If section 1 of that other Act commences at or before the time Schedule 1 to this Act commences, item 11 does not commence at all. Column 3 is left blank, acknowledging the uncertainty, yet the commencement trigger (immediately before another item in another Act) creates a logical impossibility: a provision cannot practically 'commence' at a moment defined solely by reference to another provision in a separate Act, particularly where that moment may never arrive or may be indeterminate."},{"type":"impossible_compliance","section":"Section 2, Table Row 6 (Schedule 2, item 12)","severity":"high","reasoning":"Unlike items 10 and 11, there is no express non-commencement condition for item 12 if the external trigger event (commencement of item 21 of Schedule 1 to another Act) fails to occur. Column 3 is blank. This creates a situation where the commencement of a provision in this Act is made wholly contingent on the commencement of a provision in a separate, independently enacted Act, with no fallback if that other provision never commences. There is no 'does not commence at all' safety valve as appears in items 10 and 11, meaning the provision is in a perpetual state of suspended commencement if item 21 of the other Act never commences."},{"type":"other","section":"Section 4(1) and 4(2)","severity":"medium","reasoning":"The Note to s4(2) openly acknowledges 'there are effectively 2 versions of the Child Support Act that apply in Australia.' While this is a known constitutional mechanism, the practical result — that the amended and unamended versions coexist simultaneously — is a genuine logical absurdity. The provision does not specify any mechanism for resolving conflicts where a matter crosses jurisdictions (e.g., where one parent is in WA and the other is elsewhere), creating potential for irresolvable jurisdictional confusion.","confidence":0.75,"description":"Section 4 explicitly contemplates — and legislatively entrenches — the simultaneous operation of two different versions of the same Act within Australia. The Commonwealth Parliament is effectively legislating that its own amendments do not apply in one State (Western Australia) for one class of children (exnuptial), while applying everywhere else. This creates a deliberate legal bifurcation where the same federal statute has two operative texts at once, which, while constitutionally explicable under the referral of powers framework, is logically absurd in practical administration: a child support officer must apply different versions of the law depending on the State and the marital status of the parents."},{"type":"other","section":"Section 2(2)","severity":"low","reasoning":"Allowing editorial amendment of commencement date information that is simultaneously presented as authoritative guidance creates a risk that published versions misstate commencement dates without legal consequence, since the dates are 'not part of this Act.' Column 2 expressly provides that the provision does not commence at all if section 1 of the Child Support Legislation Amendment Act 2006 commences at or before that time. These two statements are directly contradictory: Column 3 asserts commencement occurred while Column 2 provides a condition under which it did not. These provisions attempt to do different things with the same statutory text simultaneously: s4(1) excludes the amended Act from WA, while s4(2) preserves the pre-amendment Act in WA.
