Climate Change and Greenhouse Gas Reduction Act 2010

The Act organises its regulatory architecture around statutory targets, measurement and reporting, institutional roles, voluntary sector engagement, and a limited intervention into gas-network connections.

Targets and measurement

• The core legal objects are targets for emission reduction and renewable energy (s 5). The principal ACT target is zero net emissions by 30 June 2045 (s 6(1)). The Act explicitly allows offsets located outside the ACT but within Australia to be used to balance ACT emissions (s 6(2)) and gives the Minister power to determine acceptable offsets (s 6(3)-(4)). Measurement methods are statutory instruments: the Minister must determine how to measure greenhouse gas emissions and renewable energy target compliance; those instruments are disallowable (s 10(1)-(2), s 11(1)-(3)).
• Interim/per-capita targets are statutory benchmarks: s 7 sets an interim target (40% less than 1990 emissions by 30 June 2020), s 8 sets a per-person target to peak by 30 June 2013. The renewable electricity statutory target is 100% on and from 1 January 2020 (s 9(1)).

Institutions and roles

• Minister: central executive role with statutory functions to promote, develop and adopt climate policy, consult, and report annually (s 14-15). The Minister must consult and receive advice from the Climate Change Council (s 6(5), s 7(4), s 10(3), s 11(3), s 18). The Minister’s determinations have two administrative categories: notifiable (s 6(4)) and disallowable instruments (s 7(3), s 10(2), s 11(2), s 26A(2)). The Act places procedural duties on the Minister, for example to present independent entity reports to the Legislative Assembly within prescribed timeframes (s 12(3)-(5)) and to table a statement where targets are not met (s 13).
• Independent entity: the Act requires the Minister to commission an independent body (the Act gives an example, the independent competition and regulatory commission) to prepare the annual emissions and targets report (s 12(1)-(4)) and to provide 5-year assessments of government policies (s 15A). The independent entity advises measurement methods (s 10(3), s 11(3)).
• Climate Change Council: advisory body established by statute, required to provide considered advice on mitigation and adaptation measures, to consult community and business representatives, and to submit an annual report that the Minister must table and respond to (ss 16-19).

Natural gas connection rules

• Part 2A (ss 13A-13B) creates a regulatory lock on new natural gas connections in areas prescribed by regulation (s 13A(1)). The Executive must obtain and have regard to the chief planner’s advice before making such regulations (s 13A(2)). The prohibition is enforced as a licence condition for gas distributors (s 13A(3)). The Act also authorises regulations modifying the operation of the National Energy Retail Law (ACT) and the National Gas (ACT) Law to give effect to the Part 2A restriction (s 13B).

Sector agreements and transparency

• Section 23 provides for voluntary sector agreements under which private entities agree to strategies to reduce emissions or increase renewables; such agreements must be consistent with the Act’s objects and include reporting/review requirements (s 23(1)-(2)). The Minister must keep a publicly available register of those agreements (s 24).

Procedural and regulatory levers

• The Act relies heavily on determinations, disallowable instruments and regulations for technical specifications and for giving effect to policy (ss 6(3)-(5), 7(2)-(4), 10-11, 13B, 26A-27). It also prescribes reporting timeframes and parliamentary tabling duties (ss 12, 13, 15, 19).

Definitions and scope

• The dictionary defines greenhouse gases by specific gases and enables regulations to add others (dictionary). The Act repeatedly references external statutes for operational definitions and administrative mechanics (for example, National Gas (ACT) Law, Utilities Act 2000, and the Legislation Act for instrument types and definitions), aligning the Act with existing regulatory frameworks.

In short, the Act combines statutory targets, delegated instruments to operationalise measurement and offsets, institutional reporting and advice lines, and a targeted statutory intervention into natural gas network connections, while offering voluntary pathways for private sector cooperation through sector agreements.

Primary legal addressees and materially affected private parties are set out in the text; the Act creates obligations, permissions and discretionary powers that fall mainly on the Territory executive, the Minister, gas distributors, government agencies, sector agreement partners, the Climate Change Council, and the independent entity identified to provide technical reporting.

Government and administration

• The Minister: central duties to promote targets, develop policies, commission reports, determine measurement methods and offsets, present reports and statements to the Legislative Assembly, and to assess policies (ss 14-15, 15A). Ministers decide on disallowable and notifiable instruments (ss 6(3)-(4), 7(2)-(4), 10-11, 26A(1)-(2)), so the Executive and Ministerial offices are the primary decision-makers.
• Government agencies: s 15(2) obliges each government agency to provide the Minister with requested information about policies and programs implemented to address climate change and to meet targets. Agencies therefore must maintain records and respond to information requests to enable annual Ministerial reporting.

