BARRANYI (NORTH ISLAND) LOCAL MANAGEMENT COMMITTEE REGULATIONS 1992

The regulations define several key concepts that structure the committee’s operation. ‘Park’ is defined in regulation 2 as the specific parcel of land on North Island, Northern Territory Portion 3997, delineated on Survey Plan S90/316B - an area of 5,421 hectares. This parcel is the physical subject of the committee’s functions. ‘Relevant Aboriginals’ has three limbs: traditional Aboriginal owners of the Park (as determined under Aboriginal tradition); Aboriginals entitled to enter and use or occupy the Park in accordance with Aboriginal tradition (whether qualified or not); and Aboriginals permitted by the first two groups to enter and use or occupy the Park (regulation 2). This definition is functional: the committee’s duties to protect the rights of relevant Aboriginals to occupy and use the Park (regulation 9(2)(f)) and to encourage maintenance of Aboriginal tradition (regulation 9(2)(g)) are framed around this category. The ‘Barranyi Aboriginal Corporation’ is the Aboriginal association incorporated under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth) - a Commonwealth body corporate that holds the nomination power for six of the ten committee members. The ‘Committee’ refers to the Barranyi (North Island) Local Management Committee itself, a body corporate established by regulation 3. The ‘Chairman’ must be elected by the committee from among the six members appointed on the nomination of the Barranyi Aboriginal Corporation (regulation 7(3)), ensuring that the committee’s presiding officer is always from the Aboriginal-nominated cohort. ‘Member’ means a member of the committee, with disqualification for members of the Legislative Assembly or Commonwealth Parliament (regulation 4(2)). The concept of ‘quorum’ is critical: six members, of whom four must be from the Aboriginal-nominated group, are required for a valid meeting (regulation 8(3)(b)). This ensures that business cannot proceed without a majority of the Aboriginal-nominated members present (or represented by proxy, which is permitted only for members of the same qualification - regulation 8(4)). The committee has a general power ‘to do all things that are necessary or convenient’ for performing its functions (regulation 9(3)), but this power is subject to the parent Act and the plan of management. The plan of management is the overarching document that constrains the committee’s determinations and recommendations - any action that conflicts with the plan would be ultra vires. The concept of ‘non-disclosure’ (regulation 10) imposes a statutory duty of confidentiality on members, with no exception for public interest or whistleblowing - only disclosures made in the course of duties are permitted. This duty may conflict with broader transparency expectations for public bodies.

The regulations directly affect several distinct groups, each with different stakes and compliance burdens. First, the Barranyi Aboriginal Corporation and the individual traditional Aboriginal owners (the ‘relevant Aboriginals’) are the primary intended beneficiaries. The corporation holds the power to nominate six of the ten members (regulation 4(1)(a)), appoint acting members when a nominee is unable to perform duties (regulation 4(5)), and advise the Minister in writing that a member nominated by it has failed properly to perform duties, which triggers mandatory termination of that member (regulation 6(1)(b)). This gives the corporation substantial control over the committee’s composition and membership discipline. The traditional owners and other relevant Aboriginals gain a formal mechanism to influence park management, protect cultural sites (regulation 9(2)(d)), and promote their traditional skills and languages (regulation 9(2)(j), (k)). However, they also bear the opportunity cost of committee service: members serve three-year terms (regulation 4(4)), must attend at least two meetings per year (regulation 8(1)), and are bound by the non-disclosure duty (regulation 10).

Second, the Northern Territory Parks and Wildlife Commission (referred to as ‘the Commission’ in the functions) is the primary government body affected. It must consult with the committee on works and facilities location (regulation 9(2)(c)), accept assistance in preparing and assessing the plan of management (regulation 9(2)(a)), and consider the committee’s recommendations on concessions, licences, charges, filming, staff training, and expenditure (regulation 9(2)(m) through (z)). The Commission cannot ignore these recommendations without some process cost, though the regulations do not impose a duty to accept them. The Commission also bears the administrative burden of supporting the committee’s operations: keeping minutes (regulation 8(5)), providing meeting records to the Minister, and making the regulations available for public inspection at its offices (regulation 11(2)). The requirement that the regulations not be published in the Gazette (regulation 11(1)) means the Commission bears the practical task of ensuring the public can access the text.

