Outdoor dining areas

(1) Must be located at least 3m from any road.

(2) Must be located within 2m of property boundary.

(3) Outdoor furniture must not result in the approved seating capacity of the premises being exceeded.

(4) Must not extend beyond the frontage of the premises to which it relates.

(5) Must not be fixed or fastened to the footpath or building.

(6) Outdoor furniture and other equipment such as umbrellas, umbrella stands, pot plants and barriers used to define the seating area must be removed at close of business each day.

(7) Must be located on sealed footpath.

Note.

Approval is also required under the Local Government Act 1993 and under the Roads Act 1993 if the road is a classified road.
