221 Confidential information (1) A person who has acquired information in exercising a power or performing a function under this Part is guilty of an offence if the person: (a) discloses the information to someone; or (b) does something that results in disclosing the information to someone and is reckless as to whether doing the thing would result in the disclosure; or Care and Protection of Children Act 2007 136 (c) uses the information. (2) Subsection (1) does not apply to: (a) a disclosure or use of the information by a person in exercising a power or performing a function under this Part; or (b) a disclosure or use of the information for any of the following purposes authorised by the Minister: (i) research relating to the object of this Part; (ii) an inquiry or investigation conducted by a coroner, the Police Force or another law enforcement agency; (iii) a purpose specified by regulation; or (c) a disclosure of the information to a court or tribunal; or (d) a disclosure or use of the information that is otherwise required or authorised by law.
