25 Requirements for restarting flaring only projects
A restarting flaring only project must be a project to which the following apply:
- neither electricity generation nor biomethane production can or does occur in respect of emissions from the project landfill on and after the day that is:
- immediately before the day the section 22 application or section 128 application in relation to the project is made; or
- the start of the first reporting period for which the project is classified as a restarting flaring only project;
- consultation undertaken by the project proponent with the owner and operator of the project landfill supports paragraph (a).
