What it does
This instrument, CASA EX100/18 , Flight Examiner Rating for CAO 82.0 Check Pilots Exemption 2018, is a time‑bound delegated exemption made by a CASA executive under the Civil Aviation Safety Regulations 1998 (CASR) (instrument preamble). It operates by removing a specific regulatory requirement for a defined class of check pilots while imposing three express conditions on that exemption.
Mechanically the instrument:
- Commences on 1 September 2018 and is repealed at the end of 31 August 2021 (s 2(a)-(b)). The instrument therefore operated only for a fixed three‑year period (the instrument text provides the dates).
- Defines its scope by reference to several existing regulatory and administrative concepts: “check pilot” as defined in paragraph 2.1 of Civil Aviation Order 82.0; “flight examiner rating” as defined in Part 61 of CASR; and “operator proficiency check” as defined in regulation 61.010 of CASR (s 3).
- Applies only when a check pilot is conducting an operator proficiency check within the scope of the check pilot approval, but expressly excludes operator proficiency checks conducted for the purposes of regulations 61.650, 61.695 or 61.880 of CASR (s 4).
- Grants an exemption from the specific statutory requirement in subregulation 61.375(7) of CASR that a person conducting an operator proficiency check hold a flight examiner rating (s 5(1)). That is, for the specified circumstances described in this instrument, the person need not hold the flight examiner rating otherwise required by subreg 61.375(7).
- Subjects the exemption to three conditions: (1) the check pilot must be employed or contracted by the operator for which the check is conducted; (2) the check pilot must conduct the operator proficiency check in accordance with the operator’s approved training and checking system, as existing from time to time; and (3) the check pilot must conduct the operator proficiency check in accordance with all conditions mentioned in the check pilot approval (s 6(1)-(3)).
