COMMERCIAL PASSENGER (ROAD) TRANSPORT (LIMOUSINES) REGULATIONS 2003

The Regulations rest on a limited set of legal building blocks, each used to allocate obligations, discretion and enforcement rights.

Definitions and scope

• driver is defined narrowly as the person driving or in charge of a limousine (regulation 3).
• operator is defined as a person who operates a limousine otherwise than only as a driver (regulation 3). That creates a legal distinction between a sole driver who does not operate commercially beyond driving and a person who operates the service in an organisational or business capacity.
• public place is defined to include any place to which the public are admitted on payment of a fee or charge (regulation 3). That phrasing broadens the usual notion of public place to cover feeed-event venues and other paid-entry spaces.

Record-keeping and information

• Operators must make a written record of specific matters: dates and times when the limousine is used to carry passengers; the full name and residential address of the driver and the number of the driver's motor-vehicles licence during those periods; every booking and hiring; and any other matter the Director requires as a condition of the operator's licence (regulation 4(1)(a)-(d)). The Regulations impose two layers of obligation: a prescriptive list plus an open-ended residual item that gives the Director power to add record requirements as a licence condition.
• Those records must be kept at the operator’s principal place of business and produced to an inspector on demand (regulation 4(2)).

Booking, plying and solicitation

• The Regulations separate pre-booked hiring from street-hire: a limousine must not be used for standing or plying for hire (regulation 8), and a person must not use a limousine for a hiring unless the journey is pre-booked with the operator (regulation 9(1)). The operator, however, is not compelled to accept a hiring (regulation 9(2)).
• Touting or soliciting passengers for a limousine is separately prohibited (regulation 10).

Parking and authorised standing

• Drivers may park or stand only for expressly permitted purposes: picking up or setting down passengers, waiting under a passenger’s instructions, or by direction or with the consent of an inspector, provided the parking or standing is otherwise lawful (regulation 12(1)). There is a carve-out for a lot approved as a lot for the limousine (regulation 12(2)).

Alcohol, identity card and fees

• The Regulations prohibit operators or drivers accepting hirings that require the driver to purchase intoxicating liquor for another person; drivers likewise must not purchase intoxicating liquor for or on behalf of passengers during a hiring (regulation 14(1)-(2)).
• For the identity-card regime, the Regulations prescribe a limousine as a class of commercial passenger vehicle for section 74 of the Act (regulation 15(1)) and set mandatory content for the identity card: name, recent photograph, expiry date and an indication of authorisation to drive a limousine (regulation 15(2)). Drivers must carry the identity card or an approved alternative and produce it to a passenger or inspector on request (regulation 15(3)).
• The Schedule (referred to by regulation 16) sets an annual fee for a limousine licence ($300) and a fee for an application for a refund on surrender of a limousine licence ($20).

Administrative actors and discretion

• The Director has express powers to require information from operators (regulation 5) and to approve alternative forms of identification under the parent Act (regulation 15(3)(a) referencing section 74(10)). Inspectors are given practical powers to demand production of records (regulation 4(2)(b)) and to direct or consent to parking or standing (regulation 12(1)(c)). The regulation text therefore structures administrative discretion around license conditions, information requests and approvals.

Penalties as behavioural incentives

• The Regulations link specific breaches to statutory maximum penalties expressed in penalty units. For example, record-keeping and furnishing information carry a higher maximum penalty (60 penalty units, regs 4(1)-(2), 5) than most operational offences such as plying, pre-booking breaches, touting, parking contraventions and liquor purchases (generally 25 penalty units, regs 8-14). Not carrying or producing an identity card attracts a maximum of 30 penalty units (regulation 15(3)).

The main concepts therefore are: a licensing and data/reporting framework targeted at operators; an operational ruleset that channels limousine business towards pre-booked work and away from street-hire and active solicitation; identification and alcohol-related behavioural limits for drivers; and administrative levers for the Director and inspectors to request information, approve alternatives and impose licence conditions.

The Regulations directly affect several clearly identified actors; their duties and rights attach chiefly to operators and drivers, but the text also creates roles for the Director, inspectors and passengers.

Operators

• Defined as a person who operates a limousine otherwise than only as a driver (regulation 3), operators bear the principal administrative and financial obligations. They must create and maintain written records about dates and times of operation, driver identity and licence numbers, every booking and hiring, and any additional matters required by the Director as licence conditions (regulation 4(1)(a)-(d)). Operators must keep those records at their principal place of business and produce them when an inspector asks (regulation 4(2)). Operators must also respond to requests from the Director, furnishing full and correct information about journeys within the time specified by the Director (regulation 5). Financially, operators (or licence-holders) are the payors of the fees stated in the Schedule, notably the annual limousine licence fee of $300 and the $20 refund application fee on surrender (regulation 16 and Schedule).

