Carrick Hill Trust Regulations 2012

The regulations organise their rules under preliminary provisions, personal conduct, driving and parking, and miscellaneous powers. The key legal concepts that structure the instrument are:

• Approval and authorisation: reg 4 authorises the Trust and authorised officers to permit actions otherwise prohibited, and prescribes the form and flexibility of that approval. Approvals must be in writing, or if oral, confirmed in writing as soon as practicable (reg 4(2)(a)). Approvals can be conditional, attach fees (reg 4(2)(c)), and be varied or revoked (reg 4(2)(d)). Failure to comply with a condition is an offence with a maximum penalty of $250 (reg 4(3)). The regimen therefore separates blanket prohibitions from case-by-case authorised exceptions.
• Signage-enabled prohibitions: several prohibitions apply only where the Trust has indicated a restriction by signs or lines "with the authority of the Trust" (for example restrictions on eating, drinking or smoking reg 6(1)(b); traffic restrictions reg 7(a); disabled parking areas reg 9). This design makes the scope of several rules contingent on administrative acts by the Trust, rather than absolute across the whole site.
• Offences with monetary penalties and expiation fees: the regulations pair maximum penalties with specific expiation fees for many offences (see regs 5-9). The instrument therefore creates enforceable criminal or quasi-criminal sanctions while also providing fixed, administrative-style expiation amounts for particular contraventions.
• Protection of Trust property and cultural assets: the regulations prohibit defacement, damage to plantings, removal of animals, touching art or furniture of historic or artistic value, and climbing or attaching items to Trust property (see reg 6(3)(a)-(m)). The prohibition on taking photographs or electronic images inside a building (reg 6(3)(n)) is a specific limitation on certain forms of conduct that might affect conservation, privacy or commercial concerns.
• Regulation of vehicular use: reg 7 establishes duties when driving or riding motor vehicles on the site, including compliance with traffic signs authorised by the Trust, staying out of non-public vehicular areas, not emitting undue noise, and exercising due care. Reg 8 addresses parking so as not to impede access. Reg 9 makes disabled-only parking enforceable where the area is indicated by Trust-authorised signage and requires a valid disabled person's parking permit as defined by reg 3.
• Enforcement and administrative powers: reg 10 empowers authorised officers to remove animals where owners cannot be found. Reg 11 sets expectations about returning surrendered or confiscated property but permits retention where the Trust reasonably believes the item may be evidence in legal proceedings.

Definitions: reg 3 defines "Act" and "disabled person's parking permit" (including permits issued under Part 3D of the Motor Vehicles Act 1959 or similar interstate/territory permits) and notes that "property of the Trust" includes property for which the Trust has responsibility. The definition of "authorised officer" appears in usage but is not further defined within the text provided; the regulations assume the existence of authorised officers under the enabling Act or Trust arrangements.

The instrument thus blends prescriptive prohibitions with administrative flexibility via approvals and signage, and sets out the enforcement penalties for non-compliance. Many restrictions are site-specific and conditional on Trust authorisation, elevating the role of the Trust in determining how the prohibitions will apply in practice.

Primary affected persons and entities under the regulations are visitors to Carrick Hill, the Carrick Hill Trust itself, and authorised officers acting on the Trust's behalf. More specifically:

