Members serve three-year terms and may be reappointed (reg 4).\n- Prescribes how the Committee elects a Chairman (the Chairman must be one of the six members nominated by Barranyi Aboriginal Corporation), meeting rules (including minimum two meetings a year, quorum and voting rules), proxies, minute-taking and the Minister’s powers to call meetings (regs 7–8).\n- Lists the Committee’s functions and powers, principally advisory and management-orientated duties: assisting with the Park’s plan of management, advising on day-to-day management, locations of works and facilities, protection of culturally important sites, nomination of Aboriginal persons for Park employment, advice on concessions and licences for commercial operations, entry charges, camping, access, staff training (with Aboriginal content), promoting Aboriginal involvement and traditional skills, and recommending how Park budget allocations are spent (reg 9). The Committee may also seek reservations of land under the Mineral Titles Act in respect of the Park (reg 9(2)(s)).\n- Prohibits members from disclosing information obtained in the course of duty except as part of their duties (reg 10).\n- Requires publication/availability of the Regulations at Commission offices (reg 11).\n\n**Who this affects**\n\n- Local Aboriginal people with traditional rights and association with the Park (defined as “relevant Aboriginals”) — the Regulations directly protect their rights to occupy and use the Park and require promotion of their culture and involvement (reg 2 definition; reg 9(2)(f)–(m), (y)).\n- Barranyi Aboriginal Corporation — nominates the majority of Committee members and can advise the Minister when a nominated member is not performing (reg 4(1)(a), 6(1)(b)).\n- Residents of Borroloola — two seats are reserved for them (reg 4(1)(c)).\n- The Minister and the relevant conservation Commission — the Minister appoints members and convenes initial meetings and may direct meetings; the Committee’s role is mainly to assist and make recommendations to the Commission (regs 3–4, 7–9).\n- Commercial operators, tour operators and prospective concession-holders — the Committee makes recommendations to the Commission about concessions, licences, entry charges and use of the Park (reg 9(2)(q), (r)).\n- Government agencies (the Commission and public sector employees) — two public sector employees sit on the Committee and the Committee works subject to the Territory Parks and Wildlife Conservation Act and the Park’s plan of management (reg 4(1)(b), 9(1)).\n\n**Why it matters (purpose-claims and practical effects)**\n\n- The Regulations are designed to give local Aboriginal stakeholders and nearby residents a formal, structured role in advising on the management of Barranyi (North Island) Park. The instrument assigns a mix of nomination rights (Barranyi Aboriginal Corporation), ministerial appointment power and statutory duties for the Committee (regs 2, 4, 9).\n\n- In practice the Committee is an advisory management body: it can set guidance on day-to-day management, nominate staff, recommend policies on access, commercial use and fees, and encourage Aboriginal employment and cultural programming — but core statutory control remains with the Commission and the Act (reg 9(1)–(2)). That means the Committee influences decisions through recommendations rather than by unilateral authority.\n\n- The Committee is given one specific statutory lever related to mineral tenure: it may seek land reservations under the Mineral Titles Act in respect of the Park (reg 9(2)(s)). This creates a formal route to affect whether mineral exploration or mining can be pursued in the Park area.\n\n**Who pays, who decides, and what behaviour changes**\n\n- Who pays: administrative and operational costs of running the Committee and implementing its recommendations would be borne by the responsible government agency (the Commission) and ultimately by public funds; commercial impacts (e.g. concession terms, entry charges) will affect private operators if the Commission adopts the Committee’s recommendations (reg 9(2)(q), (r), (z)).\n\n- Who decides: the Minister appoints members and convenes the initial meeting; Barranyi Aboriginal Corporation nominates six members and therefore controls a majority of nominations; the Committee elects its Chairman from those six nominated members (regs 4(1)(a), 4(3), 7(1)–(3)). The Commission retains statutory decision-making authority and the Committee’s role is primarily to advise (reg 9(1)).\n\n- Behaviour changes expected: the instrument institutionalises local consultation and Aboriginal involvement in Park administration, making it more likely that management decisions (location of infrastructure, staffing, training content, licensing, camping rules, entry charges) will reflect local input. Private operators seeking concessions or licences will need to factor in Committee recommendations when negotiating with the Commission (reg 9(2)(q)–(r)). The Committee’s ability to seek mineral reservations may affect prospective mining exploration activities (reg 9(2)(s)).\n\n**Trade-offs, incentives and implementation risks**\n\n- Binding force: the Committee’s functions are largely advisory (reg 9(1)); the Commission is the formal decision-maker. This limits direct regulatory intervention by the Committee but gives it scope to shape policy through recommendations. The effectiveness of the Committee therefore depends on how the Commission treats its advice.\n\n- Concentrated vs diffuse effects: the Committee concentrates appointment influence (Barranyi Aboriginal Corporation nominates 6 of 10 members — reg 4(1)(a)) and so provides concentrated representation for that body; broader public interests are represented more diffusely through the Commission, public sector members and Borroloola residents. This concentration can focus benefits (e.g. employment, concessions) on locally-favoured outcomes if the Commission accepts recommendations.\n\n- Commercial implications: recommendations on concessions, licences and entry charges (reg 9(2)(q), (r)) can materially affect private operators’ costs and opportunities. Because recommendations are non-binding, private operators face uncertainty about outcomes and may need to engage with both the Committee and the Commission.\n\n- Administrative and compliance burdens: the Committee must keep minutes, publish appointments in the Gazette, and make regulations available for inspection (regs 4(3), 8(5), 11). Members are restricted from disclosing information outside their duties (reg 10), which creates an administrative duty to manage confidential information.\n\n- Appointment and removal mechanics: the Minister appoints and replaces members (regs 4, 6). The Barranyi Aboriginal Corporation may advise the Minister if a nominated member is not performing (reg 6(1)(b)). This creates a combined mechanism of community nomination and ministerial control, with potential for disagreement over replacements and performance management.\n\n**Key provisions to look at for specific detail**\n\n- Definitions and scope of \"relevant Aboriginals\" and \"Park\" — reg 2.\n- Committee composition, appointment, term, acting members and vacancy rules — reg 4.\n- Chairman election and removal — reg 7.\n- Meeting rules, quorum (including proxy voting rules), minimum meeting frequency and record-keeping — reg 8.\n- Full list of advisory functions and the specific power to seek reservations under the Mineral Titles Act — reg 9.\n- Confidentiality obligations for members — reg 10.\n\n"},"summary":{"complexity_score":3,"scope_assessment":{"changed":false,"description":"Based on the available information, the regulations appear to remain focused on their original purpose: governing the operation of the Barranyi (North Island) Local Management Committee.
