116N Occupier entitled to be present during search etc
(1) If an occupier of premises is present at the premises while an entry
and search warrant is being executed, the occupier is entitled to
observe the search being conducted.
Note The Crimes Act 1914 (Cwlth), pt 1C applies in relation to the
investigation of certain ACT offences.
(2) However, the occupier is not entitled to observe the search if to do so
would impede the search.
(3) This section does not prevent 2 or more areas of the premises being
searched at the same time.