• Visitors and members of the public: Every person who enters or remains on Carrick Hill is subject to the regulations. Entry without payment of any entrance fee fixed by the Trust is an offence (reg 5(1)(a)). Visitors must comply with site rules such as behaviour standards, prohibitions on specified items, vehicle operation rules, and parking restrictions (regs 5-9). Children under 16 are specifically regulated: a child under 16 must not enter or remain unless in the care or under the supervision of an adult (reg 5(2)).
• Persons bringing vehicles: Drivers and riders using motor vehicles within Carrick Hill must obey traffic signs and lines authorised by the Trust, must not drive in areas not intended for public vehicular access, must avoid undue vehicle noise, and must drive with due care and consideration (reg 7). Those parking must not impede pedestrian or vehicle passage and must not park in designated disabled areas unless displaying a lawful disabled person's parking permit (regs 8-9). The regulations therefore impose obligations on private vehicle operators visiting the site.
• People intending to carry out commercial, expressive, or structural activities: Individuals or groups wishing to distribute printed matter, erect structures, display billboards or banners, sell goods, take up collections, or hold rallies and demonstrations will be legally prevented from doing so on Carrick Hill unless they obtain approval from the Trust or an authorised officer; such activities are listed among prohibited acts (reg 6(3)(d)-(i)). Approvals remain the Trust's instrument for permitting exceptions (reg 4).
• Owners and persons in charge of animals: Owners and handlers of animals are affected by the removal power in reg 10, which allows authorised officers to remove animals when the owner cannot be located after reasonable attempts. The prohibition on bringing animals onto Carrick Hill, other than guide dogs, also affects owners and handlers (reg 6(2)(a)).
• Disabled persons and permit holders: Reg 3 defines "disabled person's parking permit" and reg 9 ties the right to park in designated disabled areas to the lawful display of such a permit. Users holding permits under the Motor Vehicles Act 1959 or equivalent interstate/territory permits are the intended beneficiaries of disabled parking designations but only where the Trust has authorised signage indicating disabled zones.
• The Carrick Hill Trust and authorised officers: The Trust decides on the imposition of entrance fees, the installation and removal of authorised signage, the giving, varying and revocation of approvals (including setting conditions and fees) and enforcement exercises such as removal of animals and retention of property for evidentiary purposes (regs 4, 10, 11). The Trust also has a role in returning surrendered/confiscated items where appropriate (reg 11(1)).

Indirectly affected parties include any person who might intend to use Carrick Hill for meetings, commercial activities, or other activities listed as prohibited without prior approval from the Trust. The regulations place the decision-making power in relation to exceptions with the Trust or authorised officers, who can condition approvals, require fees, and revoke or vary permissions (reg 4(2)(b)-(d)). The regulations do not set out administrative application processes or timelines for approvals in detail, so applicants will be reliant on Trust procedures.

Finally, the reference to "property of the Trust includes property for which the Trust has responsibility" (reg 3) broadens the practical footprint of these rules to any property managed or for which the Trust has responsibility, not only land strictly owned.

The regulations impose specific duties on visitors and convey limited administrative rights and powers to the Trust and authorised officers. Below are the principal duties and rights, with relevant citations:

Duties on visitors and users

• Pay any entrance fee fixed by the Trust before entering Carrick Hill, and not enter or remain when the site is closed (reg 5(1)(a)-(b)). Maximum penalty for breach: $1,250; expiation fee: $160 (reg 5(1) table).
• Supervise children: ensure children under 16 are accompanied or under adult supervision while at Carrick Hill (reg 5(2)). Maximum penalty: $750; expiation fee: $105.
• Behave in a manner that does not interfere with another person's reasonable enjoyment of Carrick Hill (reg 6(1)(a)). Maximum penalty: $750; expiation fee: $105.
• Comply with site-specific prohibitions such as no eating, drinking or smoking in areas marked by Trust-authorised signage (reg 6(1)(b)). The prohibition applies only where signage is erected "with the authority of the Trust".
• Avoid abusive, threatening or insulting language, and avoid depositing litter except in receptacles provided (reg 6(1)(c)-(d)). Maximum penalty: $750; expiation fee: $105.
• Do not bring specified items into Carrick Hill, unless permitted: animals (other than guide dogs), weapons, firearms, explosives, skateboards, scooters, roller blades (reg 6(2)(a)-(g)). Maximum penalty: $1,250; expiation fee: $160.
• Do not deface or interfere with Trust property, pick or damage plants, harm or remove animals from Trust property, distribute printed matter, erect structures, display bills, signs, posters, placards, banners or flags, sell or offer anything for sale, take up a collection, or hold, arrange or participate in rallies, demonstrations or other meetings (reg 6(3)(a)-(i)). Maximum penalty: $1,250; expiation fee: $160.
• Do not climb on, or attach lighting to, trees, shrubs, fences, roofs, walls or other structures of Trust property (reg 6(3)(j)).
• Do not enter any body of water on the property, light or maintain a fire, or touch objects of art or furniture of historic or artistic value (reg 6(3)(k)-(m)).
• Do not take photographs or electronic images while inside a building on the site (reg 6(3)(n)). Maximum penalty for the class of acts listed in reg 6(3): $1,250; expiation fee: $160.
• Drive and park vehicles in compliance with Trust-authorised signs and lines, stay out of areas not intended for public vehicular access, avoid undue noise from vehicles, and drive with due care and reasonable consideration (reg 7(a)-(d)). Maximum penalty: $750; expiation fee: $105.
• Avoid parking a motor vehicle so as to prevent or impede passage of a pedestrian or another motor vehicle (reg 8). Maximum penalty: $750; expiation fee: $105.
• Do not park in disabled permit areas (as indicated by Trust-authorised signage) unless a disabled person's parking permit is lawfully displayed (reg 9). Maximum penalty: $750; expiation fee: $105.

