What it does
This instrument prescribes and approves particular foreign States as "recognised foreign States" for two separate regulatory purposes. Mechanically, it does two things. First, under regulation 61.047 of the Civil Aviation Safety Regulations 1998 (CASR), it prescribes each country listed in Schedule 1 as a recognised foreign State (see s 3). Second, for the purposes of section 12.13 of the Part 133 Manual of Standards (MOS), it approves each State listed in Schedule 2 as a recognised foreign State (see s 4). The instrument is made under regulation 61.047 of CASR and subsection 7 of Civil Aviation Order 82.0 Instrument 2014 (title at top).
The two schedules are not identical. Schedule 1 (Prescribed Recognised Foreign States) begins with a generic entry, "Countries that are EASA member States", lists a number of named European states (Austria, Bulgaria, Croatia, Cyprus, Estonia, Greece, Hungary, Iceland, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Poland, Romania, Slovakia, Slovenia), includes an "Other countries" heading, and separately lists the "United Kingdom". Schedule 2 (Approved Recognised Foreign States) contains a parallel generic entry "EASA member States" followed by the same set of named States but does not list the United Kingdom or an "Other countries" heading.
The instrument contains notes that cross-reference external definitions. A note under Schedule 1 directs readers to the definition of "recognised foreign State" in regulation 61.010 of CASR for "other recognised foreign States" and explains that the United Kingdom was, at the time of preparing the instrument, listed in paragraph (xv) of that definition as an EASA member State but that paragraph has no effect because the United Kingdom ceased to be an EASA member State on 31 December 2020. A corresponding note under Schedule 2 refers to section 1.04 of the Part 133 MOS for other recognised foreign States, and the compilation header supplies the relevant FRLI registration and commencement dates: the original instrument was registered 15 December 2020 and commenced 16 December 2020; it was amended by CASA 68/22,registered 23 December 2022 and commenced 24 December 2022. The instrument itself contains no offence or penalty clauses; it performs a labelling function that operates by reference into CASR and the Part 133 MOS (see ss 3-4).
