What it does
These regulations set out the statutory form and registration mechanics for "building title plans" under the Conveyancing and Law of Property Act 1884 framework. They prescribe the content and documentary requirements for a building title plan, the steps for lodging and registering such a plan with the Recorder of Titles, the Recorder’s powers to correct or amend plans prior to registration, and a specific form for a declaration by the Hobart City Council made under section 75CD(1) of the Act (regulation 9 and Schedule 1). The regulations take effect on 28 November 2022 (regulation 2).
Mechanically, the instrument requires a building title plan to: state the name of any body corporate to be formed and its address for service; delineate parking bays and describe rights of access where parking easements are created; define any other easements and covenants to be created on registration; include any other information and features required by the Recorder (regulation 4(1)(a)-(c)). Where the plan is divided into lots, the plan must define lot boundaries, show approximate area, state unit entitlement if applicable, and include a drawing illustrating lots distinguished by numbers or symbols (regulation 4(2)). A lot that is part of a building may be defined by reference to boundary structures without necessarily showing dimensions (regulation 4(3)). Every plan must be endorsed with, or accompanied by, a registered surveyor’s certificate certifying that buildings shown are within the site boundaries, or that any encroachment beyond boundaries is properly authorised according to law (regulation 4(4)). If the site adjoins a highway, the plan may show external boundaries and the piece under or over the highway (regulation 4(5)).
On process, a person lodging a building title plan must do so in accordance with the Land Titles Regulations 2022 as if the plan were a dealing under the Land Titles Act 1980 and pay the fee prescribed under that Act (regulation 5). The Recorder effects registration by recording on the first page of the plan a notification that the plan has been registered, the date of registration, and the Recorder’s signature (regulation 6). The Recorder has powers to number or renumber flats, supply omissions and correct patent errors, and to amend the plan before registration with the consent of the lodger and the town clerk of the Council (regulation 7). The Recorder must enter on each folio of the Register a notification describing that the proprietor holds the proprietor’s flat and share of common property subject to interests affecting the flat or common property as notified on the registered building title plan and any amendments (regulation 8). The regulations therefore operationalise the registration pathway and information content for building title plans under the Act.