Administrative rights and powers of the Trust and authorised officers

• The Trust and authorised officers may give approvals allowing otherwise-prohibited conduct, may specify conditions (including fees) for those approvals, and may vary or revoke approvals at any time (reg 4(2)(b)-(d)). Approvals must be in writing or, where given orally, confirmed in writing as soon as practicable (reg 4(2)(a)).
• The Trust and authorised officers may require compliance with conditions attached to approvals; contravening those conditions is an offence (reg 4(3), maximum penalty $250).
• Authorised officers have the power to remove animals from Carrick Hill if the owner or person in charge cannot be located after reasonable attempts (reg 10).
• The Trust should endeavour to return things surrendered or confiscated from a person when leaving Carrick Hill, but it may retain items for the period necessary if the Trust reasonably believes the item may constitute evidence in legal proceedings (reg 11(1)-(2)).

Rights and definitional links to other law

• The right to park in areas designated for disabled persons is conditional upon the lawful display of a disabled person's parking permit, as defined in reg 3 (which includes permits under Part 3D of the Motor Vehicles Act 1959 or similar interstate/territory permits). This creates a cross-reference to external statutory regimes governing disabled parking permits.

Duties of the Trust (express and implied)

• Trust decisions about signage, fees, approvals, and enforcement directly affect the practical scope and application of many prohibitions. The regulations oblige the Trust to act in certain ways procedurally (for example, confirming oral approvals in writing, reg 4(2)(a), and endeavouring to return confiscated items reg 11(1)), but leave significant discretion to the Trust in conditioning and revoking approvals and in erecting authorised signage that makes various rules operative.

Taken together, the regulations allocate direct duties to visitors and vehicle operators, grant the Trust and authorised officers procedural and enforcement powers, and condition several prohibitions on administrative acts such as the erection of signage or the issuance of approvals.

The regulations specify monetary maximum penalties and, for most listed contraventions, attendant expiation fees. Enforcement mechanisms and enforcement actors are addressed in narrow terms; the document primarily identifies the Trust and authorised officers as decision-makers and enforcers. The concrete penalty and enforcement structure is as follows:

Monetary sanctions and expiation fees

• Entry without payment of an entrance fee, and entering or remaining when the site is closed, carry a maximum penalty of $1,250 and an expiation fee of $160 (reg 5(1)).
• Failure to supervise a child under 16 carries a maximum penalty of $750 and an expiation fee of $105 (reg 5(2)).
• General behaviour offences (interfering with another’s reasonable enjoyment, eating/drinking/smoking where prohibited by Trust-authorised sign, abusive language, littering) carry a maximum penalty of $750 and an expiation fee of $105 (reg 6(1)).
• Prohibited items (animals other than guide dogs, weapons, firearms, explosives, skateboards, scooters, roller blades) and the class of property-damage and event-related prohibitions carry a maximum penalty of $1,250 and an expiation fee of $160 (regs 6(2), 6(3)).
• Traffic and driving-related contraventions, and parking that impedes access, carry maximum penalties of $750 and expiation fees of $105 (regs 7-8).
• Parking in a disabled permit area without a lawful disabled parking permit also carries a maximum penalty of $750 and an expiation fee of $105 (reg 9).
• Contravening a condition attached to an approval given by the Trust or authorised officer attracts a maximum penalty of $250 (reg 4(3)).

