What it does
The Coroners (Fees, Expenses and Allowances) Regulations 2026 prescribe fees for copies of specified coronial material and set expenses and allowances for certain witnesses. They are made under the Coroners Act 1995 (regulations’ opening provision), take effect on 22 June 2026 (reg 2), and are stated to have been notified in the Gazette on 17 June 2026.
Regulation 4 makes the fees in Part 1 of Schedule 1 payable for the listed items and says those fees are GST inclusive. The schedule charges one fee unit per page for copies of a coroner’s findings, a post-mortem report, another document relating to an investigation, and a transcript where the court has directed that a transcript be made. It sets a fee of 20 fee units for a copy of an audio recording of proceedings, two fee units per post-mortem photograph, two per scene photograph, and 20 fee units for a copy of an audio-visual exhibit. The regulations do not state the monetary value of a fee unit.
Regulation 5 sets witness expenses and allowances. Some amounts are fixed for the financial years ending 30 June 2026 and 30 June 2027, then specified expenses and allowances are indexed in later financial years using the Hobart CPI, subject to a rule against reducing the previous year’s amount. Miscellaneous allowances are set by reference to the Tasmanian State Service Award. The Chief Magistrate may set higher amounts for a professional or expert witness. Regulation 6 excludes an employee or officer who is entitled to full pay while attending as a witness under one of the listed employment arrangements from regulation 5.
The instrument does not set out the wider procedures under the Coroners Act, who may request particular records, or all circumstances in which a person may receive a witness payment. Those questions cannot be resolved from these regulations alone.
