister to prepare and lodge an amended plan with the Registrar‑General for registration under the Land Title Act 2000 when a lease is partly surrendered. That creates an explicit cadastral and registration interaction. Survey and registration processes under the Land Title Act will therefore be triggered by surrenders and partial fee simple grants.
• Bushfires Management Act 2016 and Fire and Emergency Act 1996: Schedule 2 cl 4(3)-(4) require a licensee on land with natural bushland to establish and maintain firebreaks in accordance with those Acts if the land is within a fire protection zone or an emergency response area respectively. This places licence holders within the compliance scope of those fire safety statutes, imposing overlapping duties.
• Public Sector Employment and Management Act 1993: Regulation 53(2) excludes employees within the meaning of that Act from entitlement to witness payments unless they are on leave of absence. This is an employment and budgetary interaction affecting territory employees summoned by the Minister.
• Other approvals and permits under any other Act: Schedule 1 cl 1 requires licensees to obtain any approvals, permits or other licences required under any other Act necessary for the purpose for which the licence was granted. That is a sweeping cross‑statutory integration clause making licence validity contingent on compliance with other regulatory regimes (environmental, planning, water, mining, biosecurity, local government rates, etc.), although the Regulations do not list which Acts apply.
• Land Title and surveying obligations: Regulation 50(2) requires that partial grants of estates in fee simple be surveyed at the applicant’s expense, engaging surveying law and practice and any statutory requirements in the Land Title Act 2000 for survey standards, plan lodging and registration.

Administrative interaction and overlapping duties

• Insurance and public risk: Schedule 1 cl 10 requires a policy of public risk insurance in relation to the licensed land and cl 12 creates an indemnity. These insurance duties will interact with insurer policy wordings, workers compensation and other statutory liability regimes; they may also affect a licensee’s commercial arrangements with contractors and suppliers.
• Environmental and contamination reporting: Schedule 1 cl 5 requires licensees to notify the Minister and any other relevant authority of incidents involving health and safety or contamination. This cross‑references environmental protection and public health schemes, creating concurrent reporting duties. The Regulations do not supersede statutory notification timelines in environmental legislation; rather they add a Ministerial notification requirement.
• Fees and costs interplay: The Regulations set deposit, fee and cost allocations (r 11 prescribed fee for surrender; r 52 deposits; Schedule 1 cl 9(2) cost recovery). Those amounts will interact with financial delegations, revenue law, and any regulations about fees and charges set under the Act or Treasury practice notes. The Regulations do not specify amounts, leaving them to be prescribed elsewhere or decided administratively.

Amendment and repeal interaction

• The endnotes document repeals and amendments that have restructured Part 3 and Schedules (2016, 2023, 2026 amendments). These changes may have removed or updated licence classes and conditions, which can produce discontinuities with prior administrative practices and transitional rules in the amending instruments. Practitioners should consult the amending instruments and the Act for transitional provisions.

Taken together, the Regulations create an administrative overlay that demands cross‑statutory compliance. Licence holders and lessees must manage compliance not only with the lease or licence terms but also with separate Acts referenced by the Regulations. The Minister’s powers under the Regulations are exercised within that multi‑statute context, and the Registrar‑General’s registration duties under the Land Title Act 2000 operationalise cadastral consequences.

The reprint includes a concise audit trail of the principal amendments to the Regulations since their making in 1992. The Endnotes and List of Amendments in the reprint supply sources and dates. From the reprint:

