What it does
This instrument, captioned Byron Local Environmental Plan 1988, establishes the land-use regulatory framework for the Byron Shire local government area. Mechanically it does the following.
- Zones all land in the Shire and links each parcel to a set of zone objectives and a development control table (cl 3; cl 8; cl 9). The map-based zoning system in clause 8 describes the zone numbering and the map legends (for example Zone No 1 (a) General Rural Zone; Zone No 3 (a) Business Zone; Zone No 7 (a) Wetlands Zone).
- Sets the consent authority for the plan: the council is the consent authority (cl 7).
- Prescribes what development is permitted without consent, what requires consent and what is prohibited in each zone (cl 9(2)-(3) and the table entries). It designates categories of exempt and complying development by reference to Chapter 16 of the Byron 2010 Development Control Plan (DCP) (cl 9(4)-(7)).
- Controls subdivision and the erection of dwellings through minimum lot sizes, limits on the number of allotments that may be created, and conditions attaching to particular mapped areas and schedules (cl 10-15, 11A-11B, Schedule 7, Schedule 8).
- Introduces site‑specific and thematic controls: heritage protections (Div 2, cl 18-22 and Schedule 2), flood and coastal controls (cl 23, cl 24, cl 32-33), scenic and ridgetop controls (cl 30-31), acid sulfate soils controls (cl 63), tree preservation orders (cl 52), signage controls (cl 64), and height/building line limits (cl 27; cl 40; cl 39C).
- Creates pathways for alternative tenure or settlement models: multiple occupancy/rural landsharing (cl 17A), and limited community title subdivision tied to precise schedules and management plan requirements (cl 17B; Sch 13).
