Monahan  \nExecutive Manager, National Operations & Standards\n\n28 August 2018\n\nCASA EX100/18 — Flight Examiner Rating for CAO 82.0 Check Pilots Exemption 2018\n\n1 Name\n\nThis instrument is CASA EX100/18 — Flight Examiner Rating for CAO 82.0 Check Pilots Exemption 2018.\n\n2 Duration\n\nThis instrument:\n\n(a) commences on 1 September 2018; and\n\n(b) is repealed at the end of 31 August 2021.\n\n3 Definitions\n\nIn this instrument:\n\n> check pilot has the meaning as defined in paragraph 2.1 of Civil Aviation Order 82.0.\n\n> check pilot approval, in relation to a person, means the document granting CASA’s approval of the person as a check pilot.\n\n> flight examiner rating has the same meaning as in Part 61 of CASR.\n\n> operator proficiency check has the meaning as defined in regulation 61.010 of CASR.\n\n4 Application\n\nThis instrument applies to a check pilot when conducting an operator proficiency check within the scope of the check pilot approval, other than an operator proficiency check for the purposes of regulation 61.650, 61.695 or 61.880 of CASR.\n\n5 Exemption\n\n(1) The check pilot is exempt from the requirement in subregulation 61.375 (7) of CASR to hold a flight examiner rating.\n\n(2) The exemption in subsection (1) is subject to the conditions mentioned in section 6.\n\n6 Conditions\n\n(1)While conducting an operator proficiency check, the check pilot must be employed or contracted by the operator for which the check is conducted.\n\n(2) The check pilot must conduct the operator proficiency check in accordance with the operator’s approved training and checking system, as existing from time to time.\n\n(3) The check pilot must conduct the operator proficiency check in accordance with all the conditions mentioned in the check pilot approval.","sortOrder":0}],"analysis":{"summary":{"content_quality":"ok","complexity_score":2,"scope_assessment":{"changed":false,"description":"The instrument is repealed; it ceased to have effect on 31 August 2021."},"complexity_factors":["Narrow exemption from a single licensing requirement","Time-limited with explicit start and end dates","Subject to conditions tied to employment status and approved checking systems","Carves out specific regulatory provisions (r. 61.650, 61.695, 61.880)"],"plain_english_summary":"CASA EX100/18 temporarily exempted CAO 82.0–approved check pilots from the CASR flight examiner rating requirement, allowing them—while employed/contracted by the operator and acting within their check‑pilot approval and the operator’s approved training system—to conduct operator proficiency checks from 1 Sep 2018 until 31 Aug 2021.
