# SCHEDULE 2 - Transitional Prov SCHEDULE 2 - Transitional Provisions [Section 73](#GS73@EN) [(2)](#GS73@Gs2@EN) > **1.**   In this Schedule ***repealed Act*** means the *Crown Lands Act 1935*. > **2.**   Any proclamation made under section 7 of the repealed Act and in force immediately before the commencement of this Act continues to have effect as an order under [section 8](#GS8@EN) of this Act. > **3.**   Any lease granted under section 7 of the repealed Act continues to have effect as if granted under this Act. > **4.**   Any lease or licence granted under any provision other than section 7 of the repealed Act has effect as if this Act had not been passed. > **5.**   Any contract for the sale of any Crown land under the repealed Act shall have effect as if this Act had not been passed but a purchaser of any Crown land who is paying instalments under the terms of purchase under the repealed Act may, on or after the commencement of this Act, obtain the issue of a grant in respect of that land upon payment, with the approval of the Minister, of the balance purchase price together with interest and any other sum owing in respect thereof. > **6.**   Where a notice of an auction for the sale of any Crown land has been given under section 29 of the repealed Act or for an auction lease of any Crown land under section 80 of that Act the auction shall be held and the land sold or leased (as the case may be) as if this Act had not been passed. > **7.**   Any bailiff of Crown lands appointed under section 13 of the repealed Act shall be deemed to have been appointed under [section 11](#GS11@EN) of this Act. > **8.**   [*\[Schedule 2 Amended by No. 4 of 2017, Sched. 1, Applied:01 Jul 2019\]*](/view/html/inforce/2019-07-01/act-2017-004#JS1@Ja27@GC4@EN) Upon the repeal of [sections 12](/view/html/inforce/2026-04-12/act-1929-027#GS12@EN) and [13 of the](/view/html/inforce/2026-04-12/act-1929-027#GS13@EN) [State Sinking Fund Act 1929](/view/html/inforce/2026-04-12/act-1929-027) by this Act the moneys remaining in the special fund constituted under those sections shall be paid by the Commissioners into the Public Account at the request of the Treasurer at such times and in such amounts as the Treasurer may consider desirable or expedient.
