### 37 Termination of lease where land required for public or other purposes
> > (1) [*\[Section 37 Subsection (1) amended by No. 60 of 2000, s. 8, Applied:14 Nov 2000\]*](/view/html/inforce/2000-11-14/act-2000-060#GS8@EN) Where, in the opinion of the Minister, any land subject to a lease granted by the Minister under this Act–

> > > > (a) [*\[Section 37 Subsection (1) amended by No. 17 of 1996, Applied:19 Mar 2002\]*](/view/html/inforce/2002-03-19/act-1996-017#AT@EN) is required for any public purpose; or
> > >
> > > > (b) is required for the purposes of any other Act; or
> > >
> > > > (c) should be made available for any purpose which he considers desirable in the public interest–

> > the Minister may, upon giving the lessee 3 months' notice in writing specifying the land or portion of the land which is required or should be made available and the purpose or purposes for which the land is so required or should be made so available, by notice in the *Gazette*, cancel the lease in respect of the land so required or that should be made so available.

> > (2) *\[Section 37 Subsection (2) amended by No. 23 of 1978, s. 6 and Sched. 1 \]*Where the lease is cancelled as to portion only of the land comprised in the lease, the lease shall have effect in respect of the land remaining under the lease and the Director-General shall determine the rent payable under the lease in respect of that land and the rent so determined shall be the rent payable thereafter under the lease.

> > (3) *\[Section 37 Subsection (3) amended by No. 23 of 1978, s. 6 and Sched. 1 \]*In determining the rent under [subsection (2)](#GS37@Gs2@EN) , the Director-General shall make due allowance for the diminution, if any, in the relative value of the land –

> > > > (a) by reason of the reduction in the area of land to be held under the lease; or

> > > > (b) for such other reason as the Director-General thinks fit.

> > (4) A notice under [subsection (1)](#GS37@Gs1@EN) is not a statutory rule within the meaning of the [Rules Publication Act 1953](/view/html/inforce/2026-04-12/act-1953-050) .
