Construction Industry Portable Paid Long Service Leave Regulations 1986

The Regulations are built around a small set of operational concepts that determine coverage, contribution and compliance.

• Prescribed awards and classifications (Reg 2; Reg 3; Schedule 1). The Regulations do not rely on a generic definition of construction work alone. Instead they specify a closed list of awards and the classifications of work within them that are “prescribed under section 3(4)(a) and (b) of the Act” (Reg 2; Reg 3). This functions as the primary coverage gate. Importantly, the prescription applies whether or not the award is currently in force (Reg 2). Where Schedule 1 shows an exception, condition or limitation against an award, that modifies the classification prescription (Reg 3(2); Schedule 1). The schedule is split into two divisions: Division 1 lists awards under the Commonwealth Fair Work Act 2009 and awards given continuing effect under its transitional provisions; Division 2 lists awards under Western Australia’s Industrial Relations Act 1979 (Schedule 1 headings).
• Employer definition carve-outs (Reg 3A). The Regulations exclude whole classes of public sector entities from being an employer for the Act’s purposes: Ministers, authorities constituted by written law, and local governments (Reg 3A). This shapes which organisations must register, contribute and report.
• Notifiable contract threshold (Reg 5). The Regulations fix the trigger for contract notification to the portable long service board at $250 000 (Reg 5). This provides an ex ante monetary threshold for contractor-level interface under section 17 of the Act.
• Contribution rate and base (Reg 8). The rate is expressed as a percentage of “ordinary pay” for the purposes of section 34 of the Act: the Regulations fix that percentage at 0.75 per cent (Reg 8). The Regulations do not redefine “ordinary pay”; that concept remains tied to the Act’s definition and payroll practices.
• Record-keeping fields (Reg 7). The Regulations move from general record-keeping obligations to a specific catalogue of required fields for each employee record. These fields include personal identifiers, multiple contact methods, employment basis, contractor/subcontractor descriptors, leave and apprenticeship status, registration numbers under section 31A, job title and primary tasks, start and finish dates, daily absence details including whether paid, and “the day or days of service completed as an employee within the meaning of the Act” (Reg 7).
• Inter-jurisdictional coordination (Reg 5A). The Regulations name corresponding laws in six other States and the Australian Capital Territory as corresponding laws for section 29A, facilitating portability or mutual recognition across jurisdictions that have their own construction industry portable schemes (Reg 5A).
• Administrative and enforcement instruments (Reg 4 and Reg 9). The Regulations define who holds the Board’s common seal and how it is to be used (Reg 4). They also supply the inspector’s appointment certificate form and a plain statement of the inspector’s functions as contained in the certificate text (Schedule 2; Reg 9).

These concepts convert policy design choices, eligibility boundaries, reporting cadence, and financial parameters, into administrative steps that employers, payroll service providers and the Board must implement.

The Regulations primarily impose obligations on employers engaged in the construction industry who fall within the coverage of the prescribed awards and classifications, and secondarily affect employees whose records and pay form the basis of contributions. Several specific groups and consequences are important.