Drivers

• A driver is the person driving or in charge of a limousine (regulation 3). Drivers are obliged to carry and produce an identity card or an alternative approved form of identification when driving the limousine, and to produce it to a passenger or inspector on request (regulation 15(3)). Drivers must not use a limousine for plying for hire (regulation 8), must not engage in touting or soliciting passengers (regulation 10), and must not park or stand a limousine except for the permitted purposes set out in regulation 12(1) or in an approved lot (regulation 12(2)). Drivers and operators are both prohibited from accepting hirings that require the driver to purchase intoxicating liquor for another person (regulation 14(1)) and a driver specifically must not purchase liquor for a passenger during a hiring (regulation 14(2)).

Passengers

• Passengers have a limited, specified role. They may request production of the driver’s identity card or approved identification (regulation 15(3)(b)). Passengers may instruct drivers to wait, in which case waiting is authorised under regulation 12(1)(b), provided parking is otherwise lawful.

Director

• The Director (not defined in the Regulations but referred to repeatedly) has the administrative power to require operators to furnish details about journeys within a specified time (regulation 5). The Director has the power to impose licence conditions that can require additional record-keeping (regulation 4(1)(d)) and to approve alternative forms of identification under the parent Act (regulation 15(3)(a) references section 74(10) of the Act). Through those powers, the Director shapes what data operators must capture, how identification is validated and the timing for information provision.

Inspectors

• Inspectors can request documents and require production of records (regulation 4(2)(b)), and they can direct or consent to the parking or standing of a limousine (regulation 12(1)(c)). Inspectors may also request identity cards (regulation 15(3)(b)).

Third parties and places

• The Regulations’ definition of public place includes venues with paid admission (regulation 3), so operators and drivers operating around feeed attractions, venues or events should consider the Regulations’ parking and plying prohibitions in that context.

Who pays and who decides

• Operators are the primary payors of fees and the bearers of the record-keeping burden (regulation 4 and Schedule). The Director and inspectors are the primary decision-makers for information requests, approvals for alternative IDs and parking consents (regulations 5, 15, 12). Drivers are decision-makers in-the-moment but are constrained by the Regulations’ operational prohibitions (regs 8-14).

The Regulations do not expressly address insurers, local councils, police powers, or any court processes in the text, so any interaction with those actors is indirect or lies in other instruments. The Regulations’ language places concentrated administrative cost and decision-making risk on operators and operational compliance burdens on drivers, while equipping the Director and inspectors with the tools to demand information and grant approvals.

This section lists obligations and embedded rights as they appear in the Regulations, with the express statutory reference for each requirement.

Operator duties

• Maintain written records. An operator must make a written record of: (a) dates and times during which the limousine is operated for carriage of passengers; (b) the full name and residential address of the driver during those periods and the number of the driver's licence issued under the Motor Vehicles Act 1949; (c) every booking and hiring; and (d) any other matter the Director requires as a condition of the operator’s licence (regulation 4(1)(a)-(d)). Maximum penalty: 60 penalty units.
• Keep records at principal place of business. An operator must ensure those records are kept in a safe place at the principal place of business (regulation 4(2)(a)). Maximum penalty: 60 penalty units.
• Produce records to inspectors. An operator must produce the record whenever required by an inspector (regulation 4(2)(b)). Maximum penalty: 60 penalty units.
• Furnish information on request. An operator must, whenever requested by the Director, furnish full and correct information of any details specified in the Director’s request relating to journeys undertaken by the limousine, within the time specified by the Director (regulation 5). Maximum penalty: 60 penalty units.
• Pay fees. A fee specified in the Schedule is payable for the matters opposite the fee, including an annual limousine licence fee of $300 and a $20 fee for an application for a refund on surrender of a limousine licence (regulation 16 and Schedule).