Third, the Minister for Parks and Wildlife (or equivalent) is affected through appointment and termination powers: the Minister appoints all ten members (regulation 4(1)), must publish appointments in the Gazette (regulation 4(3)), convenes the first meeting to elect the chairman (regulation 7(1)), and must terminate a member upon resignation, upon advice from the Barranyi Aboriginal Corporation that the member has failed duties, or upon becoming aware of a member’s inability to continue (regulation 6(1)). The Minister also receives copies of meeting minutes (regulation 8(5)) and may direct the chairman to call a meeting (regulation 8(2)(a)). These are ongoing compliance obligations.

Fourth, residents of Borroloola - two of whom must be appointed to the committee (regulation 4(1)(c)) - gain representation but also bear the compliance burdens of membership. Fifth, private tour operators, concession holders, and commercial enterprises are affected indirectly: the committee makes recommendations on the granting of concessions and licences (regulation 9(2)(q)), on filming (regulation 9(2)(n)), and on access by persons to areas within the park (regulation 9(2)(t)). These recommendations, while not binding, create uncertainty for businesses seeking approvals, as the Commission may defer to the committee’s views to maintain good relations. The committee’s function of encouraging Aboriginal business and commercial initiatives (regulation 9(2)(w)) may create a preference for Aboriginal-owned enterprises, potentially affecting market access for non-Aboriginal competitors.

The regulations impose several distinct duties on the committee, its members, and the Minister, while also conferring certain rights. The committee’s primary duties are enumerated in regulation 9(2): it must assist the Commission in preparing and assessing the park plan of management and amendments (paragraph (a); determine matters relating to day-to-day management to provide guidance to the Commission (paragraph (b); determine, in consultation with the Commission, the location of works and facilities (paragraph (c); assist the Commission in protecting the environment and particularly sites identified by the Barranyi Aboriginal Corporation as significant to Aboriginals (paragraph (d); nominate Aboriginals to assist the Commission in selecting employees in the park (paragraph (e); protect the rights of relevant Aboriginals to occupy and use the park (paragraph (f); encourage maintenance of Aboriginal tradition (paragraph (g); promote Aboriginal involvement in administration and management (paragraph (h); promote traditional skills (paragraph (j); promote knowledge and respect for traditional languages, culture, customs and skills (paragraph (k); make recommendations on various matters (paragraphs (m) through (q), (t), (u), (y), (z)); seek land reservations under the Mineral Titles Act 2010 (paragraph (s); and encourage Aboriginal business initiatives (paragraph (w). These are expressed as functions, but the mandatory language (‘shall’ in the structure of regulation 9(2) as a list of functions indicates they are duties to perform those functions). The committee also has a duty to meet at least twice per calendar year (regulation 8(1)), keep records of meetings (regulation 8(5)), provide minutes to each member and the Minister (regulation 8(5)), and admit advisors requested by a member (regulation 8(6)).

Individual members have a duty not to disclose information obtained in the course of duties unless the disclosure is made in the course of those duties (regulation 10). This is an absolute prohibition with no exception for public interest, good faith, or reporting misconduct - it may conflict with other legal obligations such as whistleblower protections. Members also have the right to request the committee admit advisors to a meeting to advise them on matters being considered, and to require the committee to allow those advisors to address the meeting on the member’s behalf (regulation 8(6)). However, such advisors may not vote (regulation 8(7)). Members also have the right to give a general authority to another member to vote for them at a meeting (regulation 8(4)) - essentially a proxy right limited to one proxy per member and only to a member with the same qualification (so an Aboriginal-nominated member may only proxy to another Aboriginal-nominated member). The proxy is counted towards quorum as though the absent member were present, but the authorised member cannot vote on behalf of more than one absent member.