Independent and advisory bodies

• Independent entity: although not a single named statutory body, the Act contemplates an independent technical or regulatory body (the example given is the independent competition and regulatory commission) to prepare annual reports (s 12) and periodic assessments (s 15A). That entity is tasked with producing data and analysis that will underpin ministerial and parliamentary oversight.
• Climate Change Council: appointed members (at least 5, up to 10) who are to include particular expertise categories and at least two Aboriginal or Torres Strait Islander members where practicable (s 20(1)-(2)). The Council advises the Minister and must produce an annual report; members are appointed and removable by the Minister under the standards in ss 20-22.

Commercial actors

• Gas distributors: directly regulated by Part 2A. A gas distributor must not provide a new gas connection in areas prescribed by regulation (s 13A(1)). Compliance with Part 2A is a condition of a gas distributor’s licence (s 13A(3)), so licensed distributors face a direct operational constraint. The Act defines "new gas connection" inclusively and provides examples (s 13A definitions and examples), so distributors, developers and builders are affected when construction or redevelopment triggers a new connection or an extra point of supply.
• Gas customers and developers: prospective customers, builders of granny flats, or property developers are impacted by the definition of new gas connection and the scope of regulated areas, because certain additions or rebuilds will be captured by the prohibition (s 13A definitions and examples). The Act allows regulations to exempt certain connections (s 13A(b)(iii) reference to exemptions), so affected parties must monitor regulations for local exemptions.
• Retailers and network operators under national laws: s 13B allows regulations to modify National Energy Retail Law (ACT) and National Gas (ACT) Law to give effect to the gas connection restriction. That authorises adjustments to the operation of national frameworks to accommodate Territory policy, affecting entities operating under those laws.

Private entities entering sector agreements

• Businesses and community entities that enter sector agreements with the Territory to assist in meeting statutory targets are subject to obligations within those agreements, which must be consistent with the Act and require review and reporting (s 23(1)-(2)). Those agreements are listed on a public register that the Minister must maintain (s 24), creating transparency obligations for private partners.

Public and Parliament

• Legislative Assembly and Speaker: the Minister must table independent reports and statements on target performance (s 12(4)-(5), s 13). The Minister must also present the Council’s annual report and a response (s 19(3)). These provisions implicate parliamentary oversight and public scrutiny.
• The public: the register of sector agreements must be publicly available online and at administrative unit offices (s 24(2)). Reports prepared by the independent entity and the Council are tabled in the Assembly and thereby available to the public; procedural provisions require distribution to members (s 12(5), s 19(4)).

Cross-jurisdictional regulators and laws

• National law frameworks: by referencing the National Gas (ACT) Law and National Energy Retail Law (ACT) in ss 13A-13B and by providing a regulation-making power to modify those laws for the purpose of giving effect to gas connection restrictions (s 13B(1)-(2)), the Act affects how national regimes operate in the Territory. Entities operating under those national laws must be alert to Territory regulations made under s 13B.

Others with potential exposure

• Any person or entity that provides information or becomes a party to sector agreements (s 23-24), and members of the Climate Change Council (ss 20-22), who are subject to appointment conditions and termination grounds (s 22), will be affected by the Act’s governance rules.

In sum, the Act primarily binds the Territory executive and regulated utilities (notably licensed gas distributors), while creating reporting and voluntary engagement obligations for government agencies and private entities that partner with the Territory to meet statutory targets. Public and parliamentary exposure is created by mandatory tabling and disclosure duties.

This section lists the statute’s express duties, powers and entitlements. All references are to sections in the Act.

Ministerial duties and powers

• Promotion and policy duties: the Minister must promote action to meet the ACT and other part 2 targets, develop and promote climate-related policies and programs, and consider recommending amendments to territory law or government policy if reasonably believed necessary to achieve the Act’s objects (s 14(1)(a)-(c)).
• Consultative and collaborative duties: the Minister must regularly review climate issues, consult business and community entities, promote research and development, and work together with the Australian government, State governments, the Climate Change Council and other relevant bodies (s 14(2), s 14(4)). The Minister must apply the inter-generational equity principle and consider impacts on socially or financially disadvantaged people “to the greatest extent practicable” (s 14(3)).
• Determination powers: the Minister may determine emissions offsets (s 6(3)) and may determine additional interim targets and renewable energy targets (s 7(2), s 9(2)). The Minister must determine measurement methods for greenhouse gas emissions and renewable energy target compliance (s 10(1), s 11(1)).
• Reporting and presentation duties: the Minister must request annual reports from an independent entity (s 12(1)), present those reports to the Legislative Assembly within specified timeframes (s 12(4)-(5)), present a Ministerial statement within six sitting days if a target is not met (s 13), and prepare and present an annual Ministerial report on actions taken and cost-benefit findings for policies and programs (s 15(1), (3)). The Minister must also present the Council’s annual report and a response (s 19(3)).

Obligations of government agencies

• Information provision: each government agency must give the Minister information requested about policies or programs implemented by the agency during the financial year to address climate change and meet the Act’s targets (s 15(2)).