These amounts are fixed in the text of the regulations for each specific contravention and represent the enforcement levers available to the Trust and prosecuting authorities. The presence of expiation fees indicates the intended availability of an administrative settlement mechanism for many breaches, but the regulations themselves do not contain the detailed procedural framework for expiation notices or prosecution; those procedural rules typically sit elsewhere in general administrative or criminal procedure law.

Enforcement actors and powers

• The Trust and authorised officers play central roles. The Trust sets entrance fees, chooses where to place authorised signs (which create or indicate certain prohibitions), and gives, varies and revokes approvals (reg 4(2)). The regulations repeatedly link the operative effect of certain prohibitions to the presence of Trust-authorised signage (regs 6(1)(b), 7(a), 9), making the Trust’s administrative choices central to enforcement.
• Authorised officers may remove animals from Carrick Hill where owners cannot be located after reasonable attempts (reg 10). The term "authorised officer" is used throughout as an enforcement actor, but the regulations do not define the appointment process or powers beyond the contexts given.
• The Trust has a limited property-retention power: it should endeavour to return surrendered or confiscated items to persons leaving the site, but it may retain anything it reasonably believes may constitute evidence for legal proceedings for the period necessary (reg 11(1)-(2)). The regulations therefore allow for a retention period linked to evidentiary needs in prosecutions.

Operational enforcement features and limits

• Many prohibitions depend on Trust-authorised signage. Enforcement of those prohibitions in practice will therefore follow from the presence or absence of signs or lines. The regulations do not prescribe the content or form of signage, only that the signs be "with the authority of the Trust".
• The regulations specify maximum penalties but do not describe procedural steps such as how expiation notices are to be issued, how or where fines are paid, the timeframe for return of confiscated items, or the process for contesting enforcement actions. Those procedural matters will be governed by other general statutory or administrative procedures not contained in this instrument.
• The power to give approvals that may be conditional and charged (reg 4(2)(c)) gives the Trust administrative discretion to regulate activities otherwise prohibited, but the regulations limit the consequences of approval-conditions to a maximum penalty of $250 for non-compliance (reg 4(3)), which is substantially lower than penalties for many of the substantive offences.

In summary, enforcement is primarily delegated to the Trust and authorised officers, proceeds via a combination of criminal penalties and expiation fees, and is conditioned in part by Trust decisions such as placement of authorised signage and issuance of approvals.

The regulations are subordinate legislation made under the Carrick Hill Trust Act 1985, which is cited as the "Act" in the definitions (reg 3). Several explicit and implicit interactions with other statutes and legal instruments are apparent in the text:

Express cross-reference

• Disabled parking permits: reg 3 defines "disabled person's parking permit" to include permits issued under Part 3D of the Motor Vehicles Act 1959, and "a similar permit or authority issued under the law of another State or a Territory of the Commonwealth". That definition ties the regulations to the Motor Vehicles Act 1959 for the legal standard and issuance of disabled parking permits and recognises the validity of interstate/territory permits. The practical effect is that reg 9’s prohibition on parking in designated disabled areas without such a permit relies on external statutory regimes that govern the issuance, form and recognition of disabled parking permits.
• The regulations repeatedly make certain restrictions operative only where signs or lines are "with the authority of the Trust" (for example regs 6(1)(b), 7(a), 9). This means the regulations interact with administrative law principles governing delegation, signage, and the lawful exercise of statutory power by the Trust under the enabling Act. The regulations do not set out the Trust’s enabling powers in detail; those will derive from the Carrick Hill Trust Act 1985 and any general statutory provisions on the exercise of powers by statutory corporations or trusts.

Procedural and evidentiary interactions

• Reg 11(2) permits the Trust to retain items reasonably believed to constitute evidence of an offence for the period necessary for legal proceedings. This provision anticipates interaction with the criminal justice system and with prosecutorial procedures including evidence handling, disclosure, preservation and potential seizure. The regulations do not specify evidentiary rules or retention time limits, so standard legal processes and agency policies will likely apply.
• The existence of expiation fees in the regulations indicates an administrative enforcement pathway; the procedures for issuing expiation notices, appeal rights, and payment would be governed by the relevant South Australian statutory framework for expiation of offences, not set out within these regulations.

