Charter of the United Nations (Anti-terrorism — Persons and Entities) List 2001 (No. 2)

This instrument is a ministerial List of persons, entities and assets issued under the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001. Mechanically it does three things on its face.

• It names the List (s 1): "Charter of the United Nations (Anti-terrorism , Persons and Entities) List 2001 (No. 2" (s 1).
• It sets the commencement point (s 2): the List "commences on gazettal" (s 2).
• It lists, in Schedule 1, the persons, entities and assets that the Minister has determined are to be treated for the purposes of subregulation 7(1) of the Regulations (s 3 and Schedule 1).

The instrument is signed and dated by the Minister for Foreign Affairs, Alexander Downer, who states that he is "being satisfied that the entities in this List are mentioned in paragraph 1 (c) of United Nations Security Council Resolution 1373," and that he issues the List under subregulation 7(1) of the Regulations (instrument front page; explanatory line above the signature). The statutory hook quoted in the instrument is subregulation 7(1) of the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001 and paragraph 1(c) of United Nations Security Council Resolution 1373 (the instrument repeats these textual references; see the Note after s 3).

On its face the instrument does not itself create new statutory offences or sets of procedural rules in this text, nor does it include a statement of the measures that must be taken in response to a listing. Instead the List operates as an identification mechanism: it identifies by name, aliases and, in some entries, addresses or identifying numbers (for example the Holy Land Foundation entry includes a U.S. FEIN) the persons, entities and assets that the Minister has determined fall within the cited Resolution and regulation (s 3; Schedule 1).

The instrument therefore functions as a trigger document. The legal and compliance effects said to arise from a listing are not contained in this instrument; they are located in the Regulations under which the List is made. The List states that it is made "for subregulation 7(1) of the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001" (s 3), and it repeats the statutory standard for listing in the Note, namely that "the Minister must be satisfied that an entity is mentioned in paragraph 1 (c) of Resolution 1373 (2001) of the Security Council of the United Nations." The instrument therefore changes the factual landscape (which names are officially listed under subregulation 7(1)) without reproducing in the text the downstream legal consequences. Practically, once gazetted, the List serves as the official Australian catalogue of entities designated under the cited regulation for whatever measures those Regulations prescribe.

The instrument embeds a small set of formal concepts on which all practical effect depends. These concepts are stated or implied within the text and its Schedule.

• Listing and identification. The core concept is that of "listing": Schedule 1 lists named "entities" and associated aliases and, in some instances, addresses or identifying numbers. The List is explicitly made "for subregulation 7(1)" (s 3), which frames the List as the operative identification of which persons, entities or assets are to be treated under that subregulation.

• Ministerial satisfaction. The Minister's certificate is explicit: the List is issued because the Minister is "being satisfied that the entities in this List are mentioned in paragraph 1 (c) of United Nations Security Council Resolution 1373" (front page text). The instrument itself repeats the statutory standard in the Note after s 3: "Under subregulation 7 (1), the Minister must be satisfied that an entity is mentioned in paragraph 1(c) of Resolution 1373 (2001) of the Security Council of the United Nations." The operative decision-maker under this instrument is therefore the Minister for Foreign Affairs acting under subregulation 7(1).

• Commencement by gazettal. The List takes legal effect from the moment of gazettal (s 2). The instrument therefore requires no further domestic procedure within the text itself to bring surnames or aliases into the schedule beyond publication in the Gazette.

• Referential linkage to an international measure. The instrument anchors its domestic legal validity to an international Security Council resolution (UNSCR 1373) by citing paragraph 1(c) of that Resolution. The List therefore is not presented as an autonomous domestic policy list; it is a domestic implementation instrument tied to an international designation standard.

• Scope of entries. The Schedule mixes organisational names (for example, HAMAS; HIZBALLAH), aliases (for example, many alternate names listed parenthetically for the same entity), geographic identifiers (cities, P.O. boxes, and in one case a U.S. Federal Employer Identification Number), and a short descriptive phrase in the title ("Entities"). The Schedule entries thus function both as labels and as identification aids but do not in themselves set out legal restrictions, exemptions or procedures.