Driver duties

• Do not ply for hire. A person must not use a limousine for the purpose of standing or plying for hire (regulation 8). Maximum penalty: 25 penalty units.
• Pre-booked hirings only. No person may use a limousine for a hiring unless the journey is pre-booked with the operator (regulation 9(1)). Maximum penalty: 25 penalty units. Note that the operator is not compelled to accept a hiring (regulation 9(2)).
• No touting or soliciting. A person must not tout or solicit passengers for a limousine (regulation 10). Maximum penalty: 25 penalty units.
• Parking and standing limits. A driver must not park or stand a limousine on a road or public place or on a lot off a road or public place unless parking or standing is for picking up or setting down passengers, waiting under a passenger’s instructions, or by direction or consent of an inspector, and only if the parking or standing is otherwise lawful (regulation 12(1)). Maximum penalty: 25 penalty units. An approved lot is an exception (regulation 12(2)).
• No alcohol purchasing for others. An operator or driver must not accept a hiring that requires the driver to purchase intoxicating liquor for or on behalf of another person, whether or not that person is a passenger (regulation 14(1)). Additionally, a driver must not, during a hiring, purchase intoxicating liquor for or on behalf of a passenger (regulation 14(2)). Both carry maximum penalties of 25 penalty units.
• Carry and produce identity card. For the identity-card regime, a driver must carry the driver's identity card or other form of identification approved by the Director under section 74(10) of the Act while driving the limousine, and must produce that identity card or other approved form of identification when requested by a passenger or an inspector (regulation 15(3)(a)-(b)). Maximum penalty: 30 penalty units.

Identity card content and status

• A limousine is prescribed as a class of commercial passenger vehicle for the purposes of section 74 of the Act (regulation 15(1)).
• The identity card issued under section 74(1)(a) of the Act to a driver must display the name of the driver, a recent photograph, the expiry date of the card and indicate that the holder is authorised to drive a limousine (regulation 15(2)).

Rights and discretions embedded in the Regulations

• Operator discretion to accept hires. The operator is not compelled to accept a hiring (regulation 9(2)).
• Director’s discretion re: additional record requirements and alternative ID. The operator’s record-keeping may include “any other matter that the Director requires as a condition of the operator’s licence” (regulation 4(1)(d)), and the Director may approve forms of identification other than the identity card under the parent Act (regulation 15(3)(a) referencing section 74(10) of the Act).
• Inspector direction/consent. Inspectors may direct or consent to parking or standing that would otherwise be prohibited (regulation 12(1)(c)); inspectors may require production of records (regulation 4(2)(b)) and identity cards (regulation 15(3)(b)).

Enforcement instruments

• Civil/penalty framework is by penalty units expressly stated against each breach (regulations 4-15). The Regulations do not set out court procedures or specify administrative sanctions beyond these maximum penalties and the demands made under inspection and Director request provisions.

Operational consequences

• Operators must organise record systems that capture the specified fields and any additional Director-imposed matters, and to store those records at their principal place of business and make them available to inspectors (regulation 4).
• Drivers must carry identity documentation meeting the card content requirements or an alternative approved by the Director, and must comply with parking, plying, soliciting and alcohol prohibitions (regulations 8-15).

All duties set out above carry statutory maximum penalties as specified in the Regulations; the text links the obligation and the maximum penalty immediately beneath the obligation wording, and those maxima are expressed in penalty units (for example, 60 penalty units for record-keeping failures, regulation 4).

The Regulations set out maximum penalties for contraventions and allocate enforcement roles primarily to the Director and inspectors. Penalties are stated as maximum penalty units attached to specific contraventions; the Regulations themselves do not convert penalty units into dollar values (that conversion is a matter outside this instrument).

Penalty structure

• Record-keeping and information offences: Regulation 4 imposes a maximum penalty of 60 penalty units for failing to make required written records (regulation 4(1)) and for failing to keep those records at the principal place of business or produce them to an inspector when required (regulation 4(2)). Regulation 5 imposes a maximum penalty of 60 penalty units for failing to furnish full and correct information to the Director when requested and within the time specified by the Director.
• Operational offences with lower maximum penalties: Regulations addressing plying for hire (regulation 8), hiring without pre-booking (regulation 9(1)), touting or soliciting (regulation 10), unlawful parking or standing (regulation 12(1)), and the alcohol-related prohibitions in regulation 14 carry maximum penalties of 25 penalty units each.
• Identity-card non-compliance: Regulation 15(3) prescribes a maximum penalty of 30 penalty units for failing to carry and produce the driver’s identity card or approved alternative.