Scope and limits under enabling Act

• The regulations operate within the powers conferred by the Carrick Hill Trust Act 1985 (reg 3). Any conflict between the regulations and that Act would be resolved by the primacy of the Act; the regulations cannot validly exceed powers allowed by the Act. The provided text does not include the enabling Act’s provisions, therefore one must look to the Act to determine the full scope of delegated powers, appointment of authorised officers, and duties of the Trust.

Interaction with local government or other property regimes

• The definition of "property of the Trust" includes property for which the Trust has responsibility (reg 3). That phrasing suggests the regulations apply to property under the Trust’s care, even where legal title might be different. It therefore interfaces with any arrangements (leases, management agreements, local government covenants) that place responsibility for land or structures with the Trust.

What the regulations do not do

• The regulations do not set out procedures for prosecution, expiation notice issuance, or appeal mechanisms; those will be supplied by separate administrative and criminal procedure law.
• The regulations do not define "authorised officer" or specify the appointment process, training, powers of detention or search, or use-of-force rules; those matters are governed by the enabling Act or other applicable statutes and Trust policies.

In short, these regulations are tethered to the Carrick Hill Trust Act 1985 and cross-reference the Motor Vehicles Act 1959 for disabled parking permits, while leaving procedural enforcement mechanics and detailed administrative law relationships to the enabling legislation and relevant general statutes.

The regulations themselves contain a short legislative history section and a revocation schedule. The substantive points in the instrument about its own history are:

• The Carrick Hill Trust Regulations 2012 were made and are identified as Statutory Instrument No. 265 of 2012, Gazette 20.12.2012 p5756 (Legislative history notes).
• The regulations commenced on the date on which they were made. Reg 2 states: "These regulations will come into operation on the day on which they are made." The legislative history entry records "20.12.2012: r 2", indicating commencement on 20 December 2012.
• Schedule 1 expressly revokes the Carrick Hill Trust Regulations 1999. The Schedule is titled "Revocation of Carrick Hill Trust Regulations 1999" and the single line states "The Carrick Hill Trust Regulations 1999 are revoked." Thus the 2012 instrument replaced the 1999 regulations.
• The legislative history section includes a "Principal regulations" table showing the year 2012, no. 265, the Gazette reference and the commencement notation already cited.

No subsequent amendments, variations or repeals are recorded in the text provided. The regulations do not include any amending provisions beyond the repeal of the 1999 instrument. Therefore, based solely on the material supplied, the 2012 regulations represent the current instrument that replaced the 1999 regulations effective 20 December 2012, and no further amendment entries are shown.

For persons needing to trace amendments, the regulatory note suggests using the Index of South Australian Statutes or the official website www.legislation.sa.gov.au, but no further amendment history details are present in this text.

The provided regulations file contains no litigation history, reported cases, or references to judicial decisions. The text does not name any cases, nor does it summarise judicial interpretation or challenges to the instrument.

The only legal-history material included is administrative: the revocation of the Carrick Hill Trust Regulations 1999 and the commencement details for the 2012 regulations (Schedule 1; Legislative history). There is no record in the supplied text of prosecutions, contested expiation notices, judicial review of Trust decisions under these regulations, or appellate or higher court treatment of interpretive issues arising under these regulations.

Given the absence of litigation references in the instrument itself, anyone requiring case-law on these regulations or enforcement practices must consult court records, prosecutorial statistics, or databases of South Australian decisions outside this text. The regulations anticipate interaction with legal proceedings (for example reg 11(2) permits retention of items believed to constitute evidence), but do not document any litigation outcomes or authoritative judicial interpretation within the document.

Therefore, based only on the source supplied here, there is no litigation history to summarise.