These concepts define how the instrument should be read: as a Ministerial, Gazette-commencing, identification list made under a specific subregulation to implement a UN Security Council Resolution reference. The instrument's legal work is to point, by name and alias, to a set of entities; the concrete statutory duties, penalties and procedures that apply to those names are not contained within the text of this List but are referenced as sitting in the Regulations under which it is made (s 3; note).

The List explicitly affects the entities named in Schedule 1. Section 3 says expressly that "the entities in Schedule 1 are listed" for subregulation 7(1) of the Regulations, and the Schedule itself itemises organisations and alternative names. The named entries include international organisations and groups such as ABU NIDAL ORGANIZATION; AUM SHINRIKYO; BASQUE FATHERLAND AND LIBERTY (ETA); HAMAS; HIZBALLAH; KURDISTAN WORKERS' PARTY (PKK); LIBERATION TIGERS OF TAMIL EELAM (LTTE); MUJAHEDIN-E KHALQ ORGANIZATION (MEK); REVOLUTIONARY ARMED FORCES OF COLOMBIA (FARC); SHINING PATH; and others as set out in Schedule 1.

Beyond the listed organisations themselves, the instrument will also affect anyone or any entity whose legal obligations are governed by the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001. The List is made "for subregulation 7(1) of the ... Regulations" and the Note emphasises that the Minister must be satisfied that an entity is mentioned in paragraph 1(c) of UNSCR 1373 (s 3 and Note). The instrument does not repeat the provisions of the Regulations; it therefore does not by itself specify which domestic actors are legally obliged to take action because of a listing. That said, the practical audience for the List will be those who need to know which names are officially designated under subregulation 7(1), so that they can apply the relevant measures that the Regulations prescribe. Those third parties will typically include regulated entities that have statutory duties under the Regulations (for example, a financial institution required by other law to freeze funds that are identified on such a list), but the List itself does not identify which classes of third parties are subject to those duties.

The List also affects persons or entities that share names, aliases or identifiers with listed entities. Schedule 1 includes extensive alternative names and, in some entries, postal addresses and a U.S. FEIN (Holy Land Foundation entry). Because the instrument operates by naming, the practical effect is that a person or company encountering a name or alias that matches an entry in Schedule 1 must investigate whether the match is to the listed entity or to an unrelated third party. The List therefore creates a screening obligation in practice: institutions and individuals who screen customers, counterparties or transactions against the official Australian list will need to manage false positives, ambiguous matches, similar names and overlapping addresses.

Decision-makers are also identified by the text: the instrument is signed by the Minister for Foreign Affairs, who states that he is "being satisfied" of the UNSC linkage (front page). That indicates centralised executive decision-making at ministerial level for inclusion on this List (the instrument does not indicate whether other agencies or decision processes were used).

The instrument itself is brief and does not set out a catalogue of duties, rights, exemptions or procedural safeguards within its own text. The List fulfils the identification function; it does not contain explicit statutory obligations. That said, the instrument does establish a legal fact that informs duties and rights which must be sought in the Regulations and other applicable law.

Duties implied by the instrument. Section 3 establishes that the entities in Schedule 1 "are listed" for subregulation 7(1) of the Regulations. The Note immediately after s 3 restates the statutory standard for listing, that "Under subregulation 7 (1), the Minister must be satisfied that an entity is mentioned in paragraph 1 (c) of Resolution 1373 (2001) of the Security Council of the United Nations." Those statements mean that the List operates as the instrument that a reader uses to identify which entities the Minister has designated under subregulation 7(1); any duties that flow from a designation under that subregulation are therefore triggered by inclusion on this List. The List itself, however, does not reproduce what those duties are, nor does it state who must carry them out.

Rights and procedural protections within the instrument. The List does not set out notice, review or appeal rights for listed entities or third parties. There is no statement in the text of the List as to a review mechanism, duration of listing, criteria for delisting, or timeframe for reconsideration. The instrument is silent on procedural protections that might apply post-listing; those must be located in subregulation 7(1), other parts of the Regulations, or other statutes and regulations.

Information rights. The Schedule provides names, aliases and in some cases addresses and an identifying number (the Holy Land Foundation entry includes a U.S. FEIN). This is material information that enables identification and screening. To that extent the instrument supplies part of the information that a regulated party would need to form the factual foundation for any action required by the Regulations.