Independent entity duties

• Annual reporting: the independent entity must prepare, within three months after the end of the reporting period, a report about greenhouse gas emissions and the part 2 targets for the year (s 12(1), (3)). The report must include specified measurements, analyses and identification of main emission sources and reasons for changes (s 12(2)(a)-(c)). The reporting period is defined as two years after the end of the financial year (s 12(6)), which calibrates the timing of the report.
• Advice role: the independent entity must be sought for advice when the Minister determines methods for measuring greenhouse emissions and renewable energy targets (s 10(3), s 11(3)).

Climate Change Council duties

• Advisory function: the Council’s principal function is to advise the Minister on reducing greenhouse gas emissions and addressing/adapting to climate change (s 17(1)). It may advise on energy efficiency, renewable energy, barriers and strategies, private sector action, and relevant technological and policy developments (s 17(3)(a)-(g)).
• Procedural duties: the Council must try to consult representatives from business and the community and provide information to encourage private entities to act (s 17(4)(a)); it must consider social, economic and environmental impacts and take into account independent entity reports and other information requested by the Minister (s 17(4)(b)(i)-(iv)).
• Reporting duty: the Council must prepare and give an annual report to the Minister within three months after the end of the financial year (s 19(1)-(2)).

Gas distributor duties and licence condition

• Prohibition: a gas distributor must not provide a new gas connection for natural gas in an area or to premises prescribed by regulation (s 13A(1)). This prohibition covers new connections, alterations that create an additional point of supply and replacement/reinstatement in certain circumstances, subject to exemptions by regulation (s 13A definitions and examples).
• Licence condition: it is a condition of a gas distributor’s licence that the distributor complies with Part 2A (s 13A(3)). The Act therefore incorporates compliance with the connection restriction into the licensing regime.
• Information obligations: a regulation may require a gas distributor to provide information to the Territory about compliance with s 13A and to give information to existing or potential customers (s 13B(3)(a)-(b)), if regulations under s 13B are made.

Sector agreements and register duties

• Sector agreement content: a sector agreement must be consistent with the Act’s objects and include a requirement for the entity to review and report on operation of the agreement (s 23(2)).
• Register: the Minister must keep a register of sector agreements and make it available for public inspection online and at the administrative unit’s office during ordinary hours (s 24(1)-(2)).

Instrument types and procedural constraints

• Certain instruments are disallowable or notifiable: Minister determinations for offsets are notifiable instruments (s 6(4)); determinations for additional interim targets, renewable energy measurement and greenhouse gas measurement are disallowable instruments (s 7(3), s 10(2), s 11(2)); determinations of fees are disallowable (s 26A(2)). Those labels integrate the Act’s technical decisions into the Territory’s administrative law framework (the Legislation Act supplies the formal process for such instruments, referenced in the Act’s notes and dictionary).

Rights and entitlements

• The Act confers no express private right to compensation or private enforcement mechanism in the text. Rights mainly arise as expectations of participation and transparency: the right of businesses to enter sector agreements and have them registered (s 23-24), and for the Legislative Assembly to receive reports and Ministerial statements (s 12(4)-(5), s 13, s 19(3)).

Practical consequences of these duties

• Ministerial determinations and reports are central levers that translate statutory targets into operational rules and measurement approaches (ss 6, 10-12). Gas distributors’ operational conduct is constrained by a licence condition enforcing the connection restriction and by any regulations made under s 13B that modify national law or impose information obligations.

The Act itself sets operational prohibitions, licence conditions and reporting obligations; it does not enumerate detailed schedules of pecuniary penalties within most sections, but the republication records the penalty unit value applicable to offences under the Act and incorporates enforcement through licence conditions and parliamentary accountability.

Penalty units and offences

• The republication prologue states the penalty unit value, at the republication date, for an offence against this law is $160 for an individual and $810 for a corporation (prefatory material at top of republication). The Act uses the concept of offences (the prefatory material notes “offence against this law”), but the body of the Act generally does not set explicit dollar penalties for specific contraventions; instead it creates obligations, licence conditions and instrument frameworks. Where offences exist, the Act will use penalty units and the stated unit values apply.

Licence condition enforcement

• Part 2A makes compliance with the gas connection restriction a licence condition for gas distributors (s 13A(3)). Enforcement of licence conditions is typically exercised under the licensing statute referenced (the Utilities Act 2000) and the National Gas (ACT) Law regime, as the Act cross-references those laws (s 13A note, s 13B). The Act does not itself set out the enforcement mechanism (for example, suspension, revocation or pecuniary penalties) within its text; those mechanisms will follow from the licensing regime that governs gas distributors.

Instrument oversight and parliamentary check

• A number of Ministerial determinations are disallowable instruments (s 7(3), s 10(2), s 11(2), s 26A(2)). A disallowable instrument is subject to parliamentary disallowance procedures as defined in the Legislation Act (the Legislation Act is referenced in the Act; the text labels instruments as disallowable and notifiable). The Act therefore routes key technical decisions to an oversight process that is parliamentary rather than solely administrative.

