> > (1) The [State Records Act 1998](/view/html/inforce/current/act-1998-017) does not apply to a private children’s service and such a service is not a public office for the purposes of that Act.

> > (2) In this section—

> > private children’s service means a State regulated education and care service provided to the community by any person or body other than—
> >
> > > (a) a department, office, commission, board, corporation, agency, service or instrumentality exercising any function of any branch of the Government of the State, or
> >
> > > (b) a council or county council under the [Local Government Act 1993](/view/html/inforce/current/act-1993-030).