• Employers in the private construction supply chain. Employers whose employees fall within the classifications of the awards in Schedule 1 are brought into the scheme. The Regulations bind those employers to keep detailed employee records (Reg 7), to calculate and pay contributions at the prescribed rate for the purposes of section 34 (Reg 8), and to lodge returns in the prescribed reporting periods (Reg 6 read with s 31 of the Act). The notifiable contract threshold (Reg 5) determines when a contract triggers a notification obligation under s 17 of the Act, implicating contractors and principal contractors.
• Employers who might classify workers as contractors. Reg 7 explicitly requires employers to record whether the employer “describes the employee as a contractor or subcontractor” (Reg 7(d)). That field weaponises a compliance signal: it generates a dataset for the Board and inspectors to compare the employer’s description with other indicia of employment status. Employers that systematically mischaracterise workers may therefore face greater regulatory attention.
• Temporary employees and classifications. The Regulations define the term “temporary employee” for Schedule 1 purposes as “a person who does not hold a permanent position but whose continuity of employment depends on the availability of work” (Reg 3(3)). Schedule 1 contains several limited entries where coverage is restricted to temporary employees or to temporary employees in receipt of particular allowances. The effect is to capture a segment of casual or contingent labour commonly used in construction.
• Employees. Individual workers are affected through the data their employer must retain about them (Reg 7), through the contribution of 0.75 per cent of ordinary pay that is payable in respect of their employment for long service leave funding (Reg 8), and through the portability arrangements tied to corresponding laws (Reg 5A). The Regulations require employers to keep personal data including date of birth, gender and multiple contact details (Reg 7(a)-(b)), which is material to tracing and entitlement calculations.
• Public sector entities. The Regulations carve out a class of public sector entities from being “employer” for the purposes of the Act: Ministers, authorities constituted by written law, and local governments are expressly “not an employer” under Reg 3A. Those entities therefore do not have the employer-side obligations created by the Act and Regulations, unless other parts of the Act or separate instruments impose obligations (Reg 3A).
• Boards, inspectors and administrative officers. The Board’s CEO is identified as the custodian of the common seal (Reg 4(1)(a)). Inspectors appointed under section 44 receive a statutory certificate in the form set out in Schedule 2 (Reg 9), and the certificate itself states the inspector’s investigative functions (Schedule 2).
• Inter-jurisdictional schemes. Employers and employees who operate across borders will be affected by the list of “prescribed corresponding laws” in Reg 5A. Where work spans jurisdictions, the corresponding laws named may be relevant to reciprocal recognition of service and payments.

Who ultimately pays is not the Regulations’ rhetorical question. The Regulations make employers the administrative actors required to record data, notify contracts above the threshold, and calculate and remit contributions based on ordinary pay. The cost is therefore borne by employers in covered awards and classifications, unless contractual arrangements or market pricing pass that cost on to purchasers of construction services.

The Regulations create a set of discrete duties and frame limited administrative rights tied to Board governance and inspection.

Duties

• Maintain employee records with specified fields. Regulation 7 obliges employers to keep for each employee a record containing the specific items listed, including full name, date of birth, gender, extensive contact details, employment basis (permanent, fixed term, casual or other; full-time or part-time), whether the employer describes the person as a contractor or subcontractor, entitlement to paid annual leave, apprenticeship or trainee status, registration number under s 31A(1)(b) of the Act, job title and primary tasks, start and finish dates, detailed absence records including payment status, and the day or days of service completed as an employee within the meaning of the Act (Reg 7(a)-(k)).
• Calculate and pay the prescribed contribution. Regulation 8 prescribes that the amount payable in respect of an employee for the purposes of s 34 of the Act is 0.75 per cent of the employee’s ordinary pay. Employers must therefore apply the contribution rate to the payroll base defined by the Act (Reg 8).
• Make notifications for notifiable contracts. Regulation 5 prescribes the monetary threshold ($250 000) relevant to section 17. Employers or principals who enter contracts at or above that threshold must comply with the Act’s notification requirements (Reg 5 read with s 17).
• Lodge periodic returns. Regulation 6 prescribes the reporting period for section 31 as the three months ending on the last day of March, June, September and December. Employers must therefore align returns and remittances to these quarters (Reg 6).
• Observe limitations and exceptions shown in Schedule 1. Where Schedule 1 records exceptions, conditions or limitations opposite an award, an employer’s obligations are modified accordingly (Reg 3(2); Schedule 1). Several awards in Schedule 1 are limited to temporary employees, or to particular classifications.
• Custody and use of Board seal. The Board must keep the common seal in the custody of the chief executive officer and only affix it to a document on authority of a resolution of the Board and in the presence of not less than two members, who must sign to attest the affixing (Reg 4).

Rights and administrative features

• Corresponding laws for portability. Regulation 5A lists corresponding laws in other jurisdictions (Reg 5A). That enables the operation of section 29A of the Act, which relates to recognition of service or payments across jurisdictions. The right here is procedural; it governs how the Board and scheme treat interstate service.
• Inspector appointment and powers. The Regulations provide the form of appointment certificate for inspectors (Reg 9; Schedule 2). The certificate includes a description of the inspector’s functions: to carry out investigations to ensure proper records are kept, accurate returns are lodged and correct contributions are paid by employers (Schedule 2). That sets out the scope of inspection in practical terms, although the Act contains the statutory appointment and powers.
• Board procedural control over the common seal. Regulation 4 creates an internal Board governance right: the Board decides when the seal is used, subject to the attestation signature by two members (Reg 4).