The Minister has the duty to appoint members within the prescribed categories (regulation 4(1)), publish appointments in the Gazette (regulation 4(3)), terminate a member upon resignation, upon advice of failure, or upon becoming aware of inability (regulation 6(1)), appoint a replacement with the same qualification (regulation 6(2)), and convene the initial meeting for election of chairman (regulation 7(1)). The Minister also has the right to direct the chairman to call a meeting (regulation 8(2)(a)).

The Barranyi Aboriginal Corporation has the right to nominate six members (regulation 4(1)(a)), appoint acting members when a nominee is unable to perform duties (regulation 4(5)), and advise the Minister in writing that a nominee has failed properly to perform duties (regulation 6(1)(b)). That advice triggers mandatory termination, giving the corporation a powerful disciplinary tool over its representatives.

The regulations themselves contain no penalty provisions. There is no prescribed fine, imprisonment term, or infringement notice for any breach. The only enforceable duty with a clear sanction is the non-disclosure obligation in regulation 10. However, the regulation does not specify a penalty for breach. Enforcement would likely rely on general principles: a member who breaches the non-disclosure duty may face disciplinary action under the parent Act, common law remedies such as injunction or breach of confidence (if the information is confidential), or potentially criminal sanctions if the disclosure contravenes other laws (e.g., the Criminal Code or secrecy provisions in the Territory Parks and Wildlife Conservation Act). The absence of a penalty clause in these regulations means the practical enforcement of the non-disclosure duty is uncertain. A member could be terminated by the Minister under regulation 6(1)(c) if the breach constitutes ‘inability to continue as a member because of illness or for any other reason’ - but that provision is triggered by the Minister becoming aware of the inability, not by automatic operation. The Barranyi Aboriginal Corporation could advise the Minister under regulation 6(1)(b) that a member nominated by it has ‘failed properly to perform the duties of the member’s office’, which would include breach of regulation 10, and the Minister must then terminate the appointment. This gives the corporation a de facto enforcement mechanism, but it applies only to its own nominees, not to the two public sector employees or the two Borroloola residents.

For breaches of other duties - such as failure to hold required meetings (regulation 8(1)), failure to keep records or provide minutes (regulation 8(5)), or failure to admit advisors as requested (regulation 8(6)) - there is no express penalty. The Minister could use the direction power (regulation 8(2)(a)) to compel a meeting. Persistent non-compliance might lead to the Minister taking administrative action, potentially including recommending amendment of the regulations or dissolution of the committee, but the regulations provide no statutory enforcement mechanism. This enforcement gap creates a compliance risk: the committee’s duties are largely aspirational and coercible only through political rather than legal means.

The parent Act (Territory Parks and Wildlife Conservation Act) may contain general penalty provisions for offences relating to park management, but those are not incorporated into these regulations. The regulations do not create offences. This is a notable feature: the committee is a statutory body with functions, but its failure to perform does not attract a penalty. The only real sanction is the Minister’s power to terminate individual members, and the corporation’s power to trigger termination of its own nominees. The enforcement deficit may reduce the committee’s accountability to the public and to private stakeholders affected by its recommendations.

These regulations are made under the Territory Parks and Wildlife Conservation Act 1976 (NT) (‘the Act’) and are expressly subject to the Act and any plan of management for the park (regulation 9(1)). This means that if any provision of these regulations conflicts with the Act or the plan, the Act and plan prevail. The committee cannot take any action that is inconsistent with the plan of management - for example, its determinations on day-to-day management under regulation 9(2)(b) must be within the bounds set by the plan. The plan is likely a statutory instrument approved by the Minister and subject to public consultation, giving it higher legal force than the committee’s decisions.

The regulations also interact with the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth), which governs the Barranyi Aboriginal Corporation - the body that nominates six committee members. The corporation’s internal governance, membership, and decision-making processes are subject to Commonwealth law. If the corporation ceases to exist or is deregistered, the nomination mechanism for those six members would be disrupted, and the Minister would lose the basis for appointing replacements. The regulations do not provide a fallback mechanism.

