### 55 Closure of highway; land how dealt with > > (1)  Where a highway or part thereof is closed so that it ceases to exist as such – > > > > > > (a) if the land upon which the highway or part of the highway is situated is owned in fee simple by any person, the public right of use thereof shall absolutely determine and the land shall merge into the fee simple; and > > > > > > > (b) in any other case, the land shall become Crown land. > > > (2)  The Minister may exchange any land referred to in [subsection (1)(b)](#GS55@Gs1@Hpb@EN) or any other Crown land for any land of any other person for the purpose of constructing a road or highway thereon.