Unstated but consequential duties

• Where Schedule 1 prescribes an award “whether or not in force” (Reg 2), employers must check both current and legacy award classifications to determine coverage. This imposes an information-gathering duty in practice.
• The requirement to record whether an employee is “described” as a contractor or subcontractor (Reg 7(d)) creates a compliance trail that may be used by inspectors to test characterisation decisions.

The Regulations convert administrative obligations under the Act into specific paperwork, financial calculation and governance steps for employers, the Board and inspectors.

The Regulations themselves supply limited enforcement mechanics and no standalone penalty schedule. They instead facilitate enforcement authorised by the Act by specifying the tools and thresholds that enable inspection and action.

Inspection and investigative tools

• Inspector certificate form (Reg 9; Schedule 2). The Regulations prescribe the form of the certificate that identifies an inspector appointed under section 44 of the Act. The certificate text explains the inspector’s role: to carry out investigations to ensure proper records are kept, accurate returns are lodged and correct contributions are paid by employers (Schedule 2). The certificate thus functions as the formal instrument that an inspector will present when exercising statutory powers under the Act.
• Records as evidence. Regulation 7 prescribes the detailed fields employers must keep. Those prescribed records create an evidentiary basis for inspectors to assess compliance with returns, contribution payments and other duties. The specified granularity (for example, daily absence records with reasons and whether paid) increases the Board’s and an inspector’s ability to verify entitlements and contributions.

Thresholds and triggers

• Notifiable contracts (Reg 5). The $250 000 threshold for notifiable contracts provides a clear trigger point for the Board and inspectors to focus oversight on larger contracts where portability obligations and contractor chains are more likely to arise. The threshold enables the Act’s notification regime under section 17 to be applied with a numeric rule.
• Quarterly returns (Reg 6). Regular reporting periods increase the frequency of potential detection. The quarterly cadence (last day of March, June, September and December) creates recurring compliance events that assist the Board in spotting non-lodgement and mismatches.

Penalties and enforcement actions under the Act

• The Regulations do not themselves create criminal or civil penalties or specify monetary fines. Those sanctioning powers are contained in the Act, which the Regulations reference (for example, they set the rate for s 34 payments and the periods for s 31 returns). Enforcement in practice will therefore rely on the Act’s penalty provisions and any administrative remedies the Board is empowered to use. The Regulations facilitate enforcement but do not set penalty quantum.
• The Regulations’ repeated prescription that awards are “whether or not in force” (Reg 2) and the requirement to capture whether a worker is described as a contractor (Reg 7(d)) make it easier for inspectors to identify misclassification and non-payment, which are common triggers for enforcement under portable schemes. The statutory certificate, together with a Board-held set of prescribed records, underpins any compliance investigation that could lead to enforcement under the Act.

Practical enforcement consequences

• The Regulations increase the predictability of detection. The prescribed records give inspectors concrete items to inspect, and the quarterly return schedule provides a regular audit point.
• The presence of a prescribed notifiable contract threshold means the Board and inspectors can focus resources on projects above $250 000 where multiple parties and subcontracting chains often create compliance risk.

In short, enforcement depends on the Act’s statutory powers; the Regulations provide the operational levers, data, thresholds and inspector identification, that enable the Board and inspectors to detect, investigate and refer non-compliance to the Act’s sanctioning mechanisms.

The Regulations explicitly tie the portable scheme to other industrial instruments and to interstate portable long service leave laws, and they implicitly intersect with employment classification, payroll and privacy regimes.

Interplay with industrial awards

• Prescription of awards under Commonwealth and State systems. Schedule 1 explicitly includes two divisions. Division 1 lists awards under the Fair Work Act 2009 and awards given continuing effect under the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (Commonwealth). Division 2 lists awards under the Industrial Relations Act 1979 (Schedule 1 headings). By prescribing awards “whether or not in force” (Reg 2), the Regulations create a regulatory bridge between the portable scheme and both federal and state industrial instruments. Employers must therefore consider both Commonwealth and State awards in assessing coverage.
• Exceptions and limitations. Where Schedule 1 lists exceptions, conditions or limitations opposite an award, those modify the classification prescription (Reg 3(2); Schedule 1). This requires employers to read the Schedule carefully in the context of the substantive industrial instrument.