The Public Sector Employment and Management Act 1993 (NT) defines the ‘employees’ who may be appointed as the two public sector members under regulation 4(1)(b). Those individuals are on the committee by virtue of their employment status, not as representatives of a particular agency. Their duties to the committee may conflict with their duties to their department under the Public Sector Employment and Management Act. For example, the non-disclosure duty (regulation 10) may be narrower or broader than the public sector code of conduct, creating potential double obligations.

The Mineral Titles Act 2010 (NT) is referenced in regulation 9(2)(s), which empowers the committee to ‘seek reservations of land under Part 6, Division 1 of the Mineral Titles Act 2010 in respect of the Park’. Division 1 of Part 6 deals with reservations of land from exploration and mining activities. This interaction allows the committee to advocate for the park to be excluded from mineral title applications, effectively giving the committee a formal role in land-use decisions that could affect mining and exploration interests. The amendment to regulation 9 in 2010 (by the Mineral Titles (Consequential Amendments) Act 2010) added this function, reflecting the replacement of older mining legislation.

The Interpretation Act 1978 (NT) is specifically excluded from applying to these regulations by regulation 11(1). Section 57 of the Interpretation Act ordinarily requires regulations to be notified in the Gazette and published. By excluding section 57, these regulations do not need to be published in the Gazette. Instead, copies must be available for inspection at the Commission’s offices (regulation 11(2)). This may affect the regulations’ enforceability and accessibility: if a person cannot reasonably access the regulations, the principle that ignorance of the law is no excuse may be strained. The effect is a reduced transparency requirement compared to most NT regulations.

The regulations do not interact with freedom of information or privacy legislation in any explicit way. The non-disclosure duty (regulation 10) may conflict with the Information Act 2002 (NT) if a member receives a request for information that is otherwise publicly available under that Act. The regulation likely operates as a specific secrecy provision that overrides general access rights, but this is not stated.

The regulations were originally notified on 4 August 1992 and commenced on the same day. Since then, three amending Acts have made changes, plus formal amendments under the Interpretation Legislation Amendment Act 2018. The first amendment was by the Statute Law Revision Act 2003 (Act No. 12, 2003), which commenced on 18 March 2003. This Act amended regulation 4, though the endnotes do not specify the precise change. The second amendment was by the Mineral Titles (Consequential Amendments) Act 2010 (Act No. 37, 2010), which commenced on 7 November 2011. This Act amended regulation 9, specifically adding the function to seek reservations of land under the Mineral Titles Act 2010 (paragraph (s)), reflecting the replacement of the former Mining Act with the Mineral Titles Act. The third amendment was by the Statute Law Revision and Repeals Act 2019 (Act No. 33, 2019), which commenced on 7 November 2019 (with parts 2 and 3 not yet commenced). This Act amended regulation 2, likely updating the definition of Barranyi Aboriginal Corporation from an older reference to the Aboriginal Councils and Associations Act 1976 (Cth) to the current Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth). The endnotes also record that the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made formal amendments to regulations 1, 4, 9, and 11 - these are described as ‘general amendments of a formal nature’ and likely updated drafting terminology or references without changing substance. The endnotes list the key abbreviations and provide references for commencement dates. Notably, none of the amendments altered the core structure of the committee, its composition, or the fundamental duties. The regulations have remained largely unchanged since 1992, despite changes in the governing law for Aboriginal corporations and mining titles. This stability suggests either that the committee functions adequately or that the regulations have not been a priority for reform. The lack of amendment to the composition rules (e.g., to reflect changes in the Borroloola community or public sector management) may create gaps if the original assumptions no longer hold.

