#### 179 Emergency action notices 179 Emergency action notices > > (1) This section applies if the Regulatory Authority is satisfied that an education and care service is operating in a manner that poses, or is likely to pose, an immediate risk to the safety, health or wellbeing of a child or children being educated and cared for by the service. > > > (2) The Regulatory Authority may, by written notice, direct the approved provider of the education and care service to take the steps specified in the notice to remove or reduce the risk within the time (not more than 14 days) specified in the notice. > > > (3) An approved provider must comply with a direction given under subsection (2). > > > > Penalty— > > > > > $6000, in the case of an individual. > > > > > $30 000, in any other case.