The regulations are concise but contain several points that carry practical traps for visitors, event organisers and Trust administrators. These are concrete compliance or enforcement pitfalls that arise directly from the text:

• Signage determines scope for several prohibitions: Many prohibitions are operative only "in an area marked, with the authority of the Trust, by a sign" (for example eating, drinking or smoking in reg 6(1)(b); traffic restrictions reg 7(a); disabled parking reg 9). This means visitors can be legally allowed to smoke or eat in areas where no sign exists, and conversely can be prohibited by the erection of signage. The Trust’s choices about where to place signs therefore materially change what conduct is prohibited. Practically, compliance requires close attention to onsite signage.
• Oral approvals must be confirmed in writing: reg 4(2)(a) permits approvals to be given orally but requires written confirmation "as soon as practicable". A person relying on an oral approval should obtain the written confirmation promptly to avoid breaching conditions that attract a penalty (reg 4(3) imposes a maximum penalty of $250 for contravening a condition). Relying solely on oral permission without written confirmation risks exposure if the approval is later disputed.
• Approvals can be conditional, charged and revoked at any time: reg 4(2)(c)-(d) allow conditions (including fees) and revocation. Organisers should not plan large-scale activities, sales or demonstrations without securing explicit written approvals and contingency plans in case the Trust varies or revokes permission.
• Photographing inside buildings is broadly prohibited: reg 6(3)(n) flatly prohibits taking photographs or electronic images while inside a building. This is a specific restriction that trips up many visitors, including journalists and photographers; permission must be obtained through the Trust’s approval process.
• Broad list of banned items includes common recreational devices: reg 6(2) prohibits skateboards, scooters and roller blades. These items are often used by teenagers and visitors; they cannot be brought onto Carrick Hill absent Trust approval.
• Activities commonly associated with public spaces are expressly prohibited unless approved: distributing printed matter, erecting structures, displaying billboards or banners, selling goods, taking up collections, and holding rallies or demonstrations are all in the prohibited list (reg 6(3)(d)-(i)). Event organisers and charities should seek approvals in advance and should expect the Trust to set conditions and possibly require fees.
• Confiscation and retention hazards: reg 11(2) allows the Trust to retain items it reasonably believes may constitute evidence of an offence "for such period as is necessary for the purposes of legal proceedings." There is no express time limit in the regulation; the retention period is tied to the duration necessary for legal proceedings. Retrieval policies and evidentiary chain-of-custody expectations should be clarified with the Trust to avoid loss or damage to property.
• Children under 16 must be supervised: reg 5(2) makes it an offence to have a child under 16 on the premises without adult supervision. Caregivers and event hosts must ensure supervision to avoid penalties.
• Interface with disabled parking permits: reg 9 conditions parking in disabled-only zones on the lawful display of a disabled person's parking permit as defined by reg 3. Visitors who hold interstate permits should confirm they meet the regulation’s "similar permit" criterion; the regulation recognises interstate/territory authorities in principle, but the practical acceptability requires display of the permit in the vehicle.
• Limited detail on enforcement procedure: while penalties and expiation fees are specified, the regulations do not describe procedural mechanisms for issuing expiation notices or for contesting enforcement actions. That means persons receiving an infringement or having property retained will need to consult the Trust and wider administrative or prosecutorial rules for procedural recourse.
• Small-penalty cap for breaching approval conditions: contravening a condition of approval attracts a maximum penalty of $250 (reg 4(3)), which is materially lower than penalties for many substantive offences. However, the Trust could attach substantive conditions that, if breached, also result in breach of other provisions with higher penalties. Organisers must assess both the approval-condition sanction and overlapping substantive prohibitions.

These "gotchas" derive directly from the text and reflect areas where reliance on incomplete information, verbal permissions, or inadequate planning will lead to regulatory exposure. The Trust’s discretionary power to authorise, condition and revoke permissions, combined with sign-dependent prohibitions and the breadth of items and activities listed as banned, make prior written approval and close attention to signage the practical compliance baseline.

Compliance with these regulations requires combining advance planning, attention to Trust-authorised signage, and formalising any exceptions through the Trust's approval process. Concrete steps, grounded in the text of the regulations, are:

1. Check the Trust’s entrance fee policy before arrival

• Reg 5(1)(a) makes entry without payment of an entrance fee, if any fixed by the Trust, an offence. Before public events or group visits, confirm whether the Trust has fixed an entrance fee and ensure collection/receipt procedures are in place.