• Original instrument and commencement: Crown Lands Regulations (SL No. 24, 1992), notified 26 June 1992, commenced 26 June 1992 (Endnotes 2).
• Statute Law Revision Acts and consequential amendments have produced various small and formal changes over time. The Statute Law Revision Act (No. 2) 1998, with multiple commencement dates through 1999, made repeals and formal amendments to the Regulations (Endnotes 2 and 4 show r 55 rep Act No. 92, 1998, s 6(5); see list).
• Land Title (Consequential Amendments) Act 2000 (Act No. 45, 2000) amended the Regulations, with specific changes such as r 13 being amended by s 12 (Endnotes note r 13 amd Act No. 45, 2000, s 12).
• Statute Law Revision Act 2003 (Act No. 12, 2003) effected changes that were commenced 18 March 2003 and are recorded in the list of amendments (r 53 amended by Act No. 12, 2003, s 19).
• Crown Lands Amendment Regulations 2016 (SL No. 3, 2016) made amendments notified 16 March 2016 and commenced the same day; the list shows several r numbers amended or repealed by No. 3, 2016 (for instance r 11 amd No. 3, 2016, r 3; r 32 amd No. 3, 2016, r 4; r 43 amd No. 3, 2016, r 6; r 49 rep No. 3, 2016, r 7; r 50 amd No. 3, 2016, r 8; r 56 rep No. 3, 2016, r 9; sch rep No. 3, 2016, r 10).
• Crown Lands Amendment Regulations 2023 (SL No. 10, 2023), made 11 May 2023 and commenced 25 May 2023, effected a substantial re‑structure of Part 3 into a different layout and inserted Schedules 1 and 2 (pt 3 hdg sub No. 10, 2023, r 5; rr 14-15 sub No. 10, 2023, r 5; sch 1-2 ins No. 10, 2023, r 6). Many prior regulations rr 16-49 were repealed or replaced in that exercise (List of amendments).
• Statute Law Amendment (Territory Economic Reconstruction) Act 2021 (Act No. 19, 2021) also made repeals and revisions to parts of the Regulations identified in the endnotes (rr 5-6 rep Act No. 19, 2021, s 41).
• Most recently, Statute Law Revision and Repeals Act 2026 (Act No. 3, 2026) received assent 9 February 2026 and commenced 10 February 2026; the reprint indicates that the Regulations are current as in force at 10 February 2026 and that the Act amended certain provisions (Endnotes 2 and 4: "amd Act No. 3, 2026, s 64").

Practical implications of the amendment history

• The 2016 and 2023 amendments appear to have restructured Part 3 and the licensing regime, replacing prior detailed classes and content with the current Schedules 1 and 2. The reprint expressly notes repeals of numerous regulations and insertion of Schedules in 2023. That suggests practitioners should not rely on pre‑2023 versions of Part 3 for current licence conditions.
• The 2000 amendment to r 13 aligns surrender‑related mapping obligations with the Land Title Act 2000, showing a deliberate integration of Crown land surrender mechanics and land title registration.
• Statute law revision acts have produced formal changes to punctuation, numbering and cross‑references; the reprint’s Endnotes make clear which regulations were amended formally by the Interpretation Legislation Amendment Act 2018.

For legal advice and transactional work, always check the specific amending instrument cited in the Endnotes for transitional provisions, repeals and commencement timings. The reprint lists the acts and subordinate legislation that changed specific regulations (Endnotes and List of Amendments).

The Regulations’ reprint contains no case law, judicial interpretations or recorded litigation decisions. The instrument itself does not list judicial challenges or determinations that interpret its provisions.

What the reprint shows

• The text and endnotes provide a legislative history and amendment log, but they do not record any court decisions or appeals that address the Regulations’ meaning or application.
• No cases are cited in the Regulations, and the schedules and provisions are framed as administrative and contractual requirements rather than penal or criminal offences that might have generated litigation recorded in the instrument.

Implication for practitioners

• To identify litigation that bears on these Regulations, advisers must search Territory judicial records, administrative tribunal decisions and reported cases interpreting the Crown Lands Act 1992 and its Regulations. The Regulations themselves do not provide such a catalogue.
• Key provisions that are likely to attract judicial review or civil litigation in practice include: Ministerial discretion in accepting surrenders and deciding fee simple applications (rr 11, 50-51); exercise of power to determine leases on 14 days notice (r 9(e)); the Minister’s right to enter licensed land and recover costs (Schedule 1 cl 9); indemnity and release clauses in licences (Schedule 1 cl 12-13); and disputes around procedural requirements such as registration dates for lease commencements (r 8) or survey adequacy for partial fee simple grants (r 50(2)). Resolution of those disputes will rely on case law under the Act and administrative law principles, but none is recorded in this reprint.

Recommendation

• Because the Regulations are administrative in nature and interact with the Act and other statutes, practitioners should supplement this instrument review with searches for judicial decisions under the Crown Lands Act 1992, Land Title Act 2000, relevant environmental statutes and administrative law precedents to identify how courts and tribunals have interpreted Ministerial discretion, indemnities, termination provisions and survey/registration requirements.

The Regulations contain several operational traps for lessees, licensees and advisers. These are not legal conclusions but concrete mechanics that commonly generate disputes or unanticipated costs:

Commencement tied to registration (r 8)

• A lease may not take effect until registered with the Registrar‑General, unless the lease itself specifies otherwise. If the parties assume the lease begins on signing, they may inadvertently incur liabilities (insurance, rent, repair obligations) that the Minister could enforce from registration. Practitioners should track registration timing and include interim arrangements if needed.

