#### 190C Division does not apply in relation to notified foreign passport funds or their operators This Division does not apply to an act or omission by a person, if: (a) the act or omission is in the person’s capacity as a director, other officer or employee of a notified foreign passport fund; or (b) the act or omission: (i) is in the person’s capacity as a director, other officer or employee of the operator of a notified foreign passport fund; and (ii) is connected with the operation of the fund.
