What it does
These Regulations, made under the Caravan Parks Act 2012 and commenced 1 May 2012 (rr 1-2; Endnotes), set out three principal mechanical changes.
First, they establish an infringement-notice regime for specified offences under the Caravan Parks Act by declaring which Act provisions are "infringement notice offences" and by fixing the sanction for each in penalty units (reg 4(1)-(2); Schedule). The Regulations specify when the Commissioner may give an infringement notice (reg 5), the precise contents required in an infringement notice (reg 6(1)-(2)), how payment by cheque is treated (reg 7), the manner and timing for withdrawal of a notice (reg 8), and the scope and limits of the Part (reg 9). The schedule lists the relevant Act provisions and the number of penalty units for each (Schedule).
Second, they prescribe additional mandatory content for a landlord/operator notice of intention to terminate a caravan park agreement for failure to pay rent under section 108 of the Act. A notice under s 108 must include five specific data items about rent obligations and payments, plus the date rent will next be payable after remedy (reg 10(a)-(f)).
Third, they modify the operation of section 129 of the Caravan Parks Act for a class of caravan park agreements mentioned in section 26 of the Act so that, unless the agreement provides otherwise, interest that accrues on a security deposit is distributed to the operator (reg 11(1)-(2); Note).
Mechanically, the regime connects to the Fines and Penalties (Recovery) Act 2001 by requiring infringement notices to identify the enforcement agency defined in that Act and by informing recipients of the enforcement and recovery options available under that Act (reg 6(1)(f), reg 6(2)(b)-(c)). The monetary sanction for an infringement is the monetary value of the number of penalty units specified in the Schedule (reg 4(2)). The Regulations do not require the issue of an infringement notice, do not prevent prosecution for the same offence, and permit multiple notices (reg 9(2)(a)-(c); reg 9(3)).
