While the list of prescribed awards has expanded over time (particularly with the 2021 restructuring to accommodate the Fair Work Act), and contribution rates have been adjusted periodically, the fundamental scope—setting administrative details for the 1985 Act—has not drifted. The 2023 addition excluding government employers and the 2024 update to contribution rates represent refinements within the existing framework rather than scope creep."},"complexity_factors":["Two separate schedules listing 49 different industrial awards across federal and state jurisdictions, many with specific exceptions or limitations","Frequent amendments (38 separate amendment instruments since 1986) requiring careful tracking of commencement dates","Cross-references to multiple external laws including the Fair Work Act 2009 (Cth), Industrial Relations Act 1979 (WA), and 7 different interstate statutes","Conditional logic in Schedule 1 where coverage depends on specific employee classifications (e.g., 'temporary employees', receipt of 'industry allowance')","Detailed record-keeping requirements in Regulation 7 specifying 11 categories of mandatory employee information","Percentage-based contribution formula (0.75%) requiring ongoing calculation against variable 'ordinary pay'"],"plain_english_summary":"**What this legislation does:**\n\nThese regulations support Western Australia's Construction Industry Portable Paid Long Service Leave Act 1985. They fill in the practical details that the main Act leaves blank—essentially the \"how-to\" rules for making the portable long service leave scheme work.\n\n**Key things the regulations cover:**\n\n* **Who is covered:** They list exactly which industrial awards (employment contracts) and job types fall under the scheme. This includes workers under both federal awards (like the Building and Construction General On-site Award) and state awards (like the Building Trades Award). Some awards only cover specific workers—for example, temporary employees or those receiving certain allowances.\n\n* **Who is NOT covered:** Ministers, government authorities, and local councils are explicitly excluded from being \"employers\" under this scheme.\n\n* **How much employers pay:** Employers must contribute **0.75%** of each worker's ordinary pay into the long service leave fund.\n\n* **Record-keeping:** Employers must keep detailed records for each worker—including name, contact details, employment basis (permanent/casual), job title, start/finish dates, and days of service.\n\n* **Big contracts:** Construction contracts worth **$250,000 or more** must be notified to the scheme.\n\n* **Interstate portability:** The regulations recognise equivalent long service leave laws in all other Australian states and territories, allowing workers to transfer their entitlements when moving between states.\n\n* **Administration:** They set rules for the Board's common seal (official stamp), inspector appointments, and quarterly reporting periods (March, June, September, December).\n\n**Who it affects:**\nConstruction workers in WA covered by the listed awards, their employers, and the Board that administers the fund.\n\n**Why it matters:**\nConstruction workers often change employers frequently. Without portability, they'd lose long service leave entitlements every time they switched jobs. These regulations ensure workers can accumulate leave across multiple employers and claim it after 10 years of service in the industry, regardless of who they worked for."},"flash_summary":{"complexity_score":3,"scope_assessment":{"changed":true,"description":"Yes. The regulations have been amended over time to adjust operational scope rather than to create a new scheme: they now explicitly prescribe Fair Work-era and legacy awards (Schedule 1, reg 2), exclude Ministers, public authorities and local governments from the definition of \"employer\" (reg 3A, inserted 2023), fix the notifiable contract threshold at $250,000 (reg 5, amended 2023), add detailed employee record requirements (reg 7, 2023), and list corresponding interstate long‑service laws (reg 5A, 2011).
