What it does
The Community Housing Providers National Law (Tasmania) Act 2013 is a machinery statute that adopts the Community Housing Providers National Law , originally enacted as the appendix to the New South Wales Community Housing Providers (Adoption of National Law) Act 2012 , as a law of Tasmania. Section 5 provides that the National Law, as in force from time to time, applies as a law of this jurisdiction and may be referred to as the Community Housing Providers National Law (Tasmania). This is not a stand-alone regulatory code; it is a local adoption mechanism. The substantive rules governing registration, ongoing regulation, and conduct of community housing providers are located in the National Law text itself, which is not reproduced in the Act but exists by reference. The object stated in section 3 is to apply a national law for registration and regulation under a national system. That object is achieved through the adoption clause, supplemented by a small number of local modifications and appointments.
The Act also prescribes which bodies exercise functions under the National Law in Tasmania. It declares Homes Tasmania (established under the Homes Tasmania Act 2022) as a Housing Agency for specified purposes: the definition of community housing asset, the conditions of registration at section 10(1)(h) and section 20(4), and the transfer approval condition at section 15(2)(c). The Registrar is an individual appointed by the Minister from the State Service (s10). The Tasmanian Civil and Administrative Tribunal (TASCAT) is designated as the Appeal Tribunal (s6(1), as amended). The relevant appeal period is 21 days (s6(2)). The Minister administering the Homes Act 1935 is the relevant Minister (s9). The Act also sets the fee framework: regulations prescribe the fee for the purposes of section 13(4) of the National Law (s13). Proceedings for offences under the National Law are dealt with summarily (s14).
