### 22 Forfeiture for non-payment of instalments > > (1) Where default is made in the payment of any instalment of the purchase-money in respect of any Crown land and the default continues for a period of 60 days or more the Minister shall, unless he is satisfied that forfeiture would inflict undue hardship upon the purchaser, by notice published in the *Gazette*, declare that land to be forfeited to the Crown. > > > (2) Before the Minister declares any land to be forfeited as provided in [subsection (1)](#GS22@Gs1@EN) he shall – > > > > > > (a) cause to be published in the *Gazette* a notice of his intention to declare the land to be forfeited at the expiration of 30 days from the date of the publication of the notice; and > > > > > > > (b) cause a copy of the notice to be served on the purchaser. > > > (3) A notice under this section is not a statutory rule within the meaning of the [Rules Publication Act 1953](/view/html/inforce/2026-04-12/act-1953-050) .
