70 Offence—offender reporting in person must provide
identification etc
(1) A registrable offender commits an offence if—
(a) the offender is required to make a report in person under a
reporting obligation provision; and
(b) the offender makes the report in person, or accompanies
someone else who makes the report in person for the offender;
and
(c) the offender or other person does not take all reasonable steps
to—
(i) present for inspection the offender’s Australian driver
licence (if any) or another form of identification, or other
document, prescribed by regulation to verify or support
details in the report; and
(ii) provide a photograph of the offender’s head and face of a
kind suitable for use in an Australian passport.
(2) In deciding whether a registrable offender took all reasonable steps to
comply with subsection (1) (c), the court must have regard to the
(a) the offender’s age;
(b) whether the offender had, at the time of failing to comply with
subsection (1) (c), a disability that affected the offender’s ability
to understand, or to comply with, that subsection;
(c) whether the form of notice given to the offender about the
offender’s obligation under subsection (1) (c) was adequate to
tell the offender about the obligation, having regard to the
offender’s circumstances;