Enforcement actors and powers

• Director: The Director can request information from operators concerning journeys and specify the time within which the information must be supplied (regulation 5). The Director also may approve alternative forms of identification under the parent Act (regulation 15(3)(a), referencing section 74(10) of the Act) and can impose licence conditions that may specify additional matters for record-keeping (regulation 4(1)(d)).
• Inspectors: Inspectors can require production of records held by the operator (regulation 4(2)(b)) and may direct or consent to parking or standing that would otherwise be prohibited (regulation 12(1)(c)). Inspectors can also request to see a driver’s identity card or approved form of identification (regulation 15(3)(b)).
• Passengers: While not an enforcement actor in an administrative sense, passengers are entitled to request production of a driver’s identity card or approved form of identification (regulation 15(3)(b)), which creates a private compliance check triggered by passengers.

Practical enforcement features and gaps

• The Regulations give administrative demand powers (information requests, production requests, approvals) and attach monetary maximum penalties for non-compliance, but they do not set out procedural enforcement steps (for example, notice periods, infringement notice procedures, or administrative penalty mechanisms) in this text. The Regulations do not specify which agency prosecutes or issues infringement notices, nor do they set the monetary value of a penalty unit, those matters lie outside the text.
• The highest maximum penalty units apply to record-keeping and information-provision failures (60 penalty units, regs 4 and 5), indicating a legislative prioritisation of data capture and administrative disclosure. Operational contraventions (plying, pre-booking, touting, parking, alcohol purchase contraventions) carry lower maximum penalties (generally 25 penalty units).
• The Director’s ability to require “any other matter” in records as a licence condition (regulation 4(1)(d)) and to approve alternative identification forms (regulation 15(3)(a) referencing the Act) creates significant administrative discretion; this discretion is an enforcement lever because non-compliance with conditions or approval requirements is likely to attract the penalties stated for failing to make or furnish records.

Fee enforcement

• Regulation 16 and the Schedule set fees (annual licence fee $300; refund application fee $20). The Regulations do not set enforcement mechanisms for unpaid fees in this text; collection and cancellation processes would be governed by the parent Act and other instruments.

Summary of penalties by regulation

• Regulation 4(1) and 4(2): Maximum penalty 60 penalty units for record failures and failure to secure/produce records.
• Regulation 5: Maximum penalty 60 penalty units for failing to furnish information to the Director.
• Regulations 8, 9(1), 10, 12(1), 14(1), 14(2): Maximum penalty 25 penalty units for plying, unbooked hiring, touting, parking contraventions, and alcohol purchase contraventions.
• Regulation 15(3): Maximum penalty 30 penalty units for failing to carry or produce identity card or approved alternative.

The instrument assigns concentrated enforcement authority to the Director and inspectors and establishes tiered monetary maximum penalties keyed to the type of contravention, with the heaviest sanctions reserved for administrative data and disclosure obligations.

The Regulations explicitly reference and operate under the framework of broader legislation and subordinate instruments; their text and endnotes identify several points of legal interaction and interdependence.

Parent Act and specific cross-references

• The Regulations are made under the Commercial Passenger (Road) Transport Act 1991 (stated in the heading and the instrument’s preamble). Regulation 2 states that these Regulations come into operation on the commencement of Part 5AA of the Commercial Passenger (Road) Transport Act 1991, which ties the Regulations’ commencement timing directly to a Part of the parent Act.
• Regulation 15 expressly links the identity-card provisions to section 74 of the Act: it prescribes a limousine as a class of commercial passenger vehicle for the purposes of section 74, it sets out content requirements for the identity card issued under section 74(1)(a) of the Act, and it permits the Director to approve other forms of identification under section 74(10) of the Act (regulation 15(1)-(3)). Therefore, identity-card issuance, legal form and any broader sanctions or processes tied to section 74 will be governed in conjunction with the Act.

Reference to Motor Vehicles Act 1949

• Regulation 4(1)(b) requires operators to record the driver’s licence number issued under the Motor Vehicles Act 1949. That creates an evidentiary connection to a separate licensing regime and suggests reliance on the Motor Vehicles Act for the validity and form of driver licences. The Regulations do not expand on licence classes or demerits; they simply require the recording of the licence number as issued under the Motor Vehicles Act 1949.

Fees and subordinate instruments

• Regulation 16 makes payable the fees specified in the Schedule. The Schedule was amended by the Fees and Charges (Transport) Amendment Regulations 2012 (see endnotes). The endnotes also list later subordinate instruments that have amended or interacted with these Regulations (for example, Commercial Passenger Vehicle Legislation Amendment Regulations 2017). Thus the fees and some operative details may be influenced or altered by subordinate instruments under enabling Acts.

