up-to-date legislative information.\n\nThe Borrowing and Investment Powers (Authority) Regulations 2022, S.R. No. 52/2022 were made on 30 June 2022 by the Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, under section 31 of the **Borrowing and Investment Powers Act** **1987**, No. 13/1987 and came into operation as follows:\n\nParts 1, 2 (regulations 1–6) on 1 July 2022: regulation 3(1); Part 3 (regulations 7, 8) on 1 September 2022: regulation 3(2); Part 4 (regulations 9, 10) on 1 July 2023: regulation 3(3).\n\nThe Borrowing and Investment Powers (Authority) Regulations 2022 will sunset 10 years after the day of making on 30 June 2032 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after  \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.  \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.  \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after  \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.  \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after  \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Borrowing and Investment Powers (Authority) Regulations 2022 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\nBorrowing and Investment Powers (Authority) Regulations 2022, S.R. It lists which government bodies (called 'authorities') are allowed to borrow money and invest funds, and exactly which parts of the Act apply to each one.\n\n**What it does:**\n- **Identifies authorities**: It names specific organisations—like local councils, hospitals, water corporations, and various government agencies—and declares them to be 'authorities' under the Act.\n- **Specifies powers**: For each authority, it lists which sections of the Act apply to them. This means different bodies get different borrowing and investment powers. For example:\n  - Most **local councils** get sections 5, 8, 11, 13, and 15 (basic borrowing and investment powers).\n  - **Water corporations** typically get more extensive powers including sections 20 and 20A (which relate to derivatives and financial instruments).\n  - Some bodies like **catchment management authorities** only get section 10 (limited investment powers).\n\n**Who it affects:**\n- **Public sector bodies**: All 243 listed entities, from Alpine Shire Council to the Zoological Parks and Gardens Board.\n- **Treasury and finance staff**: People managing public money who need to know what financial instruments their organisation is legally allowed to use.\n- **Auditors and regulators**: Those checking that public bodies stay within their legal borrowing limits.\n\n**Why it matters:**\nPublic money needs strict controls. This regulation prevents unauthorised borrowing or risky investments by clearly mapping out who can do what. If an authority isn't listed here (or a specific section isn't applied to them), they can't use those financial powers. It's a safeguard against councils or agencies getting into debt trouble or making speculative investments."},"flash_summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"The instrument’s scope has been altered since it was made. Parts 3 and 4 were revoked soon after commencement (regulations 8 and 10), and Schedule 1 (notably Part 5) was amended by later statutory rules (S.R. No. 52/2022 regs 7, 9; S.R. No. 111/2024 reg. 3; S.R. No. 87/2025 reg. 3) to add or change authorities and the specific Act sections that apply to them. These changes affect which bodies are covered and which borrowing/investment provisions attach to each."},"complexity_factors":["Large Schedule mapping many named bodies (79 councils, dozens of institutions across multiple Parts) to different subsets of Act sections, increasing administrative scale.","Each authority has bespoke lists of sections that apply, so legal effect varies substantially by entity rather than being uniform.","Repeated cross-references to the Borrowing and Investment Powers Act 1987 (the Act) — understanding effect requires checking those sections in the principal Act.","Multiple later amendments and revocations (see S.R. Nos 52/2022, 111/2024, 87/2025) change who is listed and which sections apply, increasing version-tracking burden.","Revocation of Parts 3 and 4 shortly after commencement introduces transitional and interpretative complexity.","Specific carve-outs and qualifications (for example, Treasury Corporation of Victoria entry: “Subject to the Treasury Corporation of Victoria Act 1992”) require consultation of other statutes.","Staggered commencement dates for different Parts mean different bodies became covered at different times.","Endnotes and interpretation provisions (style and ILA references) affect how the Schedule and headings are read legally."],"plain_english_summary":"These Regulations name which public bodies count as “authorities” under the Borrowing and Investment Powers Act 1987 and set out which specific sections of that Act apply to each listed body. By doing so, they determine which councils, education and health institutions, water corporations and other state entities can use the Act’s borrowing and investment powers and under what statutory rules. This matters for the listed bodies, their lenders and counterparties because it creates tailored entitlements and compliance obligations for borrowing and investing across different organisations."},"issue_detection":{"absurdities":[],"contradictions":[]}},"importantCases":[],"_links":{"self":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022","history":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022/history","analysis":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022/analysis","conflicts":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022/conflicts","importantCases":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022/important-cases","documents":"/api/acts/borrowing-and-investment-powers-authority-regulations-2022/documents"}}