Inter-jurisdictional recognition and portability

• Prescribed corresponding laws. Regulation 5A designates seven statutes in other jurisdictions as corresponding laws for the purposes of section 29A of the Act. The list includes New South Wales, Queensland, Victoria, Tasmania, the Northern Territory, South Australia and the Australian Capital Territory (Reg 5A). This explicitly embeds a mechanism for mutual recognition or treatment of service across jurisdictions, which interacts with those jurisdictions’ portable schemes. Employers and employees operating across state borders must be aware of these cross-references because entitlements and offsets may be affected by service credited under another jurisdiction’s corresponding law.

Interplay with employment classification and contractor rules

• Record of “description” as contractor. Regulation 7 requires employers to record whether the employer describes the employee as a contractor or subcontractor (Reg 7(d)). That record will interact with broader legal tests of employment status under workplace law, tax law and superannuation law. The Regulations do not settle substantive classification tests; instead they produce a documentary trail that other regulators or courts may use in an assessment.

Payroll and tax interaction

• Ordinary pay base. Regulation 8 prescribes the contribution as a percentage of “ordinary pay” for the purposes of s 34 of the Act. The Regulations do not redefine “ordinary pay”; therefore the measurement will typically follow the Act’s definition and may echo payroll definitions used for award, superannuation or tax purposes. Employers must align payroll systems so that the long service leave contribution base is correctly identified and not double counted or omitted.

Privacy and record-keeping laws

• Personal data fields. Regulation 7 requires retention of personal identifiers and contact information including date of birth, gender, multiple addresses and phone numbers, and email (Reg 7(a)-(b)). Maintenance of that dataset engages state and federal privacy regimes. Employers must therefore ensure that the way records are kept and shared with the Board complies with privacy obligations.

Administrative and corporate law interaction

• Common seal custody. Regulation 4 prescribes corporate-style governance for the Board’s common seal, requiring custody, Board resolution, and signatures of two members (Reg 4). This is an internal corporate governance requirement that aligns with companies’, statutory authorities’ and board governance practices.
• Inspector appointment. Regulation 9 supplies the form of the inspector certificate. Inspectors will exercise powers under the Act but the form ties into administrative law principles relating to delegation, identification and procedural fairness.

Absence of express interaction clauses

• The Regulations do not specify how conflicts between this scheme and other entitlements (for example, overlapping long service leave entitlements under different Acts or awards) are to be resolved. They do, however, provide tools (prescribed corresponding laws; prescribed awards) that will be used in operational decisions about offsets and recognition.

Overall, the Regulations sit at the intersection of industrial relations law, payroll administration and inter-jurisdictional portable leave schemes, and they produce operational data that other regulators and tribunals may use when resolving disputes or enforcement actions.

The Regulations have been repeatedly amended since enactment in 1986. The compilation table lists all amendments and commencement dates. Key features of the amendment history as reflected in the source are:

• Frequent updates to the contribution rate (Reg 8). The notes appended to Reg 8 record a long series of amendments spanning from 1988 through the 1990s and into the 2000s, 2010s and 2020s. The latest amendment recorded in the Regulations is SL 2024/219 r. 4, which is listed inside the Reg 8 amendment history. The compilation table shows that SL 2024/219 had parts commencing on 30 October 2024 and regulations other than r 1 and 2 commencing on 1 January 2025. This demonstrates that the contribution rate has been subject to periodic review and adjustment by regulation.
• Addition of inter-jurisdictional recognition (Reg 5A). Regulation 5A was inserted by Gazette 30 Dec 2011 (as noted in the body: Reg 5A inserted: Gazette 30 Dec 2011 p. 5574-5). That insertion listed the long service leave Acts of other jurisdictions as corresponding laws, reflecting an integration of WA’s scheme with national portable schemes.
• Narrowing or clarifying employer coverage (Reg 3A). Regulation 3A, excluding Ministers, authorities and local governments from the definition of employer for the Act’s purposes, was inserted by SL 2023/187 r. 4. The compilation table indicates its publication and commencement in 2023 (SL 2023/187 29 Nov 2023; regs other than r 1 and 2 on 30 Nov 2023; r 7 commencement 1 Jan 2024). The insertion of Reg 3A is a structural change that alters which entities bear scheme obligations.
• Expanded record-keeping and data requirements (Reg 7). Regulation 7 was inserted by SL 2023/187 r.6, with commencement 1 Jan 2024 (Reg 7 inserted: SL 2023/187 r. 6). This created a detailed list of fields employers must maintain for each employee, representing a substantial compliance addition.
• Updates to prescribed awards and classifications (Reg 2; Reg 3; Schedule 1). The compilations show repeated updates to Schedule 1, including a reformatting and revision with the SL 2021/191 consolidation and additions or adjustments in 2023 and 2024. Schedule 1 now divides awards into Commonwealth and State categories and lists specific awards with exceptions and limitations.
• Notifiable contract threshold adjustments (Reg 5). Reg 5 was amended by SL 2023/187 r. 5. The regulator periodically adjusts monetary thresholds to reflect inflation or policy changes; the compilation table shows multiple amendments over time, although the current prescribed amount is $250 000 (Reg 5).
• Repeated technical and timing amendments. The compilation table records numerous amendments (1987, 1988, 1989, 1990, 1991, 1992, 1993, 1997, 1998, 1999, 2002, 2004, 2005, 2006, 2008, 2011, 2012, 2013, 2014, 2015, 2017, 2018, 2019, 2020, 2021, 2023, 2024). Many amendments were reprints consolidating prior changes, with explicit commencement dates for parts of each statutory instrument.

