57 Cross-examination regarding discovery obligations Unless a court orders otherwise, any party to a civil proceeding may cross-examine or seek leave to conduct an oral examination of the deponent of an affidavit of documents prepared by or on behalf of any other party to that proceeding if there is a reasonable basis for the belief that the other party may be— (a) misinterpreting the party's discovery obligations; or (b) failing to disclose discoverable documents. 58 Interaction with Evidence (Miscellaneous Provisions) Act 1958 Nothing in this Part derogates from the operation of Division 9 of Part III of the **Evidence (Miscellaneous Provisions) Act 1958**.
