What it does
This instrument, titled the Autonomous Sanctions (Designated Persons and Entities and Declared Persons - Afghanistan) List 2025, formally designates four named individuals for the purposes of paragraph 6(a) of the Autonomous Sanctions Regulations 2011, and declares those persons in Part 1 of Schedule 1 for the purpose of preventing them from travelling to, entering or remaining in Australia (see s 4(1)-(2) and Schedule 1, Part 1). The instrument was made by the Minister for Foreign Affairs (PENNY WONG) and dated 5 December 2025 (cover sheet). It commences the day after registration, in accordance with the commencement table (s 2(1)). The instrument’s effect is to create, on the Commonwealth register, a list entry that attaches the legal statuses “designated person or entity” and “declared person” to the named individuals for Afghanistan (s 4 and Schedule 1).
Mechanically, the text does three things:
- It establishes the instrument’s name and date (s 1 and instrument header).
- It fixes commencement as the day after registration (s 2(1)).
- It invokes the statutory authority in paragraphs 6(a) and 6(b) of the Autonomous Sanctions Regulations 2011 to (a) designate persons or entities for Afghanistan and (b) declare people for the purpose of preventing travel to, entry to or remaining in Australia (s 3; s 4(1)-(2)).
The Schedule (Schedule 1, Part 1) lists four individuals by name, multiple aliases, multiple years of birth where applicable, place of birth, citizenship and additional information including titles and ethnicity. For each listed individual the instrument records the instrument itself as the “Instrument of first designation and declaration.” The instrument itself contains no description of penalties, enforcement steps, or administrative processes beyond the designation and declaration entries; it refers to the Autonomous Sanctions Regulations 2011 as the enabling authority without reproducing those Regulations’ operative consequences (s 3; s 4).