Amendments and related Acts referenced in endnotes

• The endnotes list multiple amending Acts and regulations. Those instruments have rewritten or affected the Regulations at various times (for example, the Penalties Amendment (Miscellaneous) Act 2013 altered penalties in these Regulations; the Transport Legislation Amendment Act 2025 effected changes with parts commencing 21 January 2026). Readers should consult the listed instruments and the parent Act to understand the present legal architecture in full, since the Regulations are a component in a larger legislative network (Endnotes, List of Legislation and List of Amendments).

Administrative and enforcement overlap

• The Regulations allocate functions to the Director and inspectors; those functions likely interact operationally with broader administrative enforcement regimes under the parent Act. For example, request-and-production powers and licence-condition mechanisms refer to Director and inspector roles that, while given practical force in the Regulations, rely on the parent Act for the appointment, powers and procedures that govern those office-holders.

Missing interactions and external governance

• The Regulations do not address monetary conversion of penalty units, courts or prosecution procedures, police powers, vehicle safety standards, insurance requirements, or local government parking powers. Those matters fall outside this text and will be governed by the parent Act or other legislation and instruments, or by local government law. The Regulations’ references to the Motor Vehicles Act 1949 and section 74 of the parent Act indicate that the full compliance picture requires consultation of those Acts.

In short, the Regulations operate as a targeted, operational overlay that depends on the parent Act for identity-card authority and prospective enforcement architecture, and on the Motor Vehicles Act for the underlying driver-licence reference. Amendments to fees and penalties have been made by separate subordinate legislation and Acts, as listed in the endnotes, so practitioners should read the Regulations alongside those instruments and the parent Act to determine the full legal effect and procedural pathways.

The Regulations have been subject to multiple amendments since their initial certification in 2003. The instrument’s endnotes provide a chronological list of principal amendments and the statutory instruments responsible for them.

Initial instrument and commencement

• Limousine Regulations (SL No. 39, 2003) were notified 1 August 2003 and commenced 1 August 2003 (the commencement aligned with the Commercial Passenger (Road) Transport Amendment Act (No. 2) 2003 and a Government Gazette notice; see List of Legislation in the endnotes). Regulation 2 of the Regulations states commencement occurs on the commencement of Part 5AA of the Commercial Passenger (Road) Transport Act 1991.

Subsequent amendments and instruments

• Fees and Charges (Transport) Amendment Regulations 2012 (SL No. 45, 2012), notified 14 December 2012, commenced 1 January 2013. The Schedule to these Regulations was amended by that instrument (see the endnotes listing a Schedule amendment by No. 45, 2012, r 6).
• Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23, 2013): Assent date 12 July 2013 and commenced 28 August 2013. The List of Amendments identifies numerous regulatory provisions as amended by Act No. 23, 2013, s 4, including regulation 4 and regulation 5, and others (see endnote 4).
• Commercial Passenger Vehicle Legislation Amendment Regulations 2017 (SL No. 34, 2017): Notified 29 November 2017 and commenced 1 December 2017 (r 2). The List of Amendments shows that reg 4 and reg 5 were amended by No. 34, 2017 (r 13-16, 17 reference), and that some provisions were repealed by No. 34, 2017, r 15.
• Statute Law Amendment (Territory Economic Reconstruction) Act 2022 (Act No. 5, 2022): Assent date 14 April 2022. The endnotes identify commencement of part 7 on 25 May 2023 and the remaking or repeal of certain text as noted in the Gazette entries cited in the endnotes. Specifically, Act No. 5, 2022, s 69 amended regulation 15.
• Transport Legislation Amendment Act 2025 (Act No. 23, 2025): Assent date 12 September 2025. Commenced parts 2, 4, 5 and 6 on 21 January 2026, with some items remade on earlier dates per Gazette citations listed in the endnotes. The List of Amendments indicates r 1 was amended by Act No. 23, 2025, s 66.

General formal amendments

• The Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) made general amendments of a formal nature to regulations 1, 2 and 4, as noted in the endnotes (point 3).

Regulation-specific amendment mapping (per endnotes)

• The List of Amendments itemises which specific regulations were amended by various Acts: for example, r 4 and r 5 were amended by Act No. 23, 2013 and No. 34, 2017; rr 8-10 were amended by Act No. 23, 2013; r 15 was amended by Act No. 23, 2013, No. 34, 2017, and Act No. 5, 2022; the Schedule was amended by No. 45, 2012 and No. 34, 2017 (see endnote 4).