Reporting and political accountability

• The Act imposes time-bound reporting obligations on the Minister and the independent entity. For example, the Minister must present the independent entity’s report to the Legislative Assembly within 21 days of receipt (s 12(4)), or give the report to the Speaker if there are no sitting days within that period (s 12(5)). If a target is not met, the Minister must present a statement within 6 sitting days explaining why and what further action will be taken (s 13). The Council’s annual report must be tabled and the Minister must provide a response (s 19(3)). Those timing and tabling obligations create transparency and political accountability that operate alongside, and sometimes independently of, judicial or administrative enforcement mechanisms.

Regulatory modification enabling enforcement

• Section 13B(3) expressly contemplates regulations that provide for information provision by gas distributors to the Territory about compliance and for information to be provided to customers (s 13B(3)(a)-(b)). If enacted, those regulations would create enforceable documentary or disclosure obligations with which distributors must comply; the Act leaves the specific enforcement design to subordinate instruments.

Practical enforcement pathways and limits in the Act

• The Act enforces through licence conditions (s 13A(3)), reporting and tabling duties (ss 12, 13, 15, 19), and instrument types that subject technical decisions to parliamentary oversight (disallowable/notifiable instruments). It does not itself provide a comprehensive list of sanctions for all contraventions; the regime uses existing licensing and administrative frameworks referenced in the Act. The republication notes the penalty unit values that apply where offences are in the Act or created under regulations.

Note on legal challenge

• The Act places substantial discretion in the Minister and the Executive, but also embeds procedural requirements (seeking and having regard to advice from the Council and independent entity when making determinations, s 6(5), s 7(4), s 10(3), s 11(3)). Those procedural obligations potentially inform any administrative law review of executive decisions, though the Act itself does not set out judicial review pathways; such avenues would arise under general administrative law and the Legislation Act frameworks referenced by the Act.

The Act is drafted to operate alongside and to modify, where necessary, Territory and national regulatory frameworks. The statute cross-references multiple external legal instruments and regimes and creates specific pathways to adapt those frameworks to Territory climate policy objectives.

References to Legislation Act and instrument types

• The Act repeatedly refers to the Legislation Act for definitions and for the legal status of instrument types. For example, determinations are designated notifiable or disallowable instruments (ss 6(4), 7(3), 10(2), 11(2), 26A(2)). The dictionary at the end of the Act lists terms defined in the Legislation Act and notes that a reference to an Act includes any regulation or statutory instrument made under the Act (dictionary notes and s 14 note). In practical terms, the Act uses the Legislation Act’s instrument taxonomy to place Ministerial decisions under parliamentary or publication oversight.

Interaction with national energy and gas laws

• Part 2A expressly engages national laws: s 13A’s definition of “distribution pipeline” refers to the National Gas (ACT) Law, section 2, and the note explains that the National Gas (ACT) Act 2008 applies the National Gas Law set out in the South Australian schedule as if it were an ACT law. The Act therefore situates gas network definitions within the National Gas (ACT) Law framework.
• Section 13B expressly authorises regulations that may modify the operation of the National Energy Retail Law (ACT) and the National Gas (ACT) Law to give effect to the Territory’s natural gas connection prohibition (s 13B(1)-(3)). That power is limited by s 13B(2), which states a regulation under s 13B may only be made for the purpose of giving effect to s 13A. The Act therefore creates a constrained mechanism to override or tailor the operation of national regimes for the sole purpose of implementing the Territory’s local prohibition.

Utilities Act and licensing regimes

• The Act identifies “gas distributor” by reference to the Utilities Act 2000 dictionary (s 13A note). Making compliance with Part 2A a licence condition (s 13A(3)) imports the Utilities Act licensing enforcement machinery to implement the prohibition. Entities operating under utilities licences are therefore governed by both the Utilities Act regime and this Act’s licence condition requirement.

Planning law and chief planner advice

• Before making a regulation under s 13A the Executive must seek and have regard to advice of the chief planner about the proposed regulation (s 13A(2)). The Act therefore interfaces with the Territory’s planning system via the office of the chief planner and embeds planning advice into the regulatory design for natural gas network decisions. The endnotes show consequential planning amendments were made by the Planning (Consequential Amendments) Act 2023 A2023-36 and the Planning and Environment Legislation Amendment Act 2024 A2024-21 (legislation history), indicating legislative coordination with planning law.

Administrative reporting and transparency provisions

• The Act’s reporting and tabling requirements (ss 12, 13, 15, 19) interact with the Legislative Assembly’s standing orders and the Speaker’s office (definitions in s 12(6) and s 19(5) reference the Speaker and Deputy Speaker and pre-election periods as defined in the Electoral Act 1992). The Minister’s obligation to table reports and statements within precise timeframes therefore works within the parliamentary framework and its election-related restrictions.

Sector agreements and public registers

• The sector agreement regime (s 23-24) interacts with the administrative unit’s information systems and public disclosure obligations. The register must be available on the administrative unit’s website and at its offices (s 24(2)), which links the Act to broader administrative information disclosure practices.

