23 Requirements for flaring only projects
A flaring only project must be a project to which the following apply:
- the section 22 application or section 128 application in relation to the project includes a CEO statement certifying that, on the basis of modelling undertaken by the project proponent for the project within the period of 12 months immediately before the making of the section 22 application or section 128 application, the generation of electricity as part of the project is unlikely to provide a reasonable return on investment;
- there is no regulatory or contractual obligation which requires combustion of landfill gas from the project landfill beyond that which would have been combusted without the project;
- consultation undertaken by the project proponent with the owner and operator of the project landfill endorses the statements in paragraphs (a) and (b).