2. Observe opening hours and signage

• Do not enter or remain when Carrick Hill is closed (reg 5(1)(b)). Many prohibitions are sign-dependent; inspect and follow all signs and lines erected "with the authority of the Trust" (regs 6(1)(b), 7(a), 9). Trust signage determines where eating, drinking or smoking are prohibited and where traffic/parking restrictions apply.

3. Secure written approvals for activities that might otherwise be prohibited

• If you plan to distribute printed matter, erect structures, sell goods, take up collections, or hold public meetings, request written approval from the Trust or an authorised officer in advance (reg 6(3)(d)-(i); reg 4). If you receive an oral approval, obtain written confirmation "as soon as practicable" (reg 4(2)(a)). Expect conditions and potential fees to be attached (reg 4(2)(c)), and note that non-compliance with conditions is an offence (reg 4(3)).

4. Make written arrangements for photography inside buildings

• Reg 6(3)(n) prohibits taking photographs or electronic images inside a building. Apply to the Trust for written permission for any planned photography or filming inside buildings, specifying the nature of the activity and any proposed equipment or lighting (reg 4 governs approvals).

5. Comply with vehicle operation and parking rules

• When driving or riding a vehicle on site, obey speed, parking and traffic restrictions indicated by Trust-authorised signage, do not drive in non-public vehicular areas, avoid undue noise emissions, and drive with due care (reg 7). Do not park so as to impede pedestrian or vehicle passage (reg 8). For disabled parking areas, ensure display of a lawful disabled person's parking permit as defined in reg 3; consult the Motor Vehicles Act 1959 for permit issuance requirements if necessary (reg 9).

6. Do not bring prohibited items onto the site

• Do not bring animals (other than guide dogs), weapons, firearms, explosives, skateboards, scooters, or roller blades on to Carrick Hill without prior approval (reg 6(2)). If an animal must be present, ensure the owner/handler is present; otherwise authorised officers may remove the animal (reg 10).

7. Protect Trust property and cultural assets

• Do not deface, damage, remove or interfere with Trust property, including plants and artwork or furniture of historic or artistic value (reg 6(3)(a)-(m)). If an activity requires interacting with such property, secure explicit written consent from the Trust outlining permitted actions and safeguards.

8. Plan for children and supervision

• If children under 16 will attend, ensure they are accompanied or supervised by an adult at all times (reg 5(2)).

9. Prepare for potential confiscation and return of items

• The Trust "should endeavour" to return surrendered/confiscated items when a person leaves (reg 11(1)), but the Trust may retain items if they are reasonably believed to be evidence for legal proceedings (reg 11(2)). Keep records and receipts where possible for items handed over to authorised officers, and ask for details about retention and the process for retrieving items.

10. Document and retain approvals and communications

• Keep copies of all written approvals and written confirmations of oral approvals, including any stated conditions and fees (reg 4(2)(a)-(c)). If an approval is later revoked, having contemporaneous written records will assist in demonstrating compliance history.

11. Be proactive about accessibility for disabled visitors

• Ensure that vehicles designated for disabled parking display a valid disabled person's parking permit as defined in reg 3. If operating a service for disabled visitors, confirm the Trust’s layout and the presence of Trust-authorised disabled parking signage (reg 9).

12. Consult the Trust for procedural questions

• Because the regulations delegate many practical determinations to the Trust (for example, where signs are placed, what fees and conditions are attached to approvals), contact the Trust early for guidance on application processes, signage, traffic management, and event approvals. Ask specifically about the procedure for obtaining written approvals, timelines for confirmation, and whether specific insurances, bonds or site-specific requirements apply.

13. Understand enforcement and expiation processes

• Be aware that most contraventions have specified maximum penalties and expiation fees (regs 5-9). While the regulations set these monetary amounts, the practical mechanisms for expiation notice issuance or prosecution will be governed by other statutes and administrative procedures; seek administrative-law advice if you receive an expiation notice or face prosecution.

Following these steps, grounded directly in the text of the regulations, addresses the principal compliance risks: signage-dependent prohibitions, the need for written approvals, vehicle and parking obligations, the wide list of prohibited activities and items, and obligations regarding children and protection of Trust property.