Practical implications of the amendment history

• Over time the Regulations have been updated to reflect changes in penalties (Penalties Amendment 2013), to align fees with broader transport fee schedules (2012 amendments), and to integrate with wider commercial passenger vehicle reforms (2017 amendments and the 2025 Transport Legislation Amendment Act). The identity-card provisions were specifically affected by the 2022 amendment noted in the endnotes (Act No. 5, 2022, s 69).

How to track further amendments

• The Regulations’ endnotes give the principal amending instruments and Gazette references; practitioners should use those citations to locate consolidated and current text and to identify any further subordinate instruments that alter fees, penalties or procedural provisions.

The amendment history demonstrates that the Regulations have been periodically updated by separate Acts and subordinate instruments, particularly in relation to penalties, fee schedules and alignment with broader commercial passenger vehicle legislation. For a current compliance picture, read the text alongside the parent Act and the amending instruments listed in the endnotes.

The Regulations’ reprint and endnotes do not record any judicial decisions or litigation history. The text of the Regulations names no cases and the endnotes provide no citations to court judgments or administrative tribunal determinations. Therefore, based on the source provided, there is no litigation history included in this instrument.

What this absence means for practice

• The absence of cases in the reprint does not necessarily indicate an absence of disputes in the field, but it does mean that the Regulations, as presented in this reprint, do not summarise any judicial interpretations, appeals, or precedent that would clarify ambiguous provisions such as the scope of “plying for hire”, the permissible content and retention period for records, or the precise procedural requirements for Director information requests.
• Where the Regulations leave discretion (for example, the Director’s power to require “any other matter” in records as a licence condition under regulation 4(1)(d), or the approval of alternative identification under section 74(10) of the parent Act as referenced in regulation 15(3)(a)), courts or tribunals could in principle be the venue in which boundaries of that discretion are litigated. The reprint contains no judicial guidance on such matters.

Implication for advisers

• In the absence of recorded litigation in the reprint, legal advisers must rely on the statutory text and any relevant provisions in the parent Act, as well as practice directions or administrative guidelines issued by the Department or Director, to interpret duties. If disputes arise over interpretation or administrative exercise of discretion, litigation or review proceedings would be avenues for resolution, but the Regulations do not document precedent within this text.

Recommended step for fact-finding

• Practitioners seeking case law or administrative decisions should search court and tribunal databases and consult the administrative records or practice guidelines of the Director’s office and the Northern Territory Government to uncover any adjudications or enforcement actions related to these Regulations. The Regulations themselves do not provide that information.

The Regulations are compact but contain a number of provisions where administrative discretion, drafting choices and narrow phrasing create compliance traps or practical uncertainties. Below are the specific points to watch, grounded in the text.

Open-ended record requirements

• Regulation 4(1)(d) requires operators to record “any other matter that the Director requires as a condition of the operator’s licence.” That language creates an open-ended compliance obligation: operators must comply not only with the enumerated items in regulation 4(1)(a)-(c) but also with whatever additional record conditions the Director imposes under licence. The Director’s licence conditions therefore can extend record-keeping obligations beyond the Regulations’ express list, and failure to comply attracts the maximum penalty of 60 penalty units under regulation 4. Practitioners should verify licence conditions and written specifications from the Director to understand the full record-keeping burden.

Location of records and production on demand

• Regulation 4(2)(a) mandates that records be kept “in a safe place at the principal place of business of the operator.” The Regulations do not define “principal place of business,” do not permit records to be stored offsite or electronically in a different location, and do not specify a retention period. Regulation 4(2)(b) requires production whenever required by an inspector. Operators that rely on cloud storage or remote servers should confirm whether producing records from offsite electronic systems satisfies the obligation to keep records “at the principal place of business,” or whether physical copies must be available. The Regulation imposes a 60 penalty unit maximum for contravention.

Director’s timing for information requests

• Regulation 5 obliges operators to furnish information “within the time specified by the Director.” The Regulations do not define reasonable timeframes or provide appeal mechanisms for onerous or overly broad requests. Non-compliance carries a 60 penalty unit maximum. This creates a compliance risk where operators may face short statutory timelines for complex data requests.

Operator not compelled to accept hiring

• Regulation 9(2) states that an operator is not compelled to accept a hiring. While that gives operators discretion, it also interacts with the prohibition on plying and touting (regs 8 and 10). Operators and drivers must navigate refusing takings while still avoiding behaviour that could be characterised as soliciting or touting. The Regulations contain no guidance or safe-harbour for refusal procedures.

