What it does
This Act gives a short title, sets out detailed commencement arrangements for its provisions, provides that the schedules in the Act amend or repeal other Acts as specified, and records the Parliament of the Commonwealth's intention about the territorial reach of amendments to the Child Support Acts in relation to exnuptial children and Western Australia. Mechanically, the Act does these things:
- It prescribes its short title as the Child Support Legislation Amendment (Reform of the Child Support Scheme,Initial Measures) Act 2006 (s 1).
- It establishes a commencement regime in s 2. That regime is presented as a table in the statute, specifying which provisions commence when, including a number of items that commence either on assent (the day the Act received Royal Assent, 15 June 2006) or on the start of 1 July 2006, and some provisions whose commencement is conditional on the commencement of provisions of another Act, identified as the Child Support Legislation Amendment Act 2006 (see table entries in s 2).
- It makes clear that Column 3 of the commencement table is non-statutory; Column 3 contains additional information that is not part of the Act and can be added or edited in any published version of the Act (s 2(2)).
- It states that each Act specified in a Schedule to this Act is amended or repealed as set out in the Schedule concerned, and other items in a Schedule have effect according to their terms (s 3). The schedules themselves, which contain the substantive amendments to other Acts, are not reproduced here.
- It records the Parliament of the Commonwealth's intention about the territorial application of Child Support Act amendments affecting exnuptial children in Western Australia. Section 4 provides that amendments made by this Act, and any later Act, do not extend to Western Australia in relation to exnuptial children unless one of two events occurs: either the Parliament of Western Australia refers the matter of maintenance of exnuptial children to the Commonwealth, or Western Australia adopts the Child Support Act as amended (s 4(1)). Until one of those events occurs, the Child Support Act continues to extend to Western Australia in relation to exnuptial children as if those amendments had not been made (s 4(2)). Section 4(3) identifies "Child Support Act" for these purposes as the Child Support (Registration and Collection) Act 1988 and the Child Support (Assessment) Act 1989.
