105 Determination of trustee (1) The Minister must determine that the trustee for a perpetual care trust is either— (a) the public trustee; or (b) the director-general. (2) Before making the determination, the Minister must consult the following people: (a) for an authority perpetual care trust—the authority; (b) for a licensee perpetual care trust—the licensee. (3) A determination is a disallowable instrument.
