What it does
These Regulations prescribe which named public bodies are "authorities" for the purpose of the Borrowing and Investment Powers Act 1987 (the Act) and specify which provisions of the Act apply to each authority. The Regulations do not themselves set substantive borrowing limits, interest or investment rules; instead they operate by linking named persons or bodies (listed in Schedule 1) to particular sections of the Act so that the rights, duties and constraints contained in those sections bind the named authority (see regs 1, 5-6, Schedule 1). Reg 1 states the Regulations’ objectives: to prescribe persons or bodies for the definition of "authority" in s 3(1) of the Act and to prescribe sections of the Act for each authority. Reg 2 identifies the authorising provision: these Regulations are made under s 31 of the Act.
The instrument is primarily a mapping exercise. It contains: a Preliminary Part (regs 1-4), two short operative regs that identify the authorities and the sections that apply (regs 5-6) and a Schedule listing 243 named items across five Parts (Councils; Educational institutions; Public hospitals and public health services; Water authorities; Other authorities) with, for each named authority, a Column 2 entry recording the section numbers from the Act that are to apply (Schedule 1, Parts 1-5). The Schedule entries vary: some bodies are listed against a single section number (for example, many TAFE institutes appear with only section 10), while many large water corporations and statutory authorities are listed against an extended set (for example, Melbourne Water Corporation: 5, 8, 9, 10, 11, 11AA, 13, 14, 15, 20, 20A, 21; see Sch 1 Pt 4 items 168). Reg 4 defines "the Act" for the Regulations as the Borrowing and Investment Powers Act 1987.
Commencement is staggered: regs 1-6 (Parts 1-2) came into effect on 1 July 2022, Part 3 (when present) was set to commence on 1 September 2022, and Part 4 on 1 July 2023 (reg 3). The Endnotes record that certain Parts and regulations were revoked after making (reg 8 revoked Pt 3 and reg 10 revoked Pt 4 in the published table of amendments) and that the Regulations will sunset ten years from making under the Subordinate Legislation Act 1994 (see Endnotes, Table of Amendments and General information). The effect of these Regulations therefore is mechanical and delegated: they decide "who" the Act will apply to and "which" sections will apply; the substantive legal regime remains in the Act itself and in any other Acts noted as modifying or constraining application (for example, Schedule 1 item 225 is expressly "Subject to the Treasury Corporation of Victoria Act 1992").
