### 38 Termination of lease in consequence of mining operations
> > (1) [*\[Section 38 Subsection (1) amended by No. 9 of 2003, Sched. 1, Applied:16 Apr 2003\]*](/view/html/inforce/2003-04-16/act-2003-009#JS1@Ja13@GC2@EN) [*\[Section 38 Subsection (1) amended by No. 60 of 2000, s. 9, Applied:14 Nov 2000\]*](/view/html/inforce/2000-11-14/act-2000-060#GS9@EN) Where the Minister is satisfied that, by reason of any mining operations being carried out under the [Mineral Resources Development Act 1995](/view/html/inforce/2026-04-12/act-1995-116) in, on, or under any land which is subject to a lease granted by the Minister under this Act, that land cannot reasonably be used for the purposes for which it is authorised to be used under the lease, he shall, on the application in writing of the lessee, cancel the lease as to the land affected by those operations.