Implications of the amendment pattern

• The Regulations have been used periodically to adjust monetary parameters such as the contribution rate and the contract notification threshold. The history shows they are the regular vehicle for implementing incremental policy adjustments without primary legislation change.
• The recent additions in 2023 (Reg 3A and Reg 7) signal a contemporary focus on clarifying employer scope and enhancing record-keeping requirements. The insertion of Reg 7 imposes a material administrative burden not present before that date.
• The inclusion of corresponding laws from 2011 formalised interstate co-ordination in a way that aligns with the national proliferation of portable schemes.

Readers should consult the compilation table for exact commencement dates of particular amendments. The Regulations’ amendment history shows a mix of technical, fiscal and substantive changes over nearly four decades.

The Regulations themselves do not record or include any cases or litigation excerpts. The compilation and the text supplied do not cite judicial decisions, and Schedule 1 and the other regulations contain no references to case law. Therefore, there is no litigation history presented in this instrument.

Where disputes are most likely to arise, and therefore where litigation might develop, can be identified from the Regulations’ mechanics:

• Coverage disputes over prescribed awards and classifications. Because the Regulations prescribe specific awards and include exceptions and limitations in Schedule 1, litigation could arise to resolve whether a particular worker’s duties fit within a prescribed classification. The Regulations’ direction that awards are prescribed “whether or not in force” (Reg 2) may generate factual disputes about the contemporary application of legacy award language.
• Employer status disputes under Reg 3A and the Act. The Regulations exclude Ministers, certain authorities and local governments from the definition of employer for the Act’s purposes (Reg 3A). Litigation could therefore focus on characterising a body as an “authority constituted for a public purpose by a written law” or as something outside that definition, where the entity contends it is not covered. Similar contested issues may arise with entities structurally part private and part public.
• Worker classification and contractor/subcontractor treatment. Reg 7 requires employers to record whether they “describe” a person as a contractor or subcontractor (Reg 7(d)). Disputes may arise when the documentary description diverges from a tribunal or court’s analysis of the employment relationship, especially where inspectors rely on those records.
• Contribution base and ordinary pay. Reg 8 prescribes the percentage rate but ties the contribution to the Act’s “ordinary pay” concept. Litigation could therefore centre on whether certain payments form part of ordinary pay for contribution purposes, how overtime or allowances are treated, or whether particular benefits are excluded.
• Notifiable contract threshold and aggregation. Reg 5 prescribes a $250 000 threshold for notifiable contracts. Disputes could hinge on whether values are aggregated, whether a contract with variations meets the threshold, or whether subcontracting chains effect notification obligations.

None of the above is recited as precedent in the Regulations. Practitioners should search case law databases and tribunal decisions for disputes under the Construction Industry Portable Paid Long Service Leave Act 1985 for authoritative rulings. The absence of litigation history in the Regulations does not indicate absence of litigation under the Act; it simply reflects that the Regulations document, as provided, does not include judicial material.

Practitioners and compliance officers must watch for several concrete traps the Regulations create.