Amendment and consequential amendment machinery

• The Act has a regulation-making power (s 27) and the legislative history shows the Act has been amended multiple times to integrate with other Territory laws and national arrangements (endnotes 3-4). Amendments inserted Part 2A and modified targets and measurement provisions, demonstrating that the Act is designed to be adapted by later territorial statutes and subordinate instruments.

Implications of instrument types for other laws

• Because the Minister’s technical decisions are tagged as disallowable or notifiable instruments (ss 6(4), 7(3), 10(2), 11(2), 26A(2)), those decisions are subject to the procedural and parliamentary oversight rules in the Legislation Act. That cross-linkage means that legal challenges or political contestation over those determinations will engage the disallowance regime and instrument publication obligations.

In summary, the Act deliberately threads its policy through existing regulatory frameworks: national gas and retail energy laws, utilities licensing, planning systems, parliamentary tabling rules, and the Legislation Act instrument taxonomy. It creates explicit, limited powers to modify national laws only to the extent necessary to implement local policy (s 13B(2)), and embeds licence-condition enforcement via the Utilities Act link.

The republication includes a detailed legislation and amendment history (endnotes 3-4). Key amendments and their mechanical effects are set out in the endnotes and the body of the republished Act. The following lists principal amendments recorded in the republication and the changes they made to the Act’s operation.

Major amendments and insertion of Part 2A

• Climate Change and Greenhouse Gas Reduction Act 2010 (original): enacted 2010 (legislation history).
• Climate Change and Greenhouse Gas Reduction (Principal Target) Amendment Act 2018 (A2018-36): amended the principal target provisions (s 6). The endnotes record this Act as effecting relevant changes and note the commencement dates (legislation history).
• Climate Change and Greenhouse Gas Reduction (Renewable Electricity Target) Amendment Act 2019 (A2019-19): amended the renewable electricity target, resulting in s 9(1) establishing 100% renewable electricity on and from 1 January 2020 (legislation history and amendment history).
• Climate Change and Greenhouse Gas Reduction Amendment Act 2022 (A2022-26): amended ministerial functions (s 14), annual reporting (s 15), council membership requirements (s 20) and other operational elements (legislation history and amendment history).
• Climate Change and Greenhouse Gas Reduction (Natural Gas Transition) Amendment Act 2023 (A2023-25): inserted Part 2A containing ss 13A-13B, creating the restriction on new natural gas connections and the power to modify national laws for that purpose (legislation history; the republished Act shows Part 2A as inserted).
• Planning (Consequential Amendments) Act 2023 (A2023-36): made consequential amendments relating to planning, listed in the legislation history as commencing at different dates; the amendment history records an amendment to s 13A noted by A2023-36 amdt 1.82.
• Climate Change and Greenhouse Gas Reduction (Membership) Amendment Act 2024 (A2024-8): amended s 20 membership provisions, recorded in the legislation history and amendment history as 2024 amendments.
• Planning and Environment Legislation Amendment Act 2024 (A2024-21): inserted s 26A allowing Ministerial determination of fees (A2024-21 pt 2) and appears in later republications’ amendment lists.
• Statute Law Amendment Act 2025 (A2025-29): made amendments to measurement provisions and other technical changes with an effective republication date of 6 December 2025 (endnotes).

Other historical amendments

• Earlier amendments updated reporting requirements (Annual Reports (Government Agencies) Amendment Act 2015, A2015-16), made drafting and definitional updates (Public Sector Management Amendment Act 2016, A2016-52), and adjusted measurement and other provisions across 2016-2019 (Renewable Energy Legislation Amendment Act 2016 A2016-26; Planning, Building and Environment Legislation Amendment Act 2017 A2017-3; A2017-20). The republication’s endnotes provide a chronological list of these instruments with notification and commencement details.

Nature and direction of amendment activity

• Amendment history shows a pattern of (a) periodic substantive policy updates to targets and the introduction of technical measurement and reporting mechanisms, (b) the insertion in 2023 of a targeted regulatory restriction on natural gas connections, and (c) continued alignment with planning and national energy frameworks through consequential amendments. Several amendments required ministerial determinations to be recast or relabelled (for example, changes to which determinations are disallowable or notifiable, recorded in amendment history entries such as A2025-29 amdt 4.32).

Commencement timing and editorial notes

• The legislation history records both notification dates and commencement dates for parts of amendments, and the republication includes notes explaining that the Parliamentary Counsel may make editorial changes under the Legislation Act (prefatory material). The amendment history provides clause-level references to amendments and notes where provisions were renumbered.

Practical import for compliance and governance

• The amendment sequence demonstrates that targets (both emissions and renewable electricity) have been tightened or clarified over time, that the Territory has acquired a direct statutory mechanism to restrict new natural gas connections, and that the Act’s technical measurement and reporting powers continue to be refined by subsequent Acts and subordinate instruments. Entities affected should therefore treat the Act as an evolving regulatory instrument with active subordinate instrument-making and amendment activity, and monitor endnote entries and the legislation register for current instruments.