Pre-booked hiring rule and practical implications

• Regulation 9(1) requires that hirings be pre-booked with the operator. The Regulations do not define “pre-booked” or state how advance a booking must be. This creates interpretive uncertainty: is a booking made seconds before departure over the phone “pre-booked”? Enforcement practice and Director guidance will be determinative, but the text offers little clarity.

Parking constraints and interplay with local parking law

• Regulation 12(1) forbids parking or standing except for limited purposes and only if “otherwise lawful.” That qualification means local road rules, parking regulations and private land controls continue to apply; operators and drivers must ensure that permitted stopping under regulation 12 also complies with local laws. Regulation 12(2) allows for an approved lot as an exception, but the instrument does not describe the approval process or criteria.

Identity card vs approved alternative ID

• Regulation 15(3) requires a driver to carry the identity card “or other form of identification approved by the Director under section 74(10) of the Act.” Thus, compliance can be satisfied by alternative ID if the Director approves it under the parent Act. However, the Regulations do not state how approvals are evidenced or how a driver demonstrates validity of an alternative ID to passengers or inspectors. The identity card must contain specified elements (name, recent photograph, expiry date, indication of authorisation) under regulation 15(2), and failure to carry/produce attracts a 30 penalty unit maximum.

Alcohol purchase prohibition scope

• Regulation 14(1) prohibits an operator or driver from accepting a hiring under which the driver is required to purchase intoxicating liquor for or on behalf of another person, “whether or not that other person is a passenger.” This wording captures arrangements where the driver is instructed to buy liquor for a non-passenger or third party. Regulation 14(2) additionally prohibits drivers from purchasing intoxicating liquor for a passenger during a hiring. The two provisions together impose a broad prohibition on drivers buying liquor on behalf of others while on hire. The Regulations do not, however, specify enforcement procedures if the prohibition is breached.

Fees and refunds

• The Schedule sets an annual limousine licence fee ($300) and an application-for-refund fee on surrender ($20) (regulation 16 and Schedule). The Regulations do not explain licence surrender procedures, refund timelines or circumstances that might attract partial refunds. The fee schedule has been amended by subordinate instruments, so operators should confirm that these amounts reflect the current consolidated Schedule.

Inspector and Director discretion

• Inspectors can direct or consent to parking (regulation 12(1)(c)), and the Director can require additional records and approve alternative identification (regulation 4(1)(d) and regulation 15(3)(a)). These powers centralise operational discretion with administrative officers; operators should document and obtain written confirmations of any inspector directions or Director approvals to avoid later disputes.

No retention period, no offence definitions

• The Regulations state obligations but do not define retention periods for records or provide interpretive definitions for key terms like “pre-booked” or “plying for hire.” That lack of definition increases legal uncertainty and places a premium on seeking administrative guidance and documenting compliance practices.

In short, the principal “gotchas” flow from open-ended Director-imposed record requirements, the strict location-for-records rule, unspecified timing of information requests, gaps in definitional clarity around pre-booked hiring and plying, the broad alcohol purchase prohibition, and dependency on Director and inspector discretions. Practitioners should seek written licence conditions, Director guidance and inspector directives, and preserve clear documentation of any approvals or consents to reduce enforcement risk.

Below are practical, source-grounded steps and checks that operators and drivers should implement to meet the Regulations’ requirements. Each instruction is grounded in the text and cites the relevant regulation.

1. Establish and maintain prescribed written records (regulation 4(1))

• Ensure that your written record system captures at least:
  • dates and times during which the limousine is operated for the carriage of passengers (regulation 4(1)(a));
  • full name and residential address of the driver during those periods and the driver’s licence number as issued under the Motor Vehicles Act 1949 (regulation 4(1)(b));
  • every booking and hiring made by the limousine (regulation 4(1)(c));
  • any additional matters specified as licence conditions by the Director (regulation 4(1)(d)).
• Given the Director’s power to require “any other matter,” verify licence conditions and implement fields in your record system to capture Director-specified data. Keep a checklist mapping licence conditions to record fields.

2. Keep records at the principal place of business and be ready to produce them to inspectors (regulation 4(2))

• Store records in a “safe place at the principal place of business” as required by regulation 4(2)(a). If electronic records are used, maintain a local copy accessible at the principal place of business or documented procedures that allow immediate production at that location.
• Train staff that records must be produced “whenever required by an inspector” (regulation 4(2)(b)). Establish a file and a designated staff member responsible for locating and producing records promptly to inspectors.

