11 Landfill gas capture and destruction projects

For the purposes of paragraph 106(1)(a) of the Act, this instrument applies to an offsets project in which either or both of the following occur, in a way that can reasonably be expected to result in eligible carbon abatement:

landfill gas from a landfill site is collected and treated in a way that destroys methane;

landfill gas from a landfill site, with or without biogas produced from other biogas waste, is collected and treated by biogas upgrading at a project biomethane facility to produce biomethane which is then sent to an end use where it can reasonably be expected to be combusted within Australia as a natural gas substitute.

A project covered by subsection (1) is a landfill gas capture and destruction project.

A landfill site mentioned in subsection (1) is the project landfill for the landfill gas capture and destruction project.

Unless otherwise stated, a reference in this instrument to an eligible offsets project is a reference to a landfill gas capture and destruction project that is an eligible offsets project.