The republication’s endnotes provide the authoritative list of amending Acts and the specific sections amended, including Act numbers and commencement details; those endnotes are the primary source for tracing the Act’s legislative evolution.

The republished text and its endnotes do not include or cite any judicial decisions, case law or litigation arising under this Act. The Act’s text itself names no cases and the endnotes set out legislative and amendment history only. Therefore, no adjudicated litigation history is recorded in this republication.

Matters that could give rise to litigation (mechanisms)

• Although the republication does not record litigation, the Act creates several decision points and legal instruments that could attract administrative or judicial review in practice:
  • Ministerial determinations of emissions offsets, measurement methods and targets are disallowable or notifiable instruments (s 6(3)-(4), s 7(3), s 10(2), s 11(2), s 26A(2)). In many administrative-law systems, decisions embodied in subordinate instruments or administrative acts can be subject to judicial review on grounds such as procedural fairness, jurisdictional error or failure to comply with mandatory statutory procedures. The Act imposes procedural obligations when making determinations (for example, the Minister must seek and have regard to advice from the Council or an independent entity, ss 6(5), 7(4), 10(3), 11(3)), and failure to satisfy those obligations could be a ground for challenge.
  • Licence-condition enforcement for gas distributors: s 13A(3) makes compliance with Part 2A a condition of the gas distributor’s licence. Enforcement decisions under licensing statutes (for example, suspension, cancellation or fines) commonly attract administrative review. The Act’s cross-reference to the Utilities Act and the National Gas (ACT) Law means any enforcement action would sit at the intersection of Territory and national frameworks, potentially creating procedural or jurisdictional issues for review.
  • Regulatory modification of national laws (s 13B): the Act authorises regulations that modify the operation of national laws only to give effect to s 13A. The scope and legality of such regulations could be contested if parties argue an exercise of the regulation-making power exceeds the statutory purpose or conflicts with the national law scheme.
  • Interpretation disputes over definitional phrases: key statutory texts such as “zero net emissions” (s 6(2)) and the detailed definition of “new gas connection” (s 13A definitions) could be the focus of litigation if parties disagree over the legal meaning or the effect of regulations or determinations implementing those concepts.

Procedural and parliamentary oversight as an alternative to litigation

• The Act embeds parliamentary oversight mechanisms (disallowable instruments, tabling of reports and Ministerial statements) that provide political and public accountability routes in addition to judicial review. For instance, disallowance of subordinate instruments provides the Legislative Assembly with the ability to overturn specified Ministerial instruments without court involvement.

Absence of recorded cases in the republication

• The republication’s endnotes do not record any judicial decisions or annotate the Act with case citations. Practitioners seeking litigation history must consult judicial databases and court records beyond the republication for any cases filed after 6 December 2025 or any matters not annotated in the legislative endnotes.

In short, the republished Act contains no litigation history. The statutory design, however, contains several decision nodes that in practice generate administrative law disputes: Ministerial determinations, licence enforcement, regulatory modifications of national laws and definitional ambiguities.

This Act contains several technical features and drafting choices that can produce practical compliance or policy surprises if not carefully tracked. The following points flag specific provisions and timings that practitioners should note, with section references.

Timing and retrospective-feel reporting structure (s 12)

• The Act’s timing for the independent entity report is unusual in its phrasing: s 12(6) defines “reporting period, for a financial year, means 2 years after the end of the financial year.” The independent entity must then give the report within three months after the end of that reporting period (s 12(3)). Practically, that calibration means reports on a given financial year are due 2 years and 3 months after the end of the year, not immediately after the year. Entities expecting prompt, near-immediate annual reporting should note the statutory lag built into s 12, which affects how current the independent entity’s analysis will be when tabled.

Ministerial obligation to “seek, and have regard to” advice (ss 6(5), 7(4), 10(3), 11(3))

• Several sections require the Minister to seek and have regard to advice from the Council or an independent entity when making determinations. The statutory formula is “must seek, and have regard to, the advice.” That imposes a mandatory procedural step to obtain advice and to consider it; however, it does not require the Minister to follow the advice. The distinction between “have regard to” and being bound by the advice is significant for administrative law considerations and for stakeholders assessing the value and weight of the advice process.

Offsets can be outside the ACT but must be within Australia (s 6(2))

• The Act permits emissions offsets used to balance ACT emissions to be located outside the ACT but within Australia (s 6(2)). This means the Statute does not insist on local offsets only; it permits a national offset market to be tapped. The Minister determines acceptable offsets (s 6(3)) which are established as a notifiable instrument (s 6(4)); therefore, the scope and type of offsets acceptable depend on Ministerial determinations and the instrument publication regime.