The source text contains no reference to any litigation involving these regulations. The endnotes, which list amendments, do not mention any court decisions. The regulations are subordinate legislation under the Territory Parks and Wildlife Conservation Act, and any legal challenge would likely be brought under that Act or the general administrative law principles of the Northern Territory. It is possible that cases have arisen concerning the committee’s decisions or the park management plan, but the regulations themselves do not appear to have been the subject of reported judicial decisions. The absence of litigation may indicate that the committee operates without serious legal dispute, or that affected parties have not had standing or incentive to challenge its actions. The regulations provide no private right of action for breach of duty, which reduces litigation risk. The non-disclosure duty (regulation 10) could theoretically be enforced by injunction, but no cases are recorded. The committee’s advisory nature means its recommendations do not directly affect legal rights; only the Commission’s ultimate decisions are justiciable. Therefore, litigation would more likely target the Commission’s actions rather than the committee’s advice. The exclusion of Gazette publication (regulation 11) could be challenged on the basis that it impairs natural justice or the rule of law, but no such challenge is noted. Overall, this appears to be a low-litigation instrument, which may reflect its limited direct impact on third-party rights and the cooperative framework in which it operates.

Several features of these regulations may catch practitioners off guard. First, the non-disclosure duty in regulation 10 is absolute and contains no exceptions for public interest disclosures, whistleblowing, or even disclosures required by other laws (unless made in the course of duties). A member who discloses information to a journalist, a court (without a subpoena), or even to another government agency without proper authority risks breaching the regulation. The regulation does not define ‘information obtained in the course of the member’s duties’, which could include documents, verbal discussions, and draft recommendations. The absence of a penalty does not eliminate the risk: the Commission may treat breach as misconduct, and the Barranyi Aboriginal Corporation may use it as grounds to advise termination under regulation 6(1)(b). Members should assume all committee information is confidential.

Second, the quorum requirement in regulation 8(3)(b) is strict: six members must be present or represented by proxy, and of those six, at least four must be members appointed under regulation 4(1)(a) (the Aboriginal-nominated members). If fewer than four of those six are present (or validly proxied), the meeting cannot proceed, even if there are enough total members. This creates a potential for stalemate if the Aboriginal-nominated members are unable to attend. The proxy mechanism (regulation 8(4)) only allows a member to authorise another member with the same qualification to vote, and only one proxy per authorised member. This means that if only two Aboriginal-nominated members attend in person, they can hold proxies for at most two others (since the proxy holder cannot vote for more than one absent member). That yields at most four counted, which meets quorum - but if only one Aboriginal-nominated member attends, the maximum is three counted (the member plus two proxies), which fails. Practitioners advising the committee should ensure that meeting notices allow sufficient time for proxy arrangements.

Third, the chairman must be elected from among the members appointed under regulation 4(1)(a) - the Aboriginal-nominated group. This is mandatory (regulation 7(3)). The committee cannot elect a chairman from the public sector employees or the Borroloola residents, even if that person is more experienced or impartial. The chairman holds office for three years but can be removed at any time by resolution of the committee (regulation 7(6)). That power of removal rests with the entire committee, not just the Aboriginal-nominated members, which could lead to conflict.

Fourth, regulation 6(1)(b) gives the Barranyi Aboriginal Corporation the power to force the Minister to terminate a member it nominated by advising in writing that the member ‘has failed properly to perform the duties’. This is a subjective assessment by the corporation, not an objective test. The Minister has no discretion to refuse; the wording is ‘shall, as soon as practicable... terminate the appointment’. This creates a risk of political removal of members who disagree with the corporation’s leadership. Members nominated by the corporation effectively serve at the corporation’s pleasure, despite the three-year term.

Fifth, the exclusion of Gazette publication (regulation 11) means the regulations are not readily discoverable through the usual NT legislation databases. While the Commission must keep copies at its offices, a person in Darwin or interstate cannot rely on online publication. The regulations may be difficult to locate, and the Commission may not proactively provide them. Anyone dealing with the committee should obtain a certified copy from the Commission to ensure they have the current text.