Discretion and decision-making. The instrument expressly identifies ministerial satisfaction as the basis for the list (front page and Note). The Minister's satisfaction is therefore the primary decision criterion reported in the List. The instrument does not disclose what evidentiary standard was applied, what information was examined, or whether any internal or external review occurred before the listing; it simply records the Minister's conclusion that the entities are mentioned in paragraph 1(c) of UNSCR 1373.

This List does not itself specify penalties, enforcement mechanisms or procedural enforcement routes. The instrument is an identification schedule made "for subregulation 7(1) of the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001" (s 3). It therefore performs the role of designating which persons, entities and assets are to be treated under that subregulation; the text of the List does not reproduce the enforcement or penalty provisions of the Regulations. For an authoritative statement of what enforcement measures, offences or penalties apply to dealings with a listed entity, the reader must consult the Regulations referred to in the instrument.

Because the List is designed to operate under subregulation 7(1), the practical effect is that enforcement and penalties are determined by the content of that subregulation and related provisions in the Regulations and any other statutes that reference the Regulations. The List itself records the ministerial decision and identifies the targets; it does not itself identify which Commonwealth agencies will enforce those measures, what criminal or civil penalties might be imposed for contravention, or what administrative processes will be used for compliance, seizure, restraint or prosecution.

Implementation and enforcement mechanics implied by the List. Although the instrument is silent on statutory penalties, several enforcement-relevant features are contained in the List that bear on how enforcement will be implemented:

• Clear identification. Schedule 1 supplies lexical variants and alternate names for the listed organisations. That detailed naming permits enforcement and compliance operations to screen and identify matches, but it also creates the practical tasks of name-matching, identity resolution, and false-positive management for enforcers, regulated entities and intermediaries.

• Geographic and numeric identifiers. A small number of entries include addresses and one includes a U.S. FEIN (Holy Land Foundation). Those identifiers can facilitate targeted enforcement actions by agencies that have jurisdiction to act, but they are present only for some entries and therefore enforcement agencies cannot rely on a uniform set of locators across every entry.

• Ministerial centralisation. The List is the product of ministerial decision. Enforcement agencies and courts will look to a single, gazetted list to verify whether an entity has been designated under subregulation 7(1). That centralisation can simplify enforcement by reducing disputes about whether an entity is officially listed, but the List’s silence about timing, review or delisting creates procedural uncertainty for parties facing enforcement measures arising from a listing.

The instrument explicitly situates itself within a regulatory and international law network by reference. The List is made under the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001 (s 3). It also anchors its justification to an international Security Council instrument, paragraph 1(c) of United Nations Security Council Resolution 1373 (front page and Note). Those two references are the only cross-legal pointers contained in the instrument.

Vertical interaction: Regulations and the List. Section 3 states the List is made "for subregulation 7(1) of the ... Regulations." That phrasing indicates a vertical legal relationship: the List supplies the names to which subregulation 7(1) will apply. The Regulations will contain the operative rules, duties and penalties that give effect to the listing. Therefore, anyone researching legal obligations, enforcement procedures or remedies must read the List together with the Regulations. The List by itself is an identification tool; its legal effect is realised only through the measures contained in the Regulations.

International law interaction: UNSCR 1373. The instrument records that the Minister is "being satisfied that the entities in this List are mentioned in paragraph 1 (c) of United Nations Security Council Resolution 1373." That ties the domestic action to an international Security Council decision. As a matter of domestic legal structure reflected in the instrument, the List functions as an implementation of Australia's obligations (as claimed) under UNSCR 1373, insofar as domestic regulations require designated measures. The List does not replicate the language of the Resolution; it simply uses the Resolution as the basis for the Minister's satisfaction.

Potential overlap with other domestic regimes. The instrument does not mention other domestic regimes, statutes or lists (for example, customs, immigration, anti-money-laundering, or criminal sanctions regimes). Because the List is expressly made under the Charter Regulations, any intersection with other domestic laws will depend on whether those other instruments cross-reference the same Regulations or otherwise state that listed entities attract parallel measures. The List does not itself resolve conflicts or duplications across domestic laws; it simply provides the official list that other regimes may adopt, reference or treat as evidence.