Disallowable vs notifiable instrument labels create different oversight regimes (ss 6(4), 7(3), 10(2), 11(2), 26A(2))

• The Act labels some determinations disallowable and at least one notifiable. Those categories trigger different oversight processes defined under the Legislation Act. Practitioners should note which instruments are disallowable (subject to parliamentary disallowance) and which are notifiable (published but not disallowable), because the availability of parliamentary check differs across instrument types.

Scope and definition of “new gas connection” (s 13A definitions and examples)

• The Act’s definition of “new gas connection” includes several scenarios beyond first-time connections: (a) an alteration of an existing connection that results in an additional point of supply, (b) replacement or reinstatement of a permanently removed existing connection, and (c) new connections are excluded where they are simply retailer changes or relocations that do not add supply points (s 13A definitions and examples). Examples in the text show typical fact patterns (granny flats, rebuilds). It follows that construction or renovation projects may unexpectedly fall within the prohibition if they create a new point of supply; developers, builders and distributors must pay attention to both the legal definition and to regulations that could provide exemptions.

Regulation-making power to modify national laws is limited in purpose (s 13B(2))

• Section 13B(1) authorises regulations that modify operation of the National Energy Retail Law (ACT) and the National Gas (ACT) Law, but s 13B(2) restricts that power “only… for the purpose of giving effect to section 13A.” The amendment power is therefore narrow and purposive; attempts to rely on s 13B to enact unrelated modifications to national law would not have the statutory purpose required by s 13B(2).

Licence condition embedding the prohibition (s 13A(3))

• The statutory prohibition is not merely standalone; it is a condition of gas distributor licences (s 13A(3)). That means compliance will be enforced through licence mechanisms in the Utilities Act or under national gas regulatory arrangements. Licence holders and prospective licensees must treat Part 2A as a licensing compliance obligation, not only as a general statutory command.

Sector agreements are voluntary but publicly registered (ss 23-24)

• Sector agreements are contractual in nature (s 23(1)), must be consistent with the Act (s 23(2)(a)), and must include review and reporting (s 23(2)(b)). The Minister must keep a register available online and at offices (s 24(2)). Parties that enter sector agreements should expect public scrutiny and reporting obligations.

Statutory targets with past dates remain in the text (ss 7(1), 8, 9(1))

• Some targets in the Act have dates in the past (per-person target to peak by 30 June 2013 (s 8), interim target to achieve 40% less than 1990 emissions by 30 June 2020 (s 7(1))). These remain statutory benchmarks even though their dates have passed. Practitioners should be cautious in assuming they are merely historical or advisory; they are still statutory targets that will appear in independent entity reporting and ministerial statements under s 12 and s 13.

Ministerial reporting timetables differ (s 12 vs s 15)

• The independent entity report has the 2-year reporting period plus three-month delivery timetable referred to above (s 12(3), (6)). By contrast, the Minister’s annual report must be presented within six months after the end of the financial year (s 15(3)). The differing timetables produce a situation where the Minister’s annual report is due long before the independent entity’s statutory report for the same financial year is due, producing potential information asymmetries between the Minister’s report and the later independent report.

Appointment and termination rules for Council members (ss 20-22)

• Membership composition mandates (s 20(2)) require, to the greatest extent practicable, inclusion of particular expertise areas and at least two Aboriginal or Torres Strait Islander people. The Minister appoints and may end appointments for specified causes including contravention of territory law, misbehaviour, bankruptcy, criminal convictions, absenteeism or incapacity (s 22(1)). The Council itself may recommend the removal of a member after procedural steps (s 22(2)-(3)). Appointment and removal powers allocated to the Minister are broad and include ministerial discretion where the Council has passed a 2/3 resolution recommending removal.

Fees determined by the Minister are disallowable (s 26A)

• Section 26A authorises the Minister to determine fees and designates such a determination as a disallowable instrument (s 26A(1)-(2)). Parties subject to fees should note that the Minister can set fees by disallowable instrument, which will be subject to parliamentary disallowance processes.

Regulation-making power and consequential amendments (s 27 and amendment history)

• The Act contains a general regulation-making power (s 27). The amendment history shows substantive policy features have been implemented through subsequent Acts and regulations (endnotes). Practitioners must therefore monitor subordinate instruments for operational detail that will implement the statutory framework.

These “gotchas” are mechanical consequences of the Act’s drafting and the delegated-instrument architecture. They point to areas where operational practice, disclosure obligations and licensing consequences are likely to arise.

Compliance under this Act requires attention to multiple strands: monitoring determinations and regulations, ensuring licence and contractual compliance, responding to information requests, reporting obligations where engaged by sector agreements, and participation in advisory processes if appointed. The following is an action-oriented checklist mapped to statutory provisions.