Sixth, the committee’s functions under regulation 9(2)(q) allow it to make recommendations on concessions and licences for tour operations and commercial enterprises. These recommendations are not binding, but the Commission may feel compelled to follow them to avoid friction. A business that does not have the committee’s support may face additional hurdles. The committee is not required to give reasons for its recommendations, and there is no appeal mechanism. This creates a risk of arbitrary or unaccountable influence over commercial access to the public park.

For the Parks and Wildlife Commission, compliance requires establishing and maintaining a cooperative relationship with the committee. The Commission must ensure that the committee is given a meaningful opportunity to assist in preparing and assessing the plan of management (regulation 9(2)(a)). This includes providing draft documents in time for the committee to consider them, meeting to discuss, and incorporating or responding to the committee’s input. The Commission must consult with the committee on the location of works and facilities (regulation 9(2)(c)) and should document that consultation to show compliance. For day-to-day management matters, the Commission should receive the committee’s determinations and consider them as guidance, though the Commission retains authority under the Act. The Commission must also consider the committee’s recommendations on concessions, filming, charges, access, and other matters, and should record its responses. When selecting employees for the park, the Commission should accept nominations from the committee under regulation 9(2)(e) and give them due weight. The Commission should provide the committee with budgetary information relevant to the park so that the committee can make recommendations on expenditure (regulation 9(2)(z)). Practically, the Commission should assign a liaison officer to attend committee meetings (if invited by a member under regulation 8(6)) and to ensure that the committee’s minutes and records are properly kept and provided to the Minister (regulation 8(5)). The Commission must also make the regulations available for public inspection at its offices during office hours (regulation 11(2)). If someone requests a copy, the Commission should provide it promptly.

For the Barranyi Aboriginal Corporation, compliance involves nominating six members who are willing and able to serve, monitoring their performance, and appointing acting members when a nominee is unable to perform duties (regulation 4(5)). The corporation should have internal procedures for deciding whether to advise the Minister under regulation 6(1)(b) that a member has failed to properly perform duties, ensuring that such decisions are made reasonably and not arbitrarily. The corporation should also be aware that its nominees are bound by the non-disclosure duty (regulation 10) and should brief them accordingly. The corporation may wish to develop a code of conduct for its nominees.

For individual committee members, compliance requires attending at least two meetings per year (though the chairman may call more), ensuring that if they cannot attend they arrange a proxy in writing to another member of the same qualification (regulation 8(4)). Members must not disclose any information obtained in the course of their duties unless the disclosure is made in the course of those duties. This means that committee papers, discussions, and recommendations should not be shared with anyone outside the committee, the Commission, or the Minister without proper authority. Members who wish to bring an advisor to a meeting must make a formal request under regulation 8(6); the committee must then admit that advisor, but the advisor cannot vote. Members should also be aware that they can be removed mid-term by the Minister upon the Minister’s own motion (regulation 6(1)(c)) or, if nominated by the corporation, upon the corporation’s advice (regulation 6(1)(b)).

For the Minister, compliance involves making appointments within a reasonable time after a vacancy arises (regulation 6(2)), publishing appointment notices in the Gazette (regulation 4(3)), and terminating members as required by regulation 6(1). The Minister should also convene a meeting for election of a new chairman whenever that office is vacant (regulation 7(1)). The Minister should review the minutes provided by the committee (regulation 8(5)) and may use the power to direct a meeting (regulation 8(2)(a)) if the committee is not functioning properly.

For private businesses and tour operators seeking concessions or licences in the park, compliance with the regulations is indirect: they should be aware that the committee makes recommendations on these matters (regulation 9(2)(q)), and they may wish to engage with the committee early to understand any concerns. However, there is no formal requirement to seek the committee’s approval. Businesses should also note that the committee has a function to encourage Aboriginal business initiatives (regulation 9(2)(w)), which may affect market access. Recommending against a non-Aboriginal business does not breach any duty if done in good faith, but affected businesses should be prepared to make representations to the Commission if they believe the recommendation is unreasonable.
