22 Alternative period for giving report

(1) If the ACCC considers it appropriate to do so, the ACCC may, by written notice given to a designated entity, determine that:

(a) the entity’s report under section 19 is to be given within a longer period specified in the determination; or

(b) the entity’s report under section 20 for one or more specified financial years is to be given within a longer period specified in the determination.

(2) The ACCC may make a determination under subsection (1):

(a) on its own initiative; or

(b) on written application by the entity.

(3) An application under paragraph (2)(b) must contain a statement explaining why the entity considers the determination sought is necessary and appropriate to be made in the circumstances.

(4) A determination under subsection (1) is not a legislative instrument.