For the Minister and Minister’s office (s 14-15, 15A)

• Ensure procedural compliance when making determinations: seek and have regard to the Climate Change Council’s advice and the independent entity’s advice where the Act mandates (s 6(5), s 7(4), s 10(3), s 11(3)). Document the advice sought and how it was considered; that record will be useful for administrative accountability.
• Prepare and publish the Minister’s annual report within six months of the end of the financial year; gather agency data under s 15(2) early to meet the deadline.
• Commission the independent entity for annual reports and the five-year assessment on schedule (s 12, s 15A). Confirm contractual terms with the independent entity so that the entity provides the content mandated in s 12(2).
• Where a target is not met, prepare a Ministerial statement for presentation within 6 sitting days after receiving the independent report for the financial year (s 13(2)). Draft the statement to address the statutory elements: explanation of why the target was not met and what further action will be taken.

For the independent entity (s 12, s 15A)

• Establish or confirm the measurement method mandated under s 11 once the Minister determines it (or be ready to inform the Minister’s decision under s 11(3)). Provide the independent technical advice the Minister must “have regard to.”
• Produce the independent annual report containing the items in s 12(2) and deliver it within 3 months after the end of the reporting period (the reporting period is defined as two years after the end of the financial year, s 12(6); s 12(3)). Pay attention to the defined timelines and reporting content: annual emissions measured using the Minister’s method (s 12(2)(a)), progress analysis against targets (s 12(2)(b)), renewable energy compliance analysis (s 12(2)(c)), and any regulated additions.

For gas distributors and utilities (s 13A-13B)

• Immediately identify whether any of your network areas are subject to a regulation under s 13A that prescribes areas or premises where new gas connections are prohibited. If so, stop providing new gas connections in those areas where prohibited (s 13A(1)).
• Treat compliance with Part 2A as a licence condition (s 13A(3)) and review licence documentation and compliance frameworks to ensure ongoing adherence. Engage licensing counsel or the licensing regulator to determine the practical enforcement measures under the Utilities Act or national laws for non-compliance.
• Track regulations made under s 13B, which may modify the National Energy Retail Law (ACT) and the National Gas (ACT) Law to give effect to the connection prohibition; if regulations are made, comply with any new obligations to provide information to the Territory or to customers (s 13B(3)(a)-(b)).
• Understand how the Act defines “new gas connection” and whether your projects (e.g. granny flats, additional dwellings, replacements after demolition) create an “additional point of supply” (s 13A definitions and examples). If unsure, seek clarification or an exemption if regulations permit.

For businesses and entities considering sector agreements (s 23-24)

• Prepare to commit to review and reporting obligations as part of any sector agreement (s 23(2)). Structure internal monitoring to generate the reports required by the agreement.
• Expect public disclosure: the Minister will keep a register of sector agreements available online and in office during ordinary hours (s 24(1)-(2)). Build reputation and compliance checks into public communications.
• Ensure any proposed sector agreement is consistent with the objects of the Act (s 23(2)(a)). Seek legal advice to align contractual commitments with statutory expectations.

For government agencies (s 15(2))

• Maintain records and metrics on any policies or programs implemented that address climate change and greenhouse gas emissions so the agency can timely provide information requested by the Minister. Understand the scope of data and the formats required to avoid delay.

For Climate Change Council members (ss 16-22)

• Ensure membership satisfies the composition criteria “to the greatest extent practicable,” including expertise areas and at least two Aboriginal or Torres Strait Islander members (s 20(2)). Prepare to submit advice, consult business and community representatives and provide information to encourage private action (s 17(3)-(4)).
• Be aware of removal grounds (s 22) and the internal procedural protections if the Council recommends a member’s removal (s 22(2)-(3)).

For all parties tracking regulatory change

• Monitor the Legislative Assembly and the ACT legislation register for any disallowable instruments, notifiable instruments and regulations made under this Act (ss 6(4), 7(3), 10(2), 11(2), 26A(2), s 27). Technical measurement rules, acceptable offsets, and area-based natural gas prohibitions are implemented by instrument or regulation, and those texts provide the operational detail for compliance.
• Keep an eye on the endnotes and amendment history entries listed in the republication for recent amendments (endnotes 3-4). The Act has been amended multiple times since 2010, including the 2023 insertion of Part 2A and 2019’s renewable electricity target changes, so subordinate legislation and later amending Acts are likely to continue to refine obligations.

Practical compliance steps checklist

• Register and monitor: subscribe to the ACT legislation register and the administrative unit’s website to capture new determinations, regulations and the sector agreement register.
• Internal mapping: map statutory obligations to internal functions (licensing/compliance, planning, development approvals, customer communications, reporting).
• Document advisory processes: where the Act requires the Minister to seek advice, record the request for and receipt of advice and how it was considered.
• Review licences and contracts: ensure licence conditions and sector agreement terms are reflected in operational manuals and compliance processes.
• Plan for disclosure: prepare to respond to information requests from the Minister and to public disclosure obligations in sector agreements.

Complying with the Act therefore is a mix of strategic monitoring of subordinate instruments and practical operational adjustments, particularly for licensed gas distributors and for entities entering sector agreements, combined with disciplined records management for agencies and the Minister’s office to meet reporting and accountability timetables.