• “Whether or not in force” prescription. Regulation 2 prescribes the awards listed in Schedule 1 “whether or not in force”. Employers cannot assume that only current, operative awards matter. Legacy awards and classifications in Schedule 1 may impose obligations. Check Schedule 1 text and any exceptions carefully (Reg 2; Reg 3(2); Schedule 1). The effect is that a prescribed award may be out of contemporary industrial circulation yet still create scheme obligations.
• Exceptions and limitations in Schedule 1. Several Schedule 1 entries limit coverage to temporary employees or to specific classifications (for example, AWU Construction, Maintenance and Services (W.A. Government) Award 1984 limited to temporary employees in receipt of an industry allowance under the award). Failure to read the exceptions will produce over- or under-compliance risks (Reg 3(2); Schedule 1).
• Public sector exclusion is narrow but impactful. Regulation 3A removes Ministers, authorities and local governments from the Act’s employer definition. That exclusion may look straightforward but can be litigiously nuanced where entities have mixed functions, commercial undertakings or are bodies corporate with both public and private features. Do not assume all government-connected entities are outside the scheme (Reg 3A).
• Recording the employer’s description of status. Regulation 7 requires employers to record whether the employee is “described” as a contractor or subcontractor (Reg 7(d)). That description is not determinative of legal status, but it becomes evidence. Employers who freely label workers as contractors in their records may face harder enforcement scrutiny; conversely, employers who artificially label workers as employees for administrative convenience will have that description recorded too. The practical gotcha is that the record itself may be used to challenge the employer’s own classification decisions.
• Detailed absence records. The record fields in Reg 7(j) require that for any day an employee is absent the employer record the date, the reason and whether the employee was paid for the day. Payroll systems that aggregate absences or record only pay status at a weekly level may not meet the daily granularity requirement without configuration changes (Reg 7(j)).
• Broad personal data requirements and privacy obligations. Reg 7 requires multiple personal identifiers and contact fields including gender, date of birth, residential address, postal address, mobile phone, other phone and email. Employers must ensure legal basis, storage security and lawful disclosure practices under privacy laws before furnishing records to the Board or inspectors (Reg 7(a)-(b)).
• Ordinary pay definition and payroll complexity. Reg 8 fixes the percentage rate but ties it to “ordinary pay”. Differences between award definitions, payroll practices and other statutory definitions (superannuation base, taxable income) require careful payroll mapping to avoid underpayment or double charging. The Regulations do not define ordinary pay; the Act and awards do.
• Contract notification aggregation risk. The Regulations set the notifiable contract amount at $250 000 (Reg 5), but they do not state in the Regulation whether multiple linked contracts are aggregated for the threshold under s 17. Employers should test whether project phasing, variations or related contracts could require notification to avoid inadvertent non-compliance.
• Timing of recent amendments. The compilation table shows recent amendments with staggered commencement dates. For example, SL 2024/219 amends Reg 8 with parts commencing 1 January 2025. Compliance programmes must track commencement dates rather than relying on promulgation dates alone.
• Scope creep through Schedule 1 composition. Schedule 1 lists a wide range of awards including some that reach beyond obvious on-site building work, for example the Telecommunications Services Award and the Mining Industry Award. Employers in sectors adjacent to traditional building work should not assume they are outside coverage without reviewing Schedule 1.
• Formality of the inspector’s certificate. Inspectors must produce the appointment certificate in the form in Schedule 2 (Reg 9). Practitioners should verify the identity and appointment status of inspecting officers and obtain copies of the certificate for administrative records.

These are not hypothetical policy criticisms. They are direct operational consequences of the Regulations’ wording (Reg 2; Reg 3; Reg 3A; Reg 5; Reg 7; Reg 8; Reg 9; Schedule 1).

Practical compliance requires administrative systems, payroll mapping and governance steps keyed to the Regulations’ prescriptions.

1. Determine coverage by mapping employees to Schedule 1.

   • Cross-check each employee’s duties and classification against the awards and classification structures in Schedule 1 (Reg 2; Reg 3). Pay special attention to exceptions, conditions and limitations shown opposite entries in Schedule 1 (Reg 3(2); Schedule 1).
   • For employees whose classification is uncertain, procure an industrial instrument interpretation from a relevant industrial relations adviser or counsel before deciding on contributions and reporting.