Insurance formalities and timing (r 10)

• Where improvements are paid by instalments the lessee must insure from the commencement of the lease and keep insurance until full payment, lodge the policy within 30 days of issue and forward premium receipts within 30 days after they are due. Failure to lodge policies or receipts within set timeframes may breach the lease covenant and expose the lessee to remedial action or loss if improvements are damaged. The insurer must be approved by the Minister and the policy must be jointly held , policy negotiation must reflect these named party requirements.

No compensation for improvements and removal requirement (Schedule 1 cl 6-7)

• Licence holders have no right to compensation for improvements and must remove improvements and chattels at licence termination. Parties that invest in improvements on licensed land carry removal and abandonment risk. This affects asset valuation, security taken by financiers and return‑on‑investment calculations. The removal obligation can be operationally expensive and logistically complex if plant and machinery are established.

Indemnities and release (Schedule 1 cl 12-13)

• The licence requires the licensee to indemnify the Territory for harm or damage and to release the Territory from claims relating to employee injury and property loss, subject to limited exceptions. Licensees must ensure insurance and contractual arrangements with contractors reflect these shifts of risk; insurers may require broad cover and holdbacks. The indemnity extends to acts/omissions of agents and contractors, increasing vicarious risk.

Ministerial remedial entry with cost recovery (Schedule 1 cl 9)

• If a licensee defaults, the Minister may enter and remediate and charge the licensee. This could lead to immediate cash calls from the Territory for remedial work rather than fines. Licensees should maintain compliant operations and keep records of communications to contest scope or reasonableness of remedial works if necessary.

Transfer restrictions (Schedule 1 cl 2)

• Licences are not transferable without written Ministerial approval. This complicates restructure, sale, or financing of licence‑based businesses; financiers may require specific mortgage/security arrangements to protect their position where transfer is restricted.

Survey cost and technical risk for part fee simple (r 50(2))

• An applicant for fee simple in part of a lease must pay for the survey. Survey disputes, boundary complexities, and re‑establishment of monuments can produce significant costs. Counsel and surveyors should be engaged early to scope likely survey charges and timeframes.

Deposit mechanisms and refund (r 52)

• An advertised fee simple purchase requires payment of a deposit on application, which is refundable only if the Minister does not accept the application (r 52(3)). The Regulations do not spell out conditions for forfeiture or default post acceptance , further contract terms or the Act will fill gaps. Applicants must secure funds and understand refund triggers.

Surrender form and prescribed fee (r 11)

• Surrender must be in the appropriate form and accompanied by the prescribed fee. Using the wrong form or failing to pay the fee can leave leases in force. The concept that surrenders must be "accepted" by the Minister before lodging (r 11-12) means a lease is not necessarily terminated until the administrative steps are completed.

Interplay with other statutes and practical compliance gaps

• Schedule 1 cl 1 makes licence validity conditional on obtaining other required approvals under other Acts. Licensees who assume the licence alone is sufficient risk operational stoppages for lack of environmental, planning or water licences. Practitioners should map all relevant approvals before making investments.

Public sector witness payment exclusion (r 53(2))

• Public sector employees summoned by the Minister are not entitled to witness payments unless on leave. Agencies and employees should be aware of this internal cost and leave management implication.

Stock conversion oddity (r 54)

• The calculation rule that 5 sheep equal 1 head of cattle for stock counting purposes is a fixed equivalence that affects stocking rate calculations, rent or licence conditions that reference "stock carried". Misapplication of the conversion could change stocking assessments and associated obligations.

Burdens on purchasers and financiers

• Survey and registration requirements, non‑compensation clauses and licence transfer restrictions complicate financing and sale structures. Financial institutions will want express security protections and covenant mechanisms that are not provided by the Regulations.

In short, the Regulations set rigid administrative mechanics that create timing, insurance, survey and removal obligations, shift liabilities via indemnities and releases, and give the Minister remedial entry and discretion. Those mechanics frequently become the source of unanticipated costs if parties do not plan for registration timing, insurance formalities, survey costs and Ministerial approvals.

This is a practical checklist referencing the relevant Regulations and Schedules. It is not exhaustive legal advice but a procedural guide to reduce compliance risk.