Identification vs. legal outcomes. The List’s role is to label and identify. How it interacts with other laws depends entirely on whether those laws use the List as a trigger or evidentiary source. For example, if another statute requires a court, regulator or private party to act with respect to persons designated under the Charter Regulations, that statute will likely treat this List as the operative identification, but the List itself does not contain cross-references to such statutes.

The instrument itself contains a limited amendment history recorded within the document and naming conventions. The List is titled "Charter of the United Nations (Anti-terrorism , Persons and Entities) List 2001 (No. 2)" and is dated 10 December 2001 on the ministerial signature page, where Alexander Downer, Minister for Foreign Affairs, signs and states the ministerial satisfaction underpinning the List (front page; signature block). The instrument states that it "commences on gazettal" (s 2), indicating the operative start point.

The List does not include an express internal amendment or revision clause, nor does it list prior or subsequent amendments in its text. It is presented as a standalone gazetted instrument made under subregulation 7(1) of the Regulations. The designation "No. 2" in the title implies the existence of at least one earlier list in 2001, but the instrument does not reproduce earlier lists or explain differences. The instrument contains no schedule of amendments, no history of additions/deletions and no revocation clause. It therefore provides a snapshot of the ministerial designation at the moment of gazettal.

Because the List is a gazetted instrument made under a regulation, any amendment, replacement or revocation of the List would be performed by a subsequent gazetted instrument (for example, a later List or an amendment instrument under the same subregulation). The instrument itself is silent on what procedure will be used for subsequent amendment or delisting, and it contains no dates beyond the single signing date and the commencement provision.

If legal practitioners need to track changes over time they must therefore consult consolidated legislative databases or subsequent gazettes to identify later instruments that add to, replace, correct or remove entries. The List does not itself provide a record of prior versions, nor does it provide metadata about whether entries were carried forward from a previous list.

The absence of an internal amendment log within the instrument increases the importance of verifying the current status of any name in Schedule 1 by checking gazettes, the Regulations, and official consolidated lists or agency databases that maintain updated designations. The instrument as provided is a fixed record for the time it was gazetted; any subsequent changes will exist only in later gazetted instruments.

This instrument does not contain any information about litigation, judicial review or legal challenges. The text provides no record of court proceedings, stay orders, or judicial determinations related to the inclusion of any entity in Schedule 1. There is no section describing legal recourse, nor is there an annex of contested entries or outcomes of legal challenges.

The absence of litigation history within the instrument itself does not mean that litigation has not occurred; it simply means the instrument does not record such events. For anyone requiring the litigation record, the instrument signals the starting point (the gazetted list and the ministerial determination), but does not supply any parallel administrative record of objections, representations, or judicial reviews. To identify whether any of the listed entities or affected third parties have later pursued litigation, administrative review or other remedies in relation to designations under subregulation 7(1), researchers would need to consult case law databases and the public records of courts and tribunals; those sources are external to and not reproduced in this List.

Absence of procedural detail relevant to litigation. The List does not set out any internal review processes, delisting procedures, or administrative appeal rights that might be available to listed entities. That silence has litigation relevance: if an entity wishes to contest a designation, the procedural forum and available remedies must be sought in the Regulations or in general administrative and judicial review rights under Commonwealth law. The List itself offers no procedural pathway.

Practical implications of no recorded litigation history in the instrument. For practitioners, the absence of litigation references within the instrument means that the List is evidence of ministerial action but provides no pointers to how previous disputes have been resolved, the standard of proof used by the Minister, or how courts have treated similarly made lists. Where a legal challenge is contemplated, the List supplies the operative facts to be contested (the identity of the entities and the ministerial finding that they are mentioned in UNSCR 1373 para 1(c)), but not the procedural architecture for how a challenge should be mounted. That architecture will be found in the Regulations and in judicial decisions outside the instrument.

In short, the instrument is silent on litigation. Any analysis of legal precedent, success rates of challenges, or judicial interpretation of listings made under subregulation 7(1) must therefore rely on sources other than the text of this List.

