What it does
This instrument, made by a delegate of the Australian Prudential Regulation Authority (APRA) under paragraph 51(1)(a) of the Australian Prudential Regulation Authority Act 1998 (APRA Act), fixes charges for five specified services and facilities provided by APRA to the Australian Bureau of Statistics (ABS) and the Reserve Bank of Australia (RBA) during the 2024-25 financial year. It is a legislative instrument that commences on the date of registration on the Federal Register of Legislation, dated 23 June 2025.
Mechanically, the instrument does three things. First, it imposes a charge of $243,492 on the ABS for the provision of statistical information listed in Attachment 1, and $420,486 on the RBA for the statistical information listed in Attachment 2. Both Attachments consist of collections of standard APRA reporting forms - mostly those with form codes beginning “ARF” (APRA Reporting Framework) or “SRF” (Special Reporting Framework) - that require financial sector entities to submit data on balance sheets, loans, deposits, derivatives, repurchase agreements, housing finance, business credit, and other metrics. Second, it recovers development costs of the Economic and Financial Statistics (EFS) collection system: $14,291 from the ABS and $18,189 from the RBA. Third, it recovers $97,426 from the RBA for the maintenance and support costs of the data sharing Application Programming Interfaces (APIs) used by the RBA.
Each charge is payable 28 days after receipt of APRA’s invoice. The instrument expressly states that none of the charges are subject to GST under the A New Tax System (Goods and Services Tax) Act 1999. APRA may waive or refund any amount, in whole or part, if satisfied it is appropriate in the circumstances, but a waiver is effective only if given in writing. The instrument constitutes a cost-recovery mechanism for specific inter-agency services; it does not impose any new data-collection obligations on regulated entities directly. Rather, it funds the administrative and technical infrastructure that APRA operates to compile and transmit the data that financial sector entities are already required to provide under the Financial Sector (Collection of Data) Act 2001 and APRA’s prudential standards.