2. Implement payroll mapping for the contribution base.

   • Identify the payroll items that constitute “ordinary pay” under the Act and configure payroll systems to calculate 0.75 per cent of ordinary pay per employee as the contribution (Reg 8). Where payroll systems or enterprise resource planning systems treat allowances and overtime differently, document the methodology and retain audit trails for each pay run.
   • Monitor amendment dates in the compilation table to ensure the applicable percentage and commencement dates are applied correctly (Reg 8 amendment notes and compilation table).

3. Build the record-keeping dataset required by Reg 7.

   • For each worker, ensure an electronic record contains the items listed in Reg 7(a)-(k): full name, date of birth, gender, residential/postal addresses, mobile and other phone, email, employment basis (permanent/fixed term/casual/other and full-time/part-time), whether the employer describes the worker as a contractor or subcontractor, entitlement to paid annual leave, apprentice/trainee status, certificate of registration number under s 31A(1)(b), job title/primary tasks, employment start and finish dates, and daily absence records including reason and whether paid, and days of service within the meaning of the Act (Reg 7).
   • Ensure data security and privacy compliance. Implement retention policies aligned with privacy legislation and the Board’s requirements.

4. Configure reporting and remittance workflows to the quarterly rhythm.

   • Align return lodgement and payment cycles to the prescribed quarterly periods: the three months ending on the last day of March, June, September and December (Reg 6). Create calendar reminders and controls to avoid late lodgement.
   • Validate returns internally before lodgement to reconcile payroll totals, days of service and contribution calculations.

5. Track contract values and notify where required.

   • Implement a contract register to identify any contract with a value equal to or exceeding $250 000, triggering the notification obligations under section 17 as prescribed in Reg 5. Include variations, change orders and closely related contracts in the assessment where commercially reasonable.
   • Assign responsibility for notifications to a project manager or legal/compliance officer to ensure timely submission.

6. Prepare for inspections and record requests.

   • Ensure that the Board’s inspectors, when presenting themselves, have the appointment certificate in the form in Schedule 2 (Reg 9; Schedule 2). Maintain an internal process for verifying the identity and appointment of inspectors and for providing a controlled disclosure of records.
   • Keep the Board correspondence and inspector interactions logged.

7. Board governance and corporate formality.

   • For those organisations that are Boards or statutory bodies, ensure the common seal is kept in custody of the chief executive officer, and that affixation of the seal follows the process in Reg 4: authority by Board resolution and presence of not less than two members who sign to attest (Reg 4).
   • Retain copies of resolutions authorising seal use.

8. Manage classification and contractor description risk.

   • Because Reg 7 requires recording whether the employer “describes” the person as a contractor, ensure HR records reflect an accurate account of the employer’s own description and that any classification decisions are supported by written job descriptions, contracts and third-party advice. Keep contemporaneous documentation of the contractual arrangements and supervision levels that inform classification.
   • When engaging labour through labour hire or subcontracting, maintain clear contracts and ensure those agreements specify who is responsible for contribution reporting and payment where obligations arise.

9. Cross-jurisdictional work and corresponding laws.

   • If employees perform work across state lines, consult Reg 5A to determine whether a corresponding law applies and how service recognition or offsets operate (Reg 5A). Maintain records of interstate service to support portability claims or offsets.

10. Audit and compliance testing.

• Run regular internal audits comparing payroll records, employee records required by Reg 7, contribution calculations and returns lodged. Reconcile absent days, paid status and contribution bases per employee. Document remedial steps and retained evidence of correction if errors are found.
• Document procedures and train payroll, HR, and site managers on the Reg 7 fields and the obligation to preserve accurate daily absence and service records.

11. Seek advice on edge cases.

• Where there is uncertainty about coverage because of legacy awards, mixed public-private entity status, or aggregation of contract values, obtain legal advice. The Regulations create precise administrative obligations but do not themselves settle complex legal questions about employment status or aggregation for threshold purposes.

Applying these steps will address the principal compliance obligations imposed by the Regulations: accurate, granular records; correct calculation and remittance of the prescribed contribution; timely quarterly reporting; notification for notifiable contracts; and readiness for inspection. Implementing these steps requires coordination between HR, payroll, legal and project teams and, for many businesses, reconfiguration of payroll and record-keeping systems to meet Reg 7’s granular data requirements.