The instrument contains a number of features that create practical risks and operational issues for those who must use it as the basis for compliance or enforcement. The following are concrete items that deserve attention when applying this List.

• Listing is by name and alias, not by universal identifier. Most Schedule 1 entries are names with multiple "a.k.a." variants. This creates screening complexity: a business or regulator performing automated name screening may need to account for many transliterations, abbreviations and alternative titles to avoid both false negatives and false positives. The List includes long chains of aliases for single entries (for example HAMAS, HIZBALLAH, PFLP and others), so matching logic must be robust to string variance (Schedule 1).

• Partial identifiers and overlapping names. Several aliases are common-words or generic phrases (for example "ISLAMIC GROUP," "PEOPLE'S DEFENSE FORCE"). Those generic aliases increase the risk of accidental matches to unrelated groups or entities. The List provides aliases but does not provide unique identifiers for each entity across all entries, increasing operational friction in identity resolution (Schedule 1).

• Addresses and identifiers are sporadic. The Holy Land Foundation entry includes multiple street addresses and a U.S. FEIN. Some other entries include postal addresses or geographic hints (for example "Ramallah, West Bank"). However, most entries lack consistent geographic or corporate identifiers. Enforcement and compliance teams cannot assume uniform availability of address data or registration numbers across all entries, meaning different entries will require different investigatory steps (Schedule 1).

• Ministerial satisfaction standard is opaque. The instrument repeats that the Minister "must be satisfied" that an entity is mentioned in UNSCR 1373 para 1(c) (Note). The List does not disclose what evidence was considered, the standard of review applied within government, or whether any representations were received from listed entities prior to listing. That procedural opacity creates legal and reputational uncertainty for listed entities and those who deal with them.

• No delisting, renewal or review terms present. The List contains no statement about duration, expiry, or review processes for entries. There is no built-in notice of how to seek removal. That silence places practical burdens on parties who might be affected by an erroneous listing: they will need to identify the applicable review routes in the Regulations or other instruments, or seek judicial review where available (Schedule 1; Note).

The List itself is an identification instrument; compliance requires acting on the duties and procedures set out in the Charter Regulations and any other applicable domestic instruments that reference this List. The List provides the authoritative roster (Schedule 1) and the moment of legal effect (gazettal), but not the downstream obligations. Based on the instrument’s content, the following concrete compliance steps flow directly from what the List provides.

1. Treat the List as the official gazetted roster under subregulation 7(1). The List "commences on gazettal" (s 2) and is made "for subregulation 7(1)" (s 3). Organisations that must comply with the Charter Regulations should therefore ensure their compliance screening processes are configured to reference the Schedule 1 entries in the official Gazette version of this List, not informal copies.

2. Screen using the Schedule 1 names and aliases. The Schedule supplies multiple "a.k.a." variants for each entry. Compliance screening (automated and manual) must include all variants listed for a given entity to reduce the risk of false negatives. For entities that include addresses or the U.S. FEIN (Holy Land Foundation entry), those identifiers should be used as corroborating match criteria (Schedule 1).

3. Establish escalation and identity-resolution procedures. Because the List relies primarily on names and aliases, organisations should implement robust escalation workflows for ambiguous or partial matches. The List itself offers no guidance on when a match is sufficient to trigger an action under the Regulations; practitioners must consult the Regulations for the thresholds that prompt freezing, refusal or reporting actions, and should maintain contemporaneous records of steps taken to match names to the Schedule 1 entities.

4. Verify applicable duties in the Regulations. The List does not set out the actual duties that follow from inclusion; it only identifies the listed entities (s 3; Note). Organisations must consult subregulation 7(1) and other parts of the Regulations to determine precisely what actions are required (for example whether certain dealings are prohibited, whether asset-freezing or reporting obligations apply, and which agencies are to be notified). The List’s practical compliance value depends entirely on combining it with the operative rules in the Regulations.

5. Record and document reliance on gazettal date. Because the List commences on gazettal (s 2), organisations should document the date of the Gazette they used for screening and any consequent actions. Where actions are time-sensitive (for example freezing assets), capture the gazettal date and the internal decision-making steps in a compliance file.