3. Respond to Director requests for information promptly (regulation 5)

• When the Director requests journey-related information, furnish “full and correct information” within the time specified by the Director (regulation 5). Record the request, the specified deadline and the information provided, and preserve any correspondence to demonstrate compliance.
• If the request appears overly broad or the timeframe impractical, seek written extension or clarification from the Director rather than attempting partial compliance.

4. Enforce pre-booking practices and do not accept unbooked hirings (regulation 9)

• Ensure all hires are pre-booked with the operator before the journey commences (regulation 9(1)). Maintain a booking log that timestamps booking creation and links it to the journey record. Note that operators are not compelled to accept bookings (regulation 9(2)), so implement an acceptance workflow and document any refusals.

5. Prohibit plying, touting and soliciting (regulations 8 and 10)

• Train drivers not to stand or ply for hire and not to solicit passengers. Establish operational protocols for drivers to refuse unsolicited passengers and to report incidents where passengers attempt to book without pre-booking or solicit a hire.

6. Follow parking and standing rules (regulation 12)

• Only park or stand a limousine on a road or public place or a lot off a road or public place for the specified reasons: picking up or setting down passengers; waiting under the instructions of a passenger; or by direction or consent of an inspector (regulation 12(1)(a)-(c)). Ensure drivers understand to confirm a passenger’s instructions in writing or in a booking record where practical.
• If you intend to use a dedicated lot, obtain approval for that lot as an “approved lot” under the regime (regulation 12(2)) and keep evidence of approval in your principal business records.

7. Prohibit driver purchase of alcohol for others (regulation 14)

• Implement a strict policy that drivers do not purchase intoxicating liquor for passengers or any other person in the course of a hiring, and that operators do not accept hires requiring drivers to make such purchases (regulation 14(1)-(2)). Make this a contractual term with customers where possible.

8. Issue and carry identity cards or approved alternatives (regulation 15)

• For drivers, ensure each has an identity card complying with regulation 15(2): name, a recent photograph, expiry date and an indication that the holder is authorised to drive a limousine. If the Director has approved alternative forms of identification under section 74(10) of the Act, ensure those are obtained and carried.
• Train drivers to produce the identity card or approved alternative when requested by a passenger or an inspector (regulation 15(3)). Keep copies of issued identity cards and approval documentation at the principal place of business.

9. Pay fees and manage licence renewal and surrender (regulation 16 and Schedule)

• Pay the annual limousine licence fee of $300 and be aware of the $20 application-for-refund fee on surrender of a limousine licence (regulation 16 and Schedule). Keep records of fee payments and any correspondence with the licensing authority about renewals or surrender.

10. Document all dealings with the Director and inspectors

• Because the Director can impose licence conditions and request information, and inspectors can direct parking or request records and identity cards (regulations 4, 5, 12, 15), obtain written confirmation of any director-level approvals or inspector consents. File such confirmations with the principal records to evidence compliance.

11. Monitor licence conditions and subordinate instruments

• Regularly check licence conditions for any additional record-keeping requirements (regulation 4(1)(d)) and review relevant subordinate legislation and amending instruments listed in the endnotes to ensure fee and penalty changes are reflected in internal systems.

12. Train staff on contraventions and penalty exposure

• Make drivers and relevant staff aware of the maximum penalties attached to different breaches: 60 penalty units for record and information failures (regs 4 and 5), 25 penalty units for most operational contraventions (regs 8-14), and 30 penalty units for identity-card failures (reg 15(3)). While the Regulations do not convert penalty units into dollar amounts, awareness of the relative severity is useful for internal compliance enforcement.

13. Keep written booking confirmations and passenger-facing ID

• Given passengers may request identity cards (regulation 15(3)(b)), adopt a standard process for drivers to hand passengers or visibly display identification. Maintain a system for booking confirmations that passengers can present if needed to demonstrate a pre-booked hiring.

14. Seek clarifications in writing for ambiguous terms

• For interpretive uncertainties, such as what constitutes “pre-booked,” the acceptable form of electronic records kept at the principal place of business, or the scope of “public place”,seek written guidance from the Director or the licensing authority and retain the guidance in your compliance file.

These steps derive from the text of the Regulations. Because certain procedural details (penalty unit values, court procedures for penalties, licence surrender mechanics and definitions of some terms) are not set out in the Regulations, operators should coordinate compliance planning with the parent Act provisions, any written Director guidance, licence conditions and administrative practice notes issued by the licensing authority.