If you are a lessee

• Confirm the lease wording: ensure the lease includes the mandatory covenants prescribed by r 9 if it is a s 5 lease. Check the rent covenant, payment of rates, repair obligations, assignment restrictions and the 14 day determination clause.
• Track registration timing: recognise that the lease will commence on the date of registration by the Registrar‑General unless the lease says otherwise (r 8). If you need the lease to begin earlier or later, negotiate express commencement terms.
• If paying for improvements by instalments: select an insurer approved by the Minister (or seek Minister approval), insure improvements from lease commencement, ensure the policy is in the joint names of lessee and Minister, lodge the policy with the Minister within 30 days of issue and forward premium receipts within 30 days of their due dates (r 10(1)-(4)). Keep records to prove compliance.
• Keep rates and charges current: leases must require payment of all rates, charges and assessments whether payable at law by the lessee or by the Territory (r 9(b)). Budget for these charges.
• Plan for surrender: if surrendering a whole or part lease, provide the appropriate form, pay the prescribed fee and await Ministerial acceptance before assuming a lease is off the records. After acceptance the Minister will lodge the surrender with the Registrar‑General (r 11-12).

If you are a licensee

• Pre‑contract due diligence: identify all other permits and licences required under other Acts for your intended use and obtain them before or contemporaneously with licence commencement (Schedule 1 cl 1).
• Insurance and indemnity: obtain and maintain public risk insurance and be prepared to provide evidence to the Minister on request (Schedule 1 cl 10). Ensure indemnity exposures in cl 12 are covered by insurance and contractual provisions with contractors.
• Records and reporting: have processes to report health, safety, contamination or pollution incidents to the Minister and other relevant authorities promptly (cl 5). For licences involving taking natural substances, put record collection processes in place to report volumes as requested within 12 months following licence end (Schedule 2 cl 2(2)).
• Physical works and removal: where works are constructed to enable services, record details and locations and provide them to the Minister on completion (Schedule 2 cl 1(1)). Budget for removal obligations at licence end (Schedule 1 cl 6).
• Prevent breaches: maintain the land in clean and tidy condition, take measures against weed spread, and where relevant observe vegetation protections and firebreak obligations under the Bushfires Management Act 2016 and Fire and Emergency Act 1996 (Schedule 1 cl 3-4; Schedule 2 cl 4).

If you are an applicant for fee simple or purchaser

• Submit a written application to the Minister for fee simple grants (r 50(1)) and be ready for Ministerial inspection (r 51).
• If applying for a part fee simple, arrange and pay for a survey at your expense before grant or as required (r 50(2)). Engage a licensed surveyor early to scope survey timelines and costs and to co‑ordinate registration under the Land Title Act 2000.
• For advertised purchases pay the deposit specified in the advertisement at the time of application and retain proof of payment. Understand the refund rule if the Minister does not accept your application (r 52(2)-(3)).

For all parties dealing with transfers, assignments or financing

• Factor in Ministerial consent requirements for assignment and subletting (r 9(d)) and non‑transferability of licences without Minister approval (Schedule 1 cl 2). Obtain written consent before transaction completion. Lenders should seek standard Ministerial consent and charge arrangements to secure collateral.
• Check how indemnities and release clauses in licences affect recoverability and subrogation rights; ensure mortgage and security documentation contemplates licence removal obligations and no compensation clauses (Schedule 1 cl 6-7).

Administrative practice and record‑keeping

• Keep copies of all policies, premium receipts, Ministerial approvals, licences, lease documents, survey plans and correspondence proving compliance with timing obligations (r 10(3)-(4); r 11).
• Maintain an incidents register to satisfy the prompt notification obligation and to establish compliance history (Schedule 1 cl 5).
• Maintain construction records and as‑built information where a licence permits service infrastructure; these must be produced to the Minister on completion and not recoverable from the Territory (Schedule 2 cl 1).

Dealing with Ministerial discretion

• Where the Regulations give the Minister discretion (accepting surrenders, consenting to assignment, approving insurers), obtain written approval decisions and reasons to support administrative review or legal challenge if necessary. For fee simple applications, prepare a comprehensive submission including survey, environmental and planning approvals to reduce the likelihood of refusal or conditional approval (rr 50-51).

Engage professional advisers

• Use solicitors for drafting lease and licence terms that align with the Regulations and financiers’ needs.
• Use licensed surveyors for required surveys and to produce plans suitable for registration under the Land Title Act 2000 as required by r 13 and r 50(2).
• Ensure insurance brokers understand joint naming and produce policies that meet Ministerial requirements and indemnity exposures.

Following this operational checklist will reduce common compliance failures highlighted by the Regulations: lapses in insurance paperwork, mis‑timed assumptions about commencement, unbudgeted survey or removal costs and inadequate cross‑statutory approvals.
